Dear: Mr.Bennett
The City has completed the administrative review for approval of the short plat application to
subdivide one piece of property located at 2930 South 288th Street into three lots for single-family
residential development.The short plat application is hereby granted conditional approval as
follows.
Pursuant to modification request 04-101466-00-SM, street frontage improvements
must be constructed within 30th Avenue South, including a 20-foot paved roadway (as
measured from right-of-way centerline); vertical curb and gutter; a four-foot planter
strip with street trees and street light(s); a five-foot concrete sidewalk, and three-foot
utility strip. Additionally, 20-feet of paved roadway must extend to the north to
connect to the existing, paved roadway. These improvements also shall align and
connect with the existing street improvements located to the south of this proposed
short plat.To accommodate the required improvements, an additional ten feet of right-
of-way along the existing property frontage is required to be dedicated to the City.
Before beginning any of the improvements outlined above,the applicant must submit three sets of
engineering drawings (with the enclosed Resubmittal Information form)of the proposed work for
review and approval by the Department of Public Works. A completed City permit application,
and associated fees,must accompany the engineering plan submittal.The City will issue permits
for construction of the required improvements following review and approval of the engineering
drawings,payment of all related fees,and submittal of performance securities, if any.
Once the Department of Public Works inspects and approves the completed frontage, or other
required infrastructure improvements,the City will record the short plat.At that time, we will
advise you to deliver two reproducible mylars of the short plat bearing the signatures of all vested
owners of the property, along with any recording fees.
This decision is based the results of this review,contained in the enclosed Exhibit A,Findings and
Conclusion for Director's Decision,Kang Short Plat,File No. 03-103394-000-00-SU. The review
was conducted according to Federal Way City Code(FWCC)Chapter 20,Article I, and applies the

standards in FWCC Chapter 22,Article XI, "District Regulations,"for the Single-Family

Appeal Process
Any person who receives a copy of this decision may appeal the decision within 14 days of the
date of issuance.The decision may be appealed in the form of a letter delivered to the Department
of Community Development Services by December 8,2005,at the following address:

Any affected property owners may request a change in valuation for property tax purposes,
notwithstanding any program of revaluation.
Duration of Approval
Short plat approval expires one year from the date of issuance of this decision unless recorded
with King County.However,the applicant may submit a written request in the form of a letter
with supporting documentation to the Department of Community Development Services
requesting a one-time extension of this limit of up to one year.

BACKGROUND
The subject property is located at 2930 South 288th Street.The underlying property comprises 22,479
square feet,which the applicant proposes to divide into three lots of 7,493 square feet each.The property
is currently vacant and cleared of all structures.There are no environmentally sensitive areas located on
or near the parent property.
FINDINGS
1. The legal owner of the property is Song Kang.
2. A Notice of Land Use Application(NOA)was published in the Federal Way Mirror on August 17,
2005, followed by a 15-day comment period,which ended August 31,2005.No comment letters
were received.
3. There are no environmentally sensitive areas affecting the subject property.
4. The project is exempt from environmental review under the State Environmental Policy Act(SEPA)
consistent with Federal Way City Code(FWCC) Section 20-87.
5. Current uses of the project site and surrounding areas include:

South Single-family residences,zoned single-family RS7.2
East Single-family residences,zoned single-family RS7.2
West Single-family residences,zoned single-family RS7.2
6. Zoning for the property is Single-Family Residential(RS 7.2)with a minimum lot size requirement
of 7,200 square feet.The proposed development is permitted, subject to administrative review and a
Director's Decision.
7. Right-of-Way Access—Pursuant to FWCC Section 20-152, all lots must abut a public street right-of-
way.Access to all three lots shall only be via 30th Avenue South.
8. Pursuant to modification request number 04-101466-00-SM, street frontage improvements must be

Department of Public Works of the above,required improvements.A completed City permit

