The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department,and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way City Code(FWCC) and relevant information handouts are enclosed with this letter.Please be advised,this letter does not represent all applicable codes.In preparing your formal application,please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION The applicant proposes to construct a 3,130 square-foot single-family residence on a 15,300 square-foot vacant lot.The site contains a potentially regulated stream and is also mapped as an erosion hazard area. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review.These issues can change due to modifications and revisions in the plans.These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided.The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. • Planning Division The proposed location of the house is within a stream setback area.A stream analysis is required to determine the category of the stream. A Use Process IV application and SEPA review are required to grant an intrusion into the setback area. See comments below under`Planning' heading. Mr.and Mrs.Gupta Page 2 March 28,2006 • Public Works Development Services Division The project appears to meet the thresholds for Small Site Drainage Requirements. However, with the critical areas on and near the site,the project is required to submit a Category I Targeted Technical Information Report, as outlined in the 1998 King County Surface Water Design Manual. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference.Each section should be read thoroughly. If you have questions,please contact the representative listed for that section. PLANNING DIVISION (Isaac Conlen,253-835-2643,isaac.conlen@cityoffederalway.com) 1. Zoning—The site is zoned Single-Family High-Density Residential (RS 9.6). A single-family residence is a permitted use in this zone. 2. Bulk and Dimensional Regulations—Bulk and dimensional requirements are contained in Federal Way City Code(FWCC)22-631.Minimum yard dimensions are 20 feet in the front, five feet on the sides, and five feet in the rear. Note: the submitted site plan does not appear to meet the front yard setback requirement. Maximum permitted height in this zone is 30 feet above average building elevation.Maximum lot coverage is 60%. 3. Review Process—The proposed building location appears to be within a required stream setback. A proposal to locate improvements within a stream setback requires review by the City Hearing Examiner pursuant to Use Process(UP)IV and State Environmental Policy Act(SEPA)process.UP IV applications are reviewed pursuant to the provisions of FWCC 22-431-461.UP IV applications require mailed notice to neighbors within 300 feet and a public hearing before the City Hearing Examiner. If the applicant is unable to satisfy the criteria for intrusion into a stream setback(see item 7 below), the application may be processed as a reasonable use exception.The reasonable use exception will only be considered if it is determined by the City that the applicant cannot meet the criteria for approval under Use Process IV. Reasonable use exceptions for single-family residences can be reviewed as a Use Process III application.However,if the reasonable use exception is required, it will be processed concurrently and in conjunction with the UP IV application. 4. SEPA Review—As noted above, SEPA review is required in association with the UP IV application. A completed SEPA checklist is required as a part of the formal application. See below for mailing notice requirements. 5. Lot Line Elimination (LLE)—The subject property is comprised of three legal lots. A lot line elimination is required to eliminate interior lot lines that are nonconforming or are crossed by the proposed structure. Please refer to the enclosed handout. 6. Stream Analysis —As you have noted,a stream is identified on the west side of the subject property. You indicate your consultant has determined the stream to be a major category stream. Submit a stream analysis report with your formal application.Per FWCC 22-1306(a),a major stream has a 100-foot building setback. The proposed structure falls within the 100-foot setback area. As noted above, intrusions into stream setbacks may be approved through Process IV, subject to the criteria of FWCC 22-I312(c).You will likely want to utilize the services of your stream consultant to prepare a response to the above-referenced criteria. 8. Geologically Hazardous Area—City critical area maps indicate the site is in an erosion hazard area, which is considered a geologically hazardous area. Improvements may not be located within 25 feet of a geologically hazardous area,unless no reasonable alternative exists and then only if the development activity will not lead to or create any increased erosion hazard as demonstrated by geotechnical analysis(FWCC 22-1286(b)). Please submit a geotechnical report with your application that identifies the extent of the geologically hazardous area and the need to intrude, if applicable. The report should also address building foundation and other construction related issues. 9. Public Notice—The UP IV requires a mailed notice of application as well as a mailed notice of public hearing. The SEPA review requires a notice of decision. All three notices are mailed to property owners within 300 feet of the subject property. Please refer to the enclosed handout and submit three sets of stamped envelopes and supporting materials as indicated. