Please be advised that based on the submitted February 3, 2004, Geologic Hazard Area Assessment, prepared by Scott S. Riegel of Earth Consultants, Inc., the City has determined that the subject property does not contain a Geologically Hazardous Area and as such, is not subject to SEPA review. Community Development review of the short plat has continued as we await the information identified by Kim Scattarella in his October 30,2003,engineering comments. Based on Planning Division review,the following additional required information has been identified. According to the City of Federal Way's Environmentally Sensitive Areas map,the property in question is located in a landslide hazard area and erosion hazard area. The Federal Way City Code(FWCC)Section22-1,defines a Geologically Hazardous Area(GHA), as any area containing the following: 1) Erosion Hazard Areas—Those areas having a severe to very severe erosion hazard due to natural agents such as wind,rain, splash, frost action,or stream flow. 2) Landslide Hazard Areas—Those areas potentially subject to episodic down slope movement of a mass of soil or rock. 3) Seismic Hazard Areas—Those areas subject to server risk of earthquake damage as a result of seismically induced ground shaking, slope failure,settlement or soil liquefaction,or surface faulting. 4) Steep Slope Hazard Areas—Those areas with a slope of 40 percent or greater and with a vertical relief of 10 or more feet, a vertical rise of 10 feet or more for every 25 feet of horizontal distance. Mr.Mike Luna Page 2 December 23,2003 In order to ascertain whether the property does in fact contain a GHA, it is necessary to submit a soils report,prepared by a qualified professional engineer licensed in the State of Washington that analyses this question based on the definition of a GHA(enclosed).If it is determined that the property does in fact contain a GHA, it will be necessary to conduct environmental review under the State Environmental Policy Act(SEPA), as part of the short plat application. Please be advised that the City may require third party review of the environmental document,which would be conducted on a cost-recovery basis.The fee for SEPA review in 2004 will be$817.00,and SEPA requires public notification of all owners and occupants within 300 feet of the subject property. At a minimum, the improvements shall include a 24' paved street from Dash Point Rd to the site. additionally, planter strips with street trees, side walk, and street light will be required along the frontage. It appears that the existing 60' ROW is adequate to accommodate the improvements." While the client in this project expected to provide curb gutter and sidewalk along the property frontage, the requirement to extend this improvement to SW Dash Point Rd. very much alarmed us. For the sake of clarity we would like to have this requirement revisited by the City. Specifically we would like this requirement viewed as it relates to the following questions. 1. The requirement is to improve the street from SW Dash Point Rd. to the site. Is this to be interpreted as from the existing intersection of Dash Point and 30th Ave or from the intersection of 28th Ave and unconstructed Dash Point Rd? 2. The requirement to improve the street to City standards seems to imply that we would be improving the street on both sides of the street. Is this so? In several projects we have worked with the City on, the requirement has always been % street improvements. Also what is the cross section the City will be requiring for this? While we are waiting for these questions to be addressed, we would appreciate the City reviewing this requirement in the light of the following discussion we plan to use for a modification request. We believe that by addressing these issues at this time it will save everyone involved a substantial bit of time. 1. We realize that the City code provides for off site improvements in section 22-1475. At the same time these requirements are stated as "appropriate to improve traffic circulation and safety, the need for which is directly attributable to the development of the subject property." A. If the proposed improvements are to go only to the intersection of 28th Ave and the south Right Of Way line of Dash Point Road, the improvement to traffic circulation and safety is very difficult to perceive. The question needs to be asked, How can adding 2' of pavement to a freshly paved 22' road along a section of road 253' long improve traffic circulation? The sidewalk that would accompany this improvement would front one home and end abruptly at the intersection of the future Dash Point Road, approximately 400' short of the existing intersection at 304th, 30th, and 28th As Dash Point Rd has yet to be constructed, this would leave the proposed sidewalk "hanging"with no real prospect of being continued farther north. In relation to the properties on the west side of the road this sidewalk would look exceptionally out of place. This more than qualifies for the modification reason of the improvement not being harmonious with the existing street improvements. B. If the proposed improvements are to extend from the site, north to the intersection of 304th, 30th and 28th, then around to the existing intersection of Dash Point Rd. and 30th that portion of the code that states the improvements are to be "directly attributable to the development of the subject property." comes into question. The improvements as stated would force the examination of the intersection at 304th, 30th and 28m to determine the need for a redesign of this odd 3 way intersection. Then the improvements would have to continue west to the intersection with Dash Point Rd. The costs for this to be surveyed, engineered, reviewed and built are appropriate for a development of maybe 20 lots, adding several scores of vehicles and people to the existing traffic at this location. However, for a project of this size, adding only one additional home to the existing density of the area, the costs are beyond the scope of any developer. It is hard to believe that the addition of this project could so dramatically change the face of the traffic situation, that these improvements could be "directly attributable to the development of the subject property." As it relates to being harmonious to the existing neighborhood, this would make 28th, a dead end street, the only street within the area to have curb, gutter, and sidewalk. The other streets in the area have higher densities and better circulation but are not built to this standard. Cleary this would conflict with the atmosphere of the surrounding neighborhood. 2. 28th Ave. as it currently exists, is a freshly paved street (paved within the past 6 months). This pavement varies slightly, but overall is 22' wide all the way north to 30th Ave. We discussed with the traffic dept. the minimum this road can be modified to from 24' is 22'. If the improvements only extend to the intersection of 28th and unconstructed Dash Point Rd. the length of this improvement would be approximately 253' feet. Widening this road the additional 2' to meet the 24' would require the realignment of the ditch, reconstructing the neighbor's drive and adding 2' of asphalt to the western edge of pavement. While this sounds simple on paper the facts are thus: A. The west edge of pavement is directly next to a ditch . This ditch will have to be moved into the yard currently maintained by the neighbor at least 12', to accommodate the pavement, sidewalk and planting strip. In effect this reduces the yard of this neighbor by at least 15' (including the ditch). In effect placing this home with a nice large front yard, closer to the street than any of the other homes on the street. Again not harmonious with the surrounding area. B. Will the City allow us to add 2' of asphalt to the west edge of pavement or will we have to repave the entire width of the road for a specified distance in each direction?Again, while this is an appropriate requirement for a large project, the costs associated with this requirement in just this small area far outweighs any benefit that will be gained. C. The installation of this requirement will at least be required to the intersection of 28th and Dash Point road, if not farther. The future construction of Dash Point will cause at least a portion of this improvement to be destroyed as it will have to be a controlled intersection. Are we to assume we are installing improvements only to have them removed at a later date? D. Individually these facts are insignificant in themselves. When put into the context of the additional 506 square feet of asphalt added to the freshly paved street in relation to the tens of thousands of dollars required to survey, engineer, review, install and as-built the improvements, it is exceptionally hard to find this requirement for off site improvements to be "commensurate" as stated in section 22-1474 or"necessary, appropriate or needed" as stated in section 22- 1475. E. To meet the requirements of section 22-1477, it should be stated that this requirement would not be harmonious with the existing street improvements for the reasons below 1. 1. The freshly paved road extending from the site to 30th was allowed to remain 22' wide just 6 months ago. There must have been a reason this repavement was allowed to not meet current code. ,. • 2. The sidewalks that would be installed would only go to larger, more traveled roads that have no improvements. This would ultimately lead pedestrian traffic to the intersection at Dash Point and 30th. Again, a major arterial that has no sidewalks or reason for pedestrian traffic. Clearly this is not harmonious or safe. Therefore we would request, for the reasons stated above, that the requirement as stated in your January 26th letter be modified to exclude off site improvements to Dash Point Rd.