10. The proposed lots meet the requirements of FWCC Section 20-152,"Design Criteria."All three lots
are of ample dimensions to provide a regular-shaped building area that meets required setbacks,
allows access for emergency apparatus,and abuts a public street right-of-way.
11. In view of recent case law,the City has concluded that the open space requirements of FWCC
Section 20-155 do not apply to short plat applications;no open space is required for this proposal.
12. Water and Sewer Availability Certificates have been issued for the subject property.Water and
sanitary sewer service to the property will be provided by Lakehaven Utility District.A side sewer
permit will be required for any new connection to the sanitary sewer system or for modification to
any existing side sewer;pursuant to Lakehaven Utility District requirements.
13. Any future development on the site is subject to the required land use review,pursuant to the FWCC
and other local,state, and federal regulations.Preliminary short plat approval is not to be construed
as land use approval for any future development.
14. The proposed short plat has been reviewed according to FWCC Chapter 20,Article I and applies the
standards contained in FWCC Chapter 22,Article XI,"District Regulations,"for the Single-Family
Residential zone(RS 7.2)and applicable sections of Chapter 20,Articles II,"Plat";Article III,
"Design Criteria";Article IV,"Improvements"; and Article V,"Public Improvement Assessments."
Conclusion
Based on the results of this review,the proposal is found to be consistent with the Federal Way
Comprehensive Plan,FWCC,and with the public health, safety, and welfare.Approval of the project is
recommended.

Based on my conversation with Bob Bennett last week,what we need to do is when you send him his
approval (preliminary approval?) letter,we need to spell out the rest of the process, i.e., submit for the EN
(fees, application, etc...), let him know that all improvements must be constructed and accepted by PW,
then the Short Plat can be recorded.

This letter responds to your July 12,2005, letter requesting a four-month extension, "...to ensure
• resolution of design questions and allow a complete design submittal."I left a voice mail at your office on
July 15,2005,explaining that the City could not extend the application to accommodate your request.
The application for a three lot short plat was submitted on August 20,2003.The application was
determined to be incomplete,and the applicant notified of the two incomplete application issues in letters
dated September 11,2003,and February 11,2005.
Under Federal Way City Code(FWCC) Section 22-34,if an applicant fails to provide additional
information to the City within 180 days of being notified that such information is requested,the
application shall be deemed null and void and the City shall have no duty to process,review,or issue any
decision with respect to such an application.As previously noted,if requested information to address the
incomplete application items is not submitted by July 22,2005,the application will be cancelled with no
refund of fees.The July 22,2005,date is 180 days from the January 26,2005, submittal of roadway
information.

I had another meeting with Kevin Peterson of Engineering and there still is
information about the storm sewer and road width improvements to the
North. Kevin Peterson is working on supplying us information on the storm
sewer as-built and the northerly street width.
We have made another submittal, which cannot be reviewed prior to the
July 22, 2005 cancellation date.
After we met July 18, 2005, you told me that my request for an extension
would not be considered and the project would be cancelled. I didn't
understand your questions about turning the information back in for
review of completeness, when there is a fourteen (14) day turn around,
which puts us beyond the date.
Since you cancelled the project, I want to appeal that decision. Please send
me the appropriate information for the appeal.

Dear Bennett,
I appreciate the opportunity to meet with you last Tuesday to discuss the outstanding completeness issues
that were identified in Deb Barker's July 8, 2005 letter. This letter responds to those questions you had as
discussed at that meeting:
1) What is meant by the statement "Additionally, the applicant shall construct a 20-foot paved
surface from the site's frontage to the nearest intersection right-of-way."?
The intent is to continue the 30`h Avenue S road paving to the north, to connect to the existing
southerly paved extension of 29th Place S. Currently, the southerly end of that paved roadway
lays approximately 80-feet north of the north boundary of the Kang property. This extension
would create a continuous paved surface in 30th Avenue S, which would provide paved access for
all vehicles, but more importantly, for emergency vehicles, in a manner that would not cause
them to have to turn around, or have to reduce their speed to navigate the existing rough
roadway. The required 20-foot paved width would taper from the north end of the Kang frontage
improvements to the existing pavement extension. Curb, gutter, sidewalk,planter strip, etc. is not
required for the northerly extension of pavement.
2) Is the applicant responsible for extending the storm drainage system that currently exists in the
30th Avenue S roadway?
Yes. The applicant is required to extend the storm drainage system from the existing catch basin,
located south of the south property line of the Kang property. The new storm system must extend
the full length of the Kang property. The storm drainage system may be required to extend to the
north, beyond the Kang property, if it is found necessary as part of the paving extension.
Additional topographic survey information would likely be required in the 30`h Avenue
right-of-way, in order to determine if storm drainage is required north of the property.
If you or the owner do not agree with the above requirements, additional discussions with City Public
Works management staff would be necessary. However, the above items must be addressed and provided
before July 22, 2005, in order for the City to determine this application to be complete, and the short plat
application to proceed. Once these items have been provided, and the application is determined to be
complete, additional Technical comments may be addressed, and the short plat application may proceed.

