SUMMARY OF APPLICATION The applicant is proposing to install a five foot high, 46 square foot monument sign (23 • square feet per side) on a driveway property line at the edge of a five foot wide sidewalk. The request is for a side yard variance to reduce the required sign setback from three to zero feet. This would allow the sign to be placed on the edge of the sidewalk rather than near the middle of the sidewalk. The proposal is delineated on site development plans received January 22, 1999,and April 8 & 16, 1999. As required,landscaping will be provided on an existing Federal Way School District property easement to the west of the sign. g. The Hearing Examiner has heard testimony,admitted documentary evidence into the record, and taken this matter under advisement. 2. The Community Development Staff Report sets forth general findings, applicable policies and provisions in this matter and is hereby marked as Exhibit "1" and incorporated in its , entirety by this reference. 3. All appropriate notices were delivered in accordance with the requirements of the Federal Way City Code(FWCC). 4. The applicant has a possessory ownership interest in a 1.83."panhandle" or"pipestem" lot abutting the north side of 320th Street South approximately 700 feet west of Pacific Highway South within the City of Federal Way. The developable rectangular portion of the site is accessed via a 210 foot long, 30 foot wide easement extending north from 320h Street between the Federal Way School District bus yard to the west and a Health South/Vision Express commercial use to the east. The applicant will improve the site with an Extended Stay America hotel and associated parking. 5. The Federal Way City Code(FWCC)requires the applicant to improve the 30 foot wide access easement with a 20 foot wide,paved vehicular surface,a five-foot wide sidewalk, and a five-foot wide landscaped area. The sidewalk will be constructed on the west side of the driveway due to an existing retaining wall on the east side and the required . driveway taper to 320th Street. 6. The applicant needs a business identification sign near 320"Street within the 30-foot wide easement;and because of the taper,retaining wall,and existing signage on the property to the east,must construct the sign on the west side of the easement. Section 22- 1602(b)FWCC requires a three-foot setback from property lines for all signs in non- residential zones. If the applicant complies with said provision,the sign would be located near the center of the sidewalk. The applicant proposes a monument sign five-feet in height, six-feet nine inches in width, and eight inches in depth. The internally illuminated,double-faced sign will contain 23 square feet per side. The applicant will extensively modify the topography of the school bus yard property and install attractive landscaping to accentuate and beautify the entrance to it's business. 8. To locate the sign adjacent to the property line,the applicant must obtain a variance to the required three-foot setback. Prior to obtaining such variance the applicant must establish that the request satisfies the criteria set forth in Section 22-1603(b)FWCC. Findings on each criteria are hereby made as follows: - a. The literal interpretation and strict application of the provisions and requirements of the sign regulations would