Originally,the site plan showed the driveway entering the property off the southeast corner of the lot from 314 Avenue SW. Since the approval of the Process IV,the Gupta's(applicant)have received an easement from the adjoining property to the.south of the lot to access the lot from SW 294th Street. The modification letter requests that the access to the lot be from SW 294th Street. Per Federal Way City Code(FWCC) Section 22-460(b), if a specific use or site configuration for the subject property was approved under[FWCC Article VII: Process IV Review—Hearing Examiner Decision],the applicant is not required to apply for and obtain approval through[that] article for a subsequent change in use or site configuration unless: 1. There is a change in use and this chapter establishes different or more rigorous standards for the new use than the existing use; or 2. The Director of Community Development Services determines that there will be substantial changes in the impacts on the neighborhood or the city as a result of the change. Upon review of the modification request, it has been determined that the proposed driveway location does not change the use of the approved single-family home,and therefore,more rigorous standards are not required.Additionally,the location of the new driveway is still within the approved intrusion area as approved through the Hearing Examiner's Decision#06-103-491-00-UP.There will be no substantial changes in the impacts on the neighborhood or the city as a result of the proposed new driveway location. The City hereby grants the approval of the site plan modification in regards to the driveway location of#06-103491- 00-UP. Please submit revisions to your building permit to show the modifications to the site plan. Proof of easement rights must be submitted to Public Works along with your revisions to the building permit.
