The Department of Community Development Services received the ADU land use application on March 6,2009, and determined the application to be complete following an October 16,2009 resubmittal. The property's Comprehensive Plan and zoning designation is Single-Family High-Density Residential and RS 7.2,respectively. According to the submittal, the proposed ADU will be created out of a second floor `bonus room space' in the existing single-family residence.Federal Way Revised Code(FWRC) 19.200.180 allows ADU's in the single-family residential zone subject to criteria. Consistent with note#8,FWRC 19.200.180,the primary entrance to the ADU is via a proposed exterior stairway on the north side of the house and secondary access is available from a second floor hallway inside the primary dwelling unit. The 714 square-foot proposed one bedroom ADU living space does not exceed 40 percent of the square footage of the primary dwelling unit. On-site parking for one vehicle is provided. CONDITIONAL APPROVAL Preliminary ADU approval is granted subject to the following condition: • Any new parking stall and driving surface for the ADU shall be constructed with grass-crete pavers, and indicated as such on the site plan, with dimensions shown. This decision shall not waive compliance with future City of Federal Way codes,policies, and standards relating to this project site. The effective date of decision is November 20, 2009,or three days from the date of this letter. Pursuant to FWRC 22-355(a),any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by December 4,2009(14 days from the effective date of decision). In that you are the only party of record,you may waive your right to appeal by submitting a letter to this effect to the City of Federal Way's Department of Community Development Services. If you waive your right to appeal,you may begin work on the ADU construction after November 20, 2009, only if you have obtained the necessary building permit approvals as discussed below. NEXT STEPS In order to complete the ADU application process, the following must be addressed: Mr.Singh November 17,2009 Page 2 1. A separate building permit is required to install approved ADU features, including the new parking stall, and formal plans must be submitted. The building permit may include associated new plumbing work and new mechanical work. Refer to the enclosed Permit Application for plan specifications. A separate electrical permit is required. A final inspection for the completed ADU will be conducted as part of a building permit process associated with this project. 2. Lakehaven Utility District requires that the application obtain sewer service and water service connection permits for the ADU. The July 23, 2009, Certificate of Water Availability notes that the existing one-inch meter may not be adequate and will need to be evaluated under the Uniform Plumbing Code. 3. Prior to the fmal inspection,please return the signed and notarized Letter of Application &Deed Restriction to my attention in accordance with note#9, FWRC 19.200.180,in addition to a check for recording fees payable to the City of Federal Way.' Once the ADU is completed, City staff will record the Letter of Application and Deed Restriction with King County. 4. Upon satisfying the required fmal inspection and submittal of the recording fee for the Letter of Application and Deed Restriction, the City will issue a Certificate of Accessoly Dwelling Unit Compliance for the property.
