File No.08-102014-00-UP is a request to construct a 10,168 square-foot building with associated site improvements and parking,on lot N-5,a"pad ready"site at the Federal Way Marketplace site. The building consists of 3,114 square feet for restaurant use,and 7,054 square feet for retail use as permitted under Federal Way Revised Code(FWRC) 19.220.010(Retail)and FWRC 19.220.030 (Restaurant).A 600 square-foot public plaza is planned for the south side of the building.Because the proposal is consistent with a previous environmental analysis for the overall mixed-use retail center(see finding#2,below),the application is subject to Process II review,pursuant to FWRC 19.15.010(3)(c). 2. The current proposal is consistent with previous environmental' and Process III2 City approvals related to overall development of the Federal Way Marketplace.These decisions were not appealed and are incorporated by reference as if set forth in full.The environmental determination establishes mitigation measures that must be addressed prior to occupancy of the first building to be constructed on the site.The approved Process III site plan contemplated future build-out of the overall site, including tenant pads,utilities,street frontage improvements,storm drainage facilities, site access, parking,vehicle and pedestrian circulation,and overall landscaping. 3. Pursuant to the above-noted Process III approval, site-wide improvements for the overall retail center,including grading,utilities,landscaping,and street frontage improvements,have been completed in accordance with approved engineering plans,3 or bonded as allowed by code.Pursuant to the Process III conditions of approval,all site work related to individual tenant pads must be completed prior to occupancy of the subject building. 4. The subject lot,in its present configuration has also been incorporated into,and is consistent with,a 10-lot binding site plan for the overall center that has been recorded at King County.4 The building can be constructed as proposed,based on existing lot lines,access,parking,and utility easements, and occupancy of the restaurant is subject to all City and outside agency permits,conditions, inspections,and approvals,as applicable,including the above-noted site improvements. 5. The subject property is designated as"Commercial Enterprise"(CE)by the current Federal Way Zoning Map and the Federal Way Comprehensive Plan(FWCP).The proposed use of the site for retail and restaurant uses is consistent with the range of uses allowed by these designations. 6. The project embodies good site and building design principles consistent with the requirements of the Community Design Guidelines FWRC chapter 19.115.The tenant pad is connected to the City File No.04-101700-00-SE,Mitigated Determination of Nonsignificance,issued December 1,2004 2 City File No.04-101699-00-UP,Process III Approval,issued February 1,2005,modified decision issued May 31,2006 3 City File No.06-100273-00-SU 4 City File No.06-100273-00-SU,King County Recording#20061019001720 4 internal cross-site pedestrian network,and is adjacent to internal roadways.The project meets all applicable design guidelines,including those building façades subject to the façade treatment requirements of FWRC 19.115.060(b)and which incorporate building modulation,canopies over 50 percent of the façade,landscaping,and a pedestrian plaza.The building incorporates a variety of materials and colors utilized in the overall Federal Way Marketplace complex design,including tan stucco finish over cultured stone wainscoting along building façades,dark brown pilasters supported by textured stone base, gabled entry canopies with wood trusses and cedar shakes,and forest green metal awnings.Building façades incorporate a variety of overall architectural elements; including modulated façades,floor to ceiling store front windows,entrance doors identified by wooden truss canopy gables,and a stepped roof form rimmed with contrasting color cornice treatment.Pedestrian entrances on the west side feature double glass doors with sidelights,while entrances on the east side provide for service and delivery,as well as mechanical room access.The outdoor pedestrian plaza located along the south side of the building contains fixed seating,trash receptacles,special paving, and is surrounded by landscaping.Prior to issuance of the building permit,the applicant shall provide a formal plaza layout plan for review. The enclosed garbage and recycling facility south of the building is designed to minimize visibility into the structure and is screened with landscaping. Roof-top mechanical equipment shall be designed to meet FWRC 19.110.070,and any ground based mechanical equipment shall be screened with landscaping. In order to maintain unimpeded pedestrian access to the main building entrances,curb stops shall be added to parking stalls along the front or west side of the building. 7. The new 10,168 square-foot building requires fifty-four parking stalls based on one stall per 100 square feet of restaurant gross floor area,and one stall for each 300 square feet of retail.Based on the approved and recorded shared ingress/egress and parking agreement for the Federal Way Marketplace outparcels as provided in FWRC 19.130.020(c)(1),the applicant has provided forty- nine parking stalls for this new building and also shares parking stalls with adjacent retail uses on the Federal Way Marketplace site. 8. Landscaping-In conjunction with the Binding Site Plan(BSP),the Federal Way Marketplace owner has developed a master landscape plan establishing use of consistent vegetative themes for perimeter and interior parking lot landscape areas.A landscape island shall be installed north west of the new building as pavement striping is not permitted.Five feet of perimeter landscaping is required along the property line to provide visual screening of the building.While the submitted plan generally reflects landscape design themes of the