The City has reviewed revisions submitted on July 1, 2005, in response to the City's previous incomplete
application letters.Unfortunately, the application is not complete as discussed below.
As you may recall,the City of Federal Way Department of Community Development Services received
the application for a three-lot short plat for parcel number 332204-9127 on August 20,2003. In a
September 11,2003 letter,the City indicated that the application was incomplete based on short plat
submittal requirements in Federal Way City Code(FWCC)Section 22-83. The letter also provided
technical comments.
The City reiterated the incomplete application comments in a February 11, 2005 letter.That letter also
noted that pursuant to FWCC Section 22-34,if an applicant fails to provide additional information to the
City within 180 days of being notified that such information is requested,the application shall be deemed
null and void and the City shall have no duty to process,review,or issue any decisions with respect to
such an application.The City noted that if requested information was not submitted by July 22,20051,the
application would be cancelled with no refund of fees.
INCOMPLETE APPLICATION
In order for the application to be considered complete and ready for processing,the following items must
be provided:
1. Street Improvements: Frontage improvements,as required in the preapplication letter,have not
been shown. Frontage improvements on 30th Avenue South must be shown on the site plan,
including a cross section.The street shall be constructed to a Type U street,consisting of a 32-foot
street with curb,gutter,four-foot planter strip with trees, five-foot sidewalk,and street lights in a 60-
foot right-of-way(ROW).Assuming a symmetrical cross section, additional ten feet of ROW would
need to be dedicated to the City.Additionally, the applicant shall construct a 20-foot paved surface
from the site's frontage to the nearest intersection right-of-way.
Staff Response:Frontage improvements are depicted on sheet 3 of 5. However, the requirement to
construct a 20 foot wide paved surface from the site's frontage to the nearest right-of-way has not
been addressed.

Public Works prior to recording of the Short Plat.

Dear Mr. Bennett:
The purpose of this letter is to advise you of the status of the above-referenced application.
On August 20, 2003,the City of Federal Way Department of Community Development Services received
the application for a three-lot short plat for parcel number 332204-9127. In a September 11,2004 letter,
the City indicated that the application was incomplete based on short plat submittal requirements in
Federal Way City Code(FWCC) Section 22-83. The letter also provided technical comments.
A copy of a recorded easement for right-of-way was submitted to the Federal Way Public Works
Department on January 26,2005. While obtaining this easement from the Fire Department was an
important step for the project,the short plat application remains incomplete as noted below.Technical
comments from the August 20, 2003 letter, are also repeated.
Pursuant to FWCC Section 22-34, if an applicant fails to provide additional information to the City within
180 days of being notified that such information is requested, the application shall be deemed null and
void and the City shall have no duty to process, review,or issue any decisions with respect to such an
application. Please be advised that if the following information is not submitted by July 22, 2005,this
application will be cancelled with no refund of fees.
INCOMPLETE APPLICATION
In order for your application to be considered complete and ready for processing,the following items
must be provided:
1. Preliminary clearing and grading plan missing: The preapplication summary letter from the
February 20,2003 preapplication conference,called out a grading and clearing plan be submitted
with the short plat in conformance with FWCC Section 22-179. This information has not been
submitted.
2. Landscape plan missing: The preapplication summary letter from the February 20, 2003
preapplication conference,called out a landscape plan be submitted with the short plat in
conformance with FWCC Section 22-186. This information has not been submitted. Requested tree

information is depicted on the face of the short plat. This information can also be transferred to the
landscape plan, which should also show street trees in conformance with FWCC.
3. Street improvements: Frontage improvements as required in the preapplication letter have not been
shown. Frontage improvements on 30th Avenue South must be shown on the site plan, including a
cross section. The street shall be constructed to a Type U street,consisting of a 32-foot street with
curb, gutter, four-foot planter strip with trees,five-foot sidewalk, and street lights in a 60-foot right-
of-way(ROW). Assuming a symmetrical cross section, additional ten feet of ROW would need to be
dedicated to the City. Additionally, the applicant shall construct a 20-foot paved surface from the
site's frontage to the nearest intersection right-of-way.
4. Drainage System: Show the proposed drainage system layout.
TECHNICAL COMMENTS
In addition to completeness items discussed above, preliminary short subdivision review comments,
including but not limited to the following, are provided. These issues were identified in reviewing the
application for completeness.

