On January 10,2002,the City of Federal Way's Development Review Committee (DRC)met to discuss outstanding issues related to your application. Pursuant to Federal Way City Code (FWCC) Section 20-44, upon receipt of an application,the City has 28 days to determine whether all required information and documentation has been submitted. Completeness for a boundary line adjustment application is predicated on the information required in FWCC Sections 20-43 and 20-83 (enclosed). Based on a review of your submittal relative to those requirements,your application is deemed incomplete as of today's date(January 22, 2002). The following information is required in order for the City to commence formal review of the proposed BLA: The location of all existing driveways and recorded easement for access, utilities, or other purposes must be depicted on the short plat map. The submitted drawing does not show the location of the following easements: 1)Auditor File Number 9001049001; and 2)Auditor File Number 9307210476. The submitted drawing also fails to indicate the location of the driveways providing access to the house located on parcel number 195460-0046. Upon receipt of the requested information,the City has 14 days to review the resubmittal and notify you whether the application is complete or whether additional information is necessary. Although formal review of the BLA will not commence until a complete application has been submitted, the following issues must be also be addressed in relation to this application. The zoning of the subject site is Single Family Residential, (RS-15.0). This zoning district requires a minimum lot size of 15,000 square feet. Lot 2,which was created in 1990 via short plat number ILA 90- Mr. Mel Garland Page 2 January 22,2002 • 0001-SP, is less than the required 15,000 square feet. The proposed BLA does not make Lot 2 more nonconforming, however, it does create a highly irregular lot line along the southeast corner of this lot.As such,the proposed BLA does not satisfy City lot design standards of FWCC Section 20-152 (a)and is not permissible. This configuration must be addressed before the City can continue in its review of the BLA application. The following comments are intended to provide additional information on how the proposal could potentially be reconfigured to satisfy city code requirements.The applicant has indicated that the objective of this BLA is toadjust a common lot line to follow an existing fence line. This fence is along the southern edge of Mann's property and follows the northern boarder of a narrow paved drive off of 11`h Avenue SW that leads to the Quist property located on parcel number 195460-0046. If the property owners are intent on adjusting lot lines to provide ownership of the existing 11th Avenue SW access to parcel number 195460-0046,then that access and accompanying BLA must comply with current City standards. For your information, an acceptable lot configuration, known as a"pan handle,"could serve to achieve the apparent purpose of the proposed BLA. The access panhandle would need to be a minimum of 30 feet wide and improved to City driveway standards(20 feet of paved driving surface)in order to provide access between 11`h Avenue SW and the Quist property. Be advised that in creating an acceptable lot design, it is necessary that reconfigured lot lines maintain a required five-foot setback between existing structures and vehicular access easements and/or adjacent lot lines. Given the location of the existing home on the Mann's property, it appears that it would be necessary to include the second Quist property to the south(parcel number 195460-0050), if the required 30 foot wide pan handle access is to be satisfied without impacting the existing Mann home.However, based on the submitted survey, it appears that the garage located on the second Quist property(parcel number 195460-0050)would need to be removed or relocated in order to create the requisite 30 foot wide area for the panhandle driveway. It is not possible for the City to continue its review of the submitted application until the issues related to the BLA configuration are satisfactorily addressed. Upon receipt of a resubmitted application,the City will make a determination as to whether all required information and documentation has been submitted, pursuant to FWCC Section 20-44. Completeness for a boundary line adjustment application is predicated on the information required in FWCC Sections 20-83 and 20-43 (enclosed). Please be advised that there is a second issue relating to parcel number 195460-0046 that has come to the city's attention in the course of reviewing the proposed BLA.According to the conditions of approval that were issued for construction of the single family home on lot number 195460-0046(permit number BLD93-2587),the primary access to this home is to be provided from Marine View Drive SW, per the plat language stipulated in the 1990 short plat. The face of this plat shows a 12-foot wide access tract off of Marine View Drive SW, approximately 18 feet north of the south lot line;this access area is located on the subject site(parcel number 195460-0046.) Recent site inspection revealed that this approved access point was never developed,possibly due to the steep topography of the site. There is a graveled vehicle access provided to the parcel from a driveway on the property to the south. The critical issue in this matter is that the approved driveway access for parcel number 195460-0046 was never developed. The access from 11`h Avenue South is via an easement agreement, and the access from Marine View Drive appears to also be via a separate property(parcel number 195460-0050.)The submitted BLA shows an easement number 9001049001 from Marine View 01-104806-000-00-SU Doc.I .17634 4. Mr. Mel Garland Page 3 January 22, 2002 • Drive SW to parcel number 195460-0050, but it does not indicate the actual location of this easement. Resubmittal of this application must include a copy of the language of the recorded easement and the plat must indicate the accurate locations of all access easements. In that the short plat language stipulates that primary access to parcel number 195460-0046 shall be from Marine View Drive SW, it is necessary for the owner of the property to either provide the stated access, or to submit for a plat alteration that removes this restrictive language from the face of the plat. If access for parcel number 195460-0046 is not provided on site, but rather via an access easement with the property to the south,then the plat map must be altered and approved by the City to include both the location and recording number of this access easement. For your information, it would be possible,via a plat alteration,to achieve the following: 1)process a BLA;2)remove the language relating to the primary access point on Marine View Drive SW; and 3) potentially address the access easement issue from Marine View Drive.The fee that has been paid for the BLA could be applied to the short plat processing fee of$1,674. Proceeding with the BLA and applying for the required plat alteration need not be mutually exclusive applications. However, either a plat alteration will be required to address the primary access issue for lot number 195480-0046, in that the existing home on this parcel is currently in violation of the conditions of building permit approval, or the primary driveway must be provided in accordance with the approved short plat. Any statutory lien for services,labor or materials(or the claim of priority of any statutory lien for services,labor or materials over the lien of the insured mortgage)ansing from an improvement or work related to the land which is contracted for and commenced subsequent to Date of Policy and is not financed in whole or in part by proceeds of the indebtedness secured by the insured mortgage which at Date of Policy the insured has advanced or is obligated to advance. 7.