master landscape plan,the applicant has proposed a modification to the south and east perimeter planting areas. Landscape Modification-Perimeter planting areas are proposed to be reduced from five feet to three feet along the east property line to accommodate a sidewalk into service entries along the east side of the building.Under FWRC 19.220.010 and 19.220.030,there are no required building setbacks between the north building walls and the property line;however,five feet of perimeter landscaping is required between the building and the property line under FWRC 19.125.060.There is a 200%grade from the east property line to the service entrance sidewalk, and the service sidewalk is two feet below the grade of the pedestrian sidewalk.Vegetation proposed within the perimeter planting area would be below the pedestrian sidewalk grade and would not provide Type III Visual Buffering as required under FWRC 19.125.050(c),unless the height of the vegetation was increased. Through a review of the subject application,and previous approvals,the Public Works Department and Lakehaven Utility District have determined that the streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal,and the proposed existing access is at the optimal location and configuration. 10. The proposed site plan has been reviewed for consistency with all applicable zoning regulations, including FWRC 19.220.010"Retail";FWRC 19.220"Restaurant";FWRC Chapter 19.60,"Site Plan Review—Process II";FWRC Chapter 19.125,"Outdoors,Yards and Landscaping";FWRC Chapter 19.115,"Community Design Guidelines";and the above noted previous approvals. 11. Pursuant to FWRC 19.60.050(b),and the foregoing findings,the proposal has been found to be consistent with the FWCP,all applicable provisions of the FWRC,and the public health,safety,and welfare. Streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal,and access to the subject property is at the optimal location. Due to building projections and parking stall adjacency, the width of the walkway leading from the bj" internal east-west sidewalk to the west side of the building tapers to no more than four feet, which is very narrow. The potential for vehicle overhang into the walkway further narrows the walkway, and the 6gproximity of the retaining wall restricts the area for pedestrians. In order to provide a functional walking path a minimum of five feet in width,parking stalls along the building should be resized as compact stalls and curb stops installed to limit vehicle overhang. Alternatively, the building modulation can be adjusted along this facade to permit a five-foot walkway. NOTE: Curb stops will be required as a condition of approval Canopies and modulation are proposed along the west facade to comply with design guideline standards. k..x\ However, the modulated center section of the west facade is over 100 feet in length, which exceeds the 0.7- design guideline standards listed in FWCC § 22-1635(b)(1). Due to building projections and parking stall adjacency, the width of the walkway leading from the internal east-west sidewalk to the west side of the building tapers to no more than four feet, which is very narrow.The potential for vehicle overhang into the walkway further narrows the walkway, and the proximity of the retaining wall restricts the area for pedestrians.In order to provide a functional walking path a minimum of five feet in width,parking stalls along the building should be resized as compact stalls and curb stops installed to limit vehicle overhang.Alternatively, the building modulation can be adjusted along this façade to permit a five-foot walkway. 2. Canopies and modulation are proposed along the west facade to comply with design guideline standards. However,the modulated center section of the west façade is over 100 feet in length,which exceeds the design guideline standards listed in FWCC § 22-1635(b)(1).The canopy does not count as modulation; as building modulation must include the wall of the façade. Revise the facade to break up the long wall with modulation that meets the intent of FWCC. Be advised that the canopy satisfies the second treatment of FWCC § 22-1535(b)(3). 3. Retaining walls along the southwest corner of the subject site are up to six feet in height and located in a highly visible location. Provide information about the walls proposed in this area and use a cross section to show how the vehicle parking will comply with FWCC §22-1567(e). Provide retaining wall details and demonstrate how they will comply with the Federal Way Marketplace wall design standards.Will there be a fence needed at the top of this wall? 4. Depict the street furniture proposed within the outdoor seating area.Are there any bike racks, garbage receptacles, or seating areas proposed with this building? 5. Under FWCC § 22-753, the new 10,000 square-foot building requires fifty-three parking stalls based on one stall per 100 square feet of restaurant gross floor area, and one stall for each 300 square feet of retail,pursuant to FWCC §22-751. Only 45 stalls are depicted on the site plan sheet 3 of 5, with a loading zone along the north side of the building.Pad N5 originally received approval as a gas station site.Provide an update to the approved and recorded shared ingress/egress and parking agreement for the Federal Way Marketplace out-parcels to demonstrate that retail and restaurant uses provided with this project are accommodated within the shared parking agreement as provided under FWCC § 22- 1377(c)(1). Alternatively,provide 53 parking stalls for this use. Revise the site data to reflect the actual number of stalls proposed on this lot. 6. The eastern side of the building is several feet below street grade. Show the location of the rockery across this façade, so that those"above ground"areas are clearly referenced. 7. Where is the garbage and recycling facility for this building? If it is on another lot, demonstrate that the size of that facility can accommodate the waste from this project and denote the pedestrian access route to that facility. 