page. Lakehaven Utility District is making Sanitary Sewer available, and the KCHD signature block
is not needed.
2. Provide the Vertical Benchmark information(Description, location,and elevation. Elevation must be
NGVD-29 or KCAS.)
3. The right-of-way must be dedicated via a Statutory Warranty Deed.The Short Plat shall still show
the right-of-way dedication,with a blank left for the King County Recording Number. Attached is a
Worksheet for Statutory Warranty Deed for the applicant to fill out and return to the Public Works

Public Works prior to recording of the Short Plat.
After receipt of the requested information noted in the Incomplete Application section of this letter(be
sure to include the enclosed Resubmittal Information Form),the department will notify you within 14
days whether your application is considered complete or what, if any, information is still needed.It is
important to note that the department cannot begin processing your formal application until all items are
submitted,and that the short plat application will be cancelled on July 22,2005, if requested information
is not submitted.

1.Purpose.Grantee and its agents,designees and/or assigns shall have the right,without prior notice
to Grantor, at such times as deemed necessary by Grantee, to enter upon the Property to inspect,
construct,reconstruct,operate,maintain,repair,replace and enlarge a public right-of-way including,
but not limited to, all development described in Section 22-1525 of the Federal Way City Code or
any other applicable codes, rules or regulations, together with all necessary or convenient
appurtenances thereto. Following the initial construction of the Right-of-Way, Grantee may from
time to time construct such additional improvements as it may require. Nothing in this Easement
shall delegate the Grantee to commence or complete the Right-of-Way improvements within a
specific period of time.
2.Access.Grantee shall have the right of access to the Right-of-Way over and across the Property to
enable Grantee to exercise its rights hereunder.
3. Obstructions; Landscaping. Grantee may from time to time remove vegetation, trees, or other
obstructions within the Right-of-Way, and may level and grade the Right-of-Way to the extent
reasonably necessary to carry out the purposes set forth in paragraph 1 hereof; provided, however,
that following any such work, Grantee shall,to the extent reasonably practicable,restore the Right-
of-Way and Grantor's property to a condition similar to its condition prior to such work. Following
the construction of the Right-of-Way improvements, Grantor may undertake any ordinary
improvements to the landscaping of the Right-of-Way,provided that no trees or other plants shall be
placed thereon, which would be unreasonably expensive or impractical for Grantee to remove and
restore.
4. Grantor's Use of Right-of-Way. This Easement shall be exclusive to Grantee; provided,
however, Grantor reserves the right to use the Right-of-Way for any purpose not inconsistent with
Grantee's rights. Grantor shall not construct or maintain any buildings or other structures on the
Right-of-Way. Grantee shall not perform any digging, tunneling or other form of construction

activity on the Property which would disturb the compaction or damage the improvements on the
Right-of-Way. No blasting shall be done within fifteen (15) feet of the Right-of-Way.
5. Indemnification. Grantor agrees to indemnify, defend and hold Grantee, its elected officials,
officers, employees, agents, and volunteers harmless from any and all claims, demands, losses,
actions and liabilities (including costs and all attorney fees) to or by any and all persons or entities,
including, without limitation, their respective agents, licensees, or representatives, arising from,
resulting from, or connected with this Easement.

I have been in contact with Tamara, probably around the end of May. I sent them a City Easement
template to use to draft an easement so they could construct a couple of feet of the roadway on the
adjacent FWFD property.As far as I know, they are working on getting that easement so as to be able to
construct the road.

Hey Remember this one north of 288th Street on 30th South?? I got a March letter&call from the surveyor
and they noted that they were unable to get an easement from the Fire Department for the roadway on
30th Avenue South. I advised them to contact Public Works Engineering and Traffic. Have you heard from
either Tamara or Robert Bennett about this situation? I'm ready to cancel the short plat application in 30
days unless I hear that they have been working on the roadway situation.