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Sean R.Wells,P.E.,253-835-2731, sean.wells@cityoffederalway.com) Land Use Issues—Stormwater 1. Due to the stream and wetlands on site, surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual(KCSWDM)and the City of Federal Way Addendum to the 1998 KCSWDM, Section C.4. This project meets the requirements for a Category 1 Targeted Drainage Review. At the time of building permit site plan submittal, a Technical Information Report(TER), addressing the relevance of the project to the core and special requirements of the KCSWDM will be required.Also per these requirements,the applicant must provide one of the following: a. A 100-year floodplain analysis,performed by a licensed engineer currently registered in the State of Washington, or, b. Demonstrate that the proposed building is located at Ieast 10 feet above the ordinary high water mark(OHWM)of the stream and/or wetland, or is located at least two feet above the downstream overflow elevation. 2. All runoff generated from the new impervious surfaces(roofing,asphalt,concrete,compacted gravel, etc.)must be controlled employing Best Management Practices(BMP's)as outlined in the KCSWDM Appendix C, Small Site Drainage Requirements. 3. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. Information regarding this permit can be obtained from the Washington Department of Fish and Wildlife, at http://www.wa.gov/wdfw/hab/hpapage/htm or by calling the office of Regulator Assistance at 360-407-7037. 5. A geotechnical report that addresses the Best Management Practices(BMP's),as provided in the 1998 KCSWDM for the control of runoff from the roof downspouts and new driveway,must be submitted at,or prior to,permit application. 6. Show on the building permit site plan,with dimensions, the proposed location of the stormwater facilities. 7. The first 40 feet of the driveway must be paved. Right-of-Way Improvements Street improvements,meeting current City street standards(additional pavement width,curb, gutter, sidewalk,planter strip), are required along the property frontage in 3rd Avenue SW.However, the applicant may submit a Right-of-Way Improvement Modification Request to have the required improvements modified or waived. LAKEHAVEN UTILITY DISTRICT(Brian Asbury,253-946-5407,basbury@lakehaven .org) Water • A water meter application is required for a separate meter/service for any new connection to the water distribution system, in accordance with standards defined in Lakehaven's current'Fees and Charges Resolution'. Sewer * A side sewer permit is required for any new connection to the sanitary sewer system, in accordance with standards defined in Lakehaven's current 'Fees and Charges Resolution'.Minimum slope for gravity side/building sewers is 2%. * An existing side sewer stub located near the northwest portion of the property is available for sewer connection (drawing enclosed). If this location is not suitable due to site development restrictions, connect can also be made to an existing 8-inch diameter mainline south of the property.This latter connection may require the owner to acquire a private, sewer easement. General * Lakehaven's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units (ERU).Residential equivalency for Single-family use is calculated as 1.0 ERU per unit. Prepared for Steve Mackey Prepared on February 17, 2006 The following scope of work and cost estimate was developed by Sheldon & Associates, Inc. (S&A) for determining stream classification and buffer width on a property located in Federal Way, Washington. This property(parcel#119600-1465)located near the intersection of SW 293rd and 3`d Avenue SW is owned by Steve Mackey. The classification of a stream (major or minor) according to the City of Federal Way needs to be identified where it is near the property. This is a not-to-exceed cost estimate and the client will be billed as hours and expenses are accrued. This cost estimate will not be exceeded without the prior permission of the client. Task 1 —Review Background Data S&A will review existing information on the soils, wetlands, streams and other sensitive areas in the project vicinity. Sources for such information may include, but are not limited to, King County Soil Survey, King County Sensitive Areas maps, and the Federal Way Wetland Inventory maps. Task 2—Conduct Site Reconnaissance S&A will conduct a site reconnaissance of the property to assess conditions of a stream that drains into Poverty Bay. This involves determining what class of stream and associated buffer width would be according to the City of Federal Way. This is based on whether the stream provides fish habitat and if there are any natural migration barriers to fish. We will also flag the ordinary high water mark(OHWM)along both banks of the stream on the property. Assumptions • S&A will only assess the stream classification on the property,which does not involve conducting a stream survey of fish habitat. This assessment may require off-site reconnaissance of natural migration barriers downstream of the property, which can be accessed from public right-of-way. • S&A will provide a hand-sketched map of the OHWM boundary to the surveyor so that they can survey the stream banks under a separate contract. Task 3— Prepare Letter of Findings S&A will prepare a letter summarizing our findings on stream classification and buffer width identified on the property. We will determine what the stream classification(Chapter 22-1)and buffer width (Chapter 22-1306) is consistent with City of Federal Way code requirements. We will provide a map of the stream we observe on the property and the surrounding drainage area. Assumptions • S&A will prepare a draft letter for the clients review. We will incorporate any changes the client requests and provide a final letter. Deliverables • An electronic copy of the draft letter in pdf format and a field sketch will be sent to the client for review.