8. Light standards are located within several of the interior parking lot landscape islands. Provide information about the amount of interior parking lot landscaping proposed without the light standards. If the code requirements of 22 square feet of interior parking lot landscaping per parking stall is not provided without the light standards, alternative areas for the light standards must be found so that square footage of interior parking lot landscaping is not compromised. 9. Trees are missing from the western planting area,perhaps due to the retaining wall. Consider installation of trees in retaining wall pockets consistent with the west side of the Marketplace site. 10. The formal application included a landscape modification to locate perimeter landscaping off site along the east side of the building site. In order to review the request,provide a cross section of proposed landscaping area with walkways to support the landscape modification request. Is the area proposed for the landscaping installation owned by the same person as this building site? 11. Will the canopy on the south façade interfere with the crown width of the red maple tree? 12. One completed City of Federal Way Master Land Use Application form 2. One check for the Process II Application fee 3. Eight sets of site plan review plans, including the preliminary site plan,preliminary landscape planting plan, and building elevations 4. One full-size 24-by 36-inch set and eight 11-by 17-inch sets of the color building elevations Project Description: The project is proposed to be constructed on Lot N-5 of the Federal Way Marketplace site under development within the City of Federal Way. The uses and square footage for the proposed project were approved as part of the original Wal-Mart Process III Site Plan review and SEPA MDNS issued for this site. This project includes the construction of an approximately 10,000-square-foot mixed-use commercial building designed to comply with the architectural and design guidelines approved for the Wal-Mart project that comprise a "northwest" architectural theme. There are no specific tenants proposed at this time. As part of this application, we are also requesting that the City of Federal Way (City) approve a Landscape Modification Request to deviate from the perimeter landscape requirements prescribed in FWCC, Section 22.1566(0(1), to reduce the 5-foot perimeter landscape buffer required along all properties abutting public rights-of-way and ingress/egress easements. Specifically we are requesting the City to allow the elimination of the 5-foot perimeter landscaping required along the property's eastern frontage with the private north/south driveway servicing the overall site. There will be an additional 3 feet of landscaping provided along the site's frontage measured from the property line to back of sidewalk. To offset this reduction, the variety and intensity of landscaping provided elsewhere on the site will be increased beyond City standards, and a large outdoor pedestrian plaza will be added to mitigate the perimeter landscape reduction. The additional landscape and site design elements, accompanied by the excessive perimeter landscaping currently provided along the east side of the driveway on the Wal-Mart parcel - greater than 10 feet wide - should serve to satisfy the intent of the City's landscape standards. Statement of Design Intent, Finish Materials and Colors: The exterior of the building has been designed to coordinate with the "northwest" architectural theme utilized for the Wal-Mart building and other outparcel buildings approved at this site. The base of the walls will be covered with a country ledge stone veneer to a height of approximately 3 feet from grade level. Above the ledge stone veneer, the wall surface will be comprised of painted CMU to match the Wal-Mart store. Please refer to the enclosed building elevations for color details and specifications. Other finish materials incorporated into the building's exterior include exposed wooden truss awning supports roofed with standing seam metal awning panels painted forest green and formed roofline cornices to match the Wal-Mart store. Design Guidelines Justification: Pursuant to FCWW, Section 22-1635(b), all building facades longer than 60 feet and visible from the right-of-way and/or ingress/egress easements, shall provide two of four specific treatment methods: canopy or arcade, Type II landscaping, building modulation, or pedestrian plaza; however, if more than two are used, dimensional requirements for each option will be determined on a case-by-case basis. This section applies to all of the proposed building facades. As such, we have incorporated the following design elements into the building facades to satisfy this section: • North Facade: The north facade is approximately 62 feet in length. The north facade provides metal canopies in excess of 50 percent of the facade length and an approximately 1,400-square-foot outdoor seating area. Facade modulation is also provided in several locations at a depth of 2 feet and at least 6 feet wide but not greater than 60 feet. • South Facade: The south facade is approximately 62 feet in length. This facade provides metal canopies with wood truss supports in excess of 50 percent of the facade length. Facade modulation is also provided at a depth of 2 feet and at least 6 feet wide but not greater than 60 feet. • East Facade: The east facade is approximately 164 feet in length. This façade provides metal canopies and exposed wood truss canopies with metal roofing at least 50 percent of the facade length. • West Facade: The west facade is approximately 164 feet in length. This facade provides metal canopies and wood truss canopies with metal roofing at least 50 percent of its length, facade modulation at a depth of 2 feet and at least 6 feet wide but not greater than 60 feet.