This memorandum provides review comments form the Public Works Traffic Division on the submitted
materials dated August 21s`, 2003. After reviewing the materials I have the following comments:

General:
The District's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units (ERU). One
(1) single-family lot is equal to one (1) ERU. The District's current Capital Facilities Charges are $3,205/ERU for
water and $2,721/ERU for sewer. There is some credit available from prior connection charges paid to offset a
portion of the Capital Facilities Charges for water only.

4. Any claim, which arises out of the transaction vesting in the Insured the estate or interest insured by this policy, by
reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that is based on:
(i) the transaction creating the estate or interest insured by this policy being deemed a fraudulent conveyance or
fraudulent transfer; or
(ii) the transaction creating the estate or interest insured by this policy being deemed a preferential transfer except
where the preferential transfer results from the failure:
(a) to timely record the instrument of transfer; or
(b) of such recordation to impart notice to a purchaser for value or a judgment or lien creditor.
ALTA LOAN POLICY FORM (10-17-92)
The following matters are expressly excluded from the coverage of this policy and the Company will not pay loss or damage,
costs, attorneys' fees or expenses which arise by reason of:
1. (a) Any law, ordinance or governmental regulation(including but not limited to building and zoning laws,ordinances,
or regulations) restricting, regulating, prohibiting or relating to (i) the occupancy, use, or enjoyment of the land;
(ii)the character, dimensions or location of any improvement now or hereafter erected on the land; (iii) a separa-
tion in ownership or a change in the dimensions or area of the land or any parcel of which the land is or was
a part; or (iv) environmental protection, or the effect of any violation of these laws, ordinances or governmental
regulations, except to the extent that a notice of the enforcement thereof or a notice of a defect, lien or encum-
brance resulting from a violation or alleged violation affecting the land has been recorded in the public records
at Date of Policy.
(b) Any governmental police power not excluded by(a)above,except to the extent that a notice of the exercise thereof
or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the land has
been recorded in the public records at Date of Policy.
2. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of
Policy, but not excluding from coverage any taking which has occurred prior to Date of Policy which would be binding
on the rights of a purchaser for value without knowledge.
3. Defects, liens, encumbrances, adverse claims or other matters:
(a) created, suffered, assumed or agreed to by the insured claimant;
(b) not known to the Company, not recorded in the public records at Date of Policy,but known to the insured claimant
and not disclosed in writing to the Company by the insured claimant prior to the date the insured claimant became
an insured under this policy;
(c) resulting in no loss or damage to the insured claimant;
(d) attaching or created subsequent to Date of Policy(except to the extent that this policy insures the priority of the
lien of the insured mortgage over any statutory lien for services, labor or material); or
(e) resulting in loss or damage which would not have been sustained if the insured claimant had paid value for the
insured mortgage.
4. Unenforceability of the lien of the insured mortgage because of the inability or failure of the insured at Date of Policy,
or the inability or failure of any subsequent owner of the'indebtedness,to comply with applicable doing business laws
of the state in which the land is situated.
5. Invalidity or unenforceability of the lien of the insured mortgage, or claim thereof, which arises out of the transaction
evidenced by the insured mortgage and is based upon usury or any consumer credit protection or truth in lending law.
6. Any statutory lien for services, labor or materials (or the claim or priority of any statutory lien for services, labor or
materials over the lien of the insured mortgage)arising from an improvement or work related to the land which is con-
tracted for and commenced subsequent to Date of Policy and is not financed in whole or in part by proceeds of the
indebtedness secured by the insured mortgage which at DAbe of Policy the insured has advanced or is obligated to
advance.
7. Any claim, which arises out of the transaction creating the interest of the mortgagee insured by this policy, by reason
of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that is based on:
(i) the transaction creating the interest of the insured mortgagee being deemed a fraudulent conveyance or fraudulent
transfer; or
(ii) the subordination of the interest of the insured mortgagee as a result of the application of the doctrine of equitable
subordination; or
(iii) the transaction creating the interest of the insured mortgagee being deemed a preferential4ransfer except where
the preferential transfer results from the failure:
(a) to timely record the instrument of transfer; or
(b) of such recordation to impart notice to a purchaser for value or a judgment or lieA creditor.

I appreciate the opportunity to meet with you last Tuesday to discuss the outstanding completeness issues
that were identified in Deb Barker's July 8, 2005 letter. This letter responds to those questions you had as
discussed at that meeting:
1) What is meant by the statement "Additionally, the applicant shall construct a 20-foot paved
surface from the site's frontage to the nearest intersection right-of-way."?
The intent is to continue the 30th Avenue S road paving to the north, to connect to the existing
southerly paved extension of 29t Place S. Currently, the southerly end of that paved roadway
lays approximately 80-feet north of the north boundary of the Kang property. This extension
would create a continuous paved surface in 30th Avenue S, which would provide paved access for
all vehicles, but more importantly, for emergency vehicles, in a manner that would not cause
them to have to turn around, or have to reduce their speed to navigate the existing rough
roadway. The required 20-foot paved width would taper from the north end of the Kang frontage
improvements to the existing pavement extension. Curb, gutter, sidewalk,planter strip, etc. is not
required for the northerly extension of pavement.
2) Is the applicant responsible for extending the storm drainage system that currently exists in the
30th Avenue S roadway?
Yes. The applicant is required to extend the storm drainage system from the existing catch basin,
located south of the south property line of the Kang property. The new storm system must extend
the full length of the Kang property. The storm drainage system may be required to extend to the
north, beyond the Kang property, if it is found necessary as part of the paving extension.
Additional topographic survey information would likely be required in the 30th Avenue
right-of-way, in order to determine if storm drainage is required north of the property.
If you or the owner do not agree with the above requirements, additional discussions with City Public
Works management staff would be necessary. However, the above items must be addressed and provided
before July 22, 2005, in order for the City to determine this application to be complete, and the short plat
application to proceed. Once these items have been provided, and the application is determined to be
complete, additional Technical comments may be addressed, and the short plat application may proceed.

This office received a telephone call from Chief Gaspard of the Federal
Way Fire Department stating that they would not grant the easement
because you need a full road prior to being given an easement. He was
asked to grant the easement so that you could have the full road per the

Services yesterday concerning the telephone call we received from Chief
Gaspard. He will be taking care of this matter and will make sure that
the Traffic Division person is apprised of the decision of the Fire

Dear Sir or Madam,
Our client Song Kang has applied for a three (3) lot short plat at 2930 South 288th
Street, Federal Way, Application No. 03-103394-000-0-SU.
All lots for the Short Plat will have a proposed access to 30th Avenue South which
presently is a dirt road in a 20 foot right-of-way. The proposed Short Plat is on
the West side of 30th Avenue South and will require an additional 10 feet of right-
of-way to be dedicated. This will be dedicated through the Short Plat process.
The property to the East of the centerline is owned by the Federal Way Fire
Department. Our office contacted the Assistant Chief, Grant G. Gaspard (see
enclosed correspondence), to obtain an easement across 30 feet of their
property for ingress, egress and utilities. This action would have allowed our
client to make the road improvements requested by the City. The answer from
the Assistant Chief was NO easement would be granted because a full road
would be needed prior to being given an easement.
We have contacted the Planning Department and they forwarded us to the Public
Works Department. Now we must apply for a Right-of-way Improvement
Modification.
The 30th Avenue South right-of-way has some half street improvements South
and North of our proposed Short Plat and by building a half street improvement, it
will allow a minimum of 20 feet of paving. The cross section adjacent to the
project is 20 feet of paving to the face of curb; 0.5 foot of curb, 3.5 feet of grass
planter strip and a 5 foot sidewalk. We are proposing to extend the same cross
section from the South property line to the North property line along 30th Avenue
South.

would be made safer and allow our client to process the requested Short Plat.

STANDARD PLAN NOTES

These Standard Plan Notes are modeled after the King County Standard Plan Notes located in the Surface Water Design
Manual. The Standard Plan Notes must be included on..all plans. .Notes, which in no way apply to the project, shall be
omitted. However, the remaining notes must not be re -numbered For example, if General Note #3 were omitted, the
remaining notes should be numbered 1, 2. 4, 5. 6, etc.
General Notes:
1. All construction shall be in accordance with the Federal Way City Code (FWCC), applicable
ordinances, and the City Council conditions of project approval. These documents are
supplemented by the Standard Specifications for Road, Bridge, and Municipal Construction
(WSDOT/APWA), the King County Road Standards (KCRS), and the King County Surface Water
D
Design Manual (KCSWM). It shall be the sole responsibility of the applicant and the
professional engineer to correct any error, omission, or variation from the above requirements
found in these plans. All corrections shall be at no additional cost or liability to the City of
Federal Way.
2. The design elements within these plans have been reviewed according to the, Federal Way
Engineering Review Checklist. Some elements may have been overlooked or missed by the City
Engineering Plan Reviewer. Any variance from adopted standards is not allowed unless
specifically approved by the City of Federal Way, prior to construction.
3. Approval of this road, grading, and drainage plan does not constitute an approval of any other
construction (i.e. domestic water conveyance, sewer conveyance, gas, electricity, etc.)
4. Before any construction or development activity, a Preconstruction Meeting must be held between
the City of Federal Way, the applicant, and the applicant's construction representative.
5. A copy of these approved plans must be on the job site whenever construction'is in progress.
6. Construction noise shall be limited as per FWCC (Section 22-1006); normally this is 7 a.m. to 8
p.m., Monday through Saturday.
7. It shall be the applicant's/contractor's responsibility to obtain all construction easements necessary
before initiating off -site work within the road rights of way.
S. Franchised utilities of other installations that are not shown on these approved plans shall not be
constructed unless an approved set of plans that meet all City requirements and the requirements
of KCRS Chapter 8 are submitted to the City of Federal Way at least three days prior to
construction.
9. Vertical datum shall be KCAS or NGVD-29.
10. Groundwater system construction shall be within a right of way or appropriate drainage
easements, but not underneath the roadway section. All groundwater systems must be constructed
in accordance with the WSDOT/APWA Standard Specifications.
11. All utility trenches in the right of way shall be backfilled with 5/8 inch crushed rock.
12. All utility trenches shall be backfilled and compacted to 95% density.
13. All roadway subgrade shall be backfilled and compacted to 95% density in accordance with
WSDOT 2-06.3.
14, Open cutting of existing roadways is not allowed unless specifically approved by the Public
Works Director and noted on these approved plans. Any open cut shall be restored in accordance
with KCRS 8.03(b)3.
15. The contractor shall be responsible for providing adequate safeguards, safety devices, protective
equipment, flaggers, and any other needed actions to protect life, health, and safety of the public,
and to protect property in connection with the performance of work covered by the contractor.
Any work within the traveled right of way that may interrupt normal traffic flow shall require at
least one flagger for each lane of traffic affected. All sections of the WSDOT Standard
Specifications 1-07.23-Traffic Control, shall apply.
16. Contractor shall provide and install all regulatory and warning signs per the latest edition of
Manual On Uniform Traffic Control Devices.
17. All utilities shall be adjusted to final grade after paving asphalt wearing course.
18. Rockeries are considered to be a method of bank stabilization and erosion only. Rockeries shall
not be constructed to serve as retaining walls. All rockeries shall be constructed in accordance
with CFW Drawing Numbers 3-22, 3-23. Rockeries may not exceed six feet in height for cut
sections or four feet in height for fill sections unless designed by a geotechnical or structural
engineer licensed in the state of Washington.

Erosion/Sedimentation Control Notes:
1. Approval of this Erosion/Sedimentation Control (ESC) plan does not constitute an approval of
permanent road or drainage design (i.e. size and location of roads, pipes, restrictors, channe's,
retention facilities, utilities, etc.).
2. The implementation of these ESC plans'and the construction, maintenance, replacement, and
upgrading of these ESC facilities is the responsibility of the applicant/contractor until all
construction is approved.
3. The boundaries of the clearing limits shown on this plan shall be clearly flagged in the field prior
to construction. During the construction period, no disturbance beyond the flagged clearing limits
shall be permitted. The flagging shall be maintained by the applicandcontractor for the duration of
construction.
4. The ESC facilities shown on this plan must be constructed in conjunction with all clearing and
grading activities, and in such a manner as to insure that sediment laden water does not enter the
drainage system or violate applicable water standards.
5. The ESC facilities shown on this plan are the minimum requirements for anticipated site
conditions. During the construction period, these ESC facilities shall be upgraded (i.e. additional
sumps; relocation of ditches and silt fences, etc.) as needed for unexpected storm events.
6. The ESC facilities shall be inspected daily by the applicanUcontractor and maintained as necessary
to ensure their continued functioning.
7. .Any area stripped of vegetation, including roadway embankments, where no further work is
anticipated or a period of 15 days, shall be immediately stabilized with the approved ESC methods
(i.e. seeding, mulching, netting, erosion blankets, etc.)
S. Any area needing ESC measures, not requiring immediate attention, shall be addressed within 15
days.
9. The ESC facilities on inactive sites shall be inspected and maintained a minimum of once a month
or within the 48 hours following a storm event.
10. At no time shall more than one foot of sediment be allowed to accumulate within a catch basin.
All catch basins and conveyance lines shall be cleaned prior to paving. The cleaning operation
shall not flush sediment -laden water into the downstream system.
11. Stabilized construction entrances and wash pads shall be installed at the beginning of construction
and maintained for the duration of the project. Additional measures may be required to insure that
all paved areas are kept clean for the duration of the project.
12. During the time period of November 1 through March 31, all project disturbed areas greater than
5,000 square feet, that are left unworked for more then 12 hours, shall be covered by one of the
following cover measures: mulch, sod, or plastic covering.

Drainage Notes:
I . Proof of liability insurance shall be submitted to the City prior to the Preconstruction Meeting.
2. All pipe and appurtenances shall be laid on a properly prepared foundation in accordance with
WSDOT 7-02.3(1). This shall include leveling and compacting the trench bottom, the top of
foundation material, and required pipe bedding, to a uniform grade so that the entire pipe is
supported by a uniformly dense unyielding base.
3. Steel pipe shall be galvanized and have Asphalt Treatment # 1 or better inside and outside.
4. All drainage structures, such as catch basins and manholes, not located within a traveled roadway
or sidewalk, shall have solid locking lids. All drainage structures associated with a permanent
retention/detention facility shall have solid locking lids.
5. All catch basin grates shall conform to CFW Drawing Numbers 4-1, 2, 3, 4 or 5.
6. All driveway culverts located within the right of way shall be of sufficient length to provide a
minimum 3:1 slope from the edge of the driveway to the bottom of the ditch. Culverts shall have
beveled end sections to match the side slopes.
7. Rock for erosion protection of ditches, channels and swales, where required, must be of sound
quarry rock, placed to a depth of one foot and must meet the following specifications: 4"-8"
rock/40%-70% passing; 2"-4" rock/30%-400/O passing; and -2" rock/10%-20% passing.
Installation shall be in accordance with KCRS Drawing Number 51 or as amended by the
approved plans. Recycled asphalt or concrete rubble shall not be used.
8. Lots not approved for infiltration shall be provided with drainage outlets (stub -outs). Stub -outs
shall conform to the following:
A. Each outlet shall be suitably located at the lowest elevation on the lot, so as to service all
future roof downspouts and footing drains, driveways, yard drains, and any other surface or
sub -surface drains necessary to render the lots suitable for their intended use. Each outlet
shall have free -flowing, positive drainage to an approved stormwater conveyance system or to
an approved outfall location.
B. Outlets on each lot shall be located with a five-foot high, 2 x 4 stake marked "Storm". The
stub -out shall extend above surface level, be visible and be secured to the stake.
.C. Pipe material shall conform to underdrain specifications described in KCRS 7.04 and, if non-
metallic, the pipe shall contain wire or other acceptable detection.
D. Drainage easements are required for drainage systems designed to convey flows through
individual lots.
E. T;ie applicant/contractor is responsible for coordinating the locations of all Ftub-out
t.Vriveyance lines with respect to the utilities (i.e. power, gas, telephone, television).

14. Where seeding for temporary erosion control is required, fast germinating grasses shall be applied
at an appropriate rate (i.e., annual or perennial rye applied at approximately 80 pounds per acre).
15. Where straw mulch for temporary erosion control is required, it shall be applied at a minimum
thickness of two inches.
16. Management practices providing significant tree protection shall be provided per Section 22-1568
(c) (6) (a-g) ofFWCC.

ROOT BARRIER:
Root barrier shall be rigid High Impact Polypropylene treated with UV inhibitors,
< Inlmum 18" height, with 1 /2" raised vertical ribs 6" on center, or approved equal.
2. Install root barrier in continuous 24' strip, centered on tree, next to sidewalk and
curb according to manufacturer's directions. Exposed edge shall not extend more than
1/2" above finished grade.
STAKING:
1 . Use 2, 1-1/2" by 8'-0" rebor tree stakes. Do not drive stake through root ball.
2. Attach tree to stoke with canvas web belting or rubber, using a figure-8 formation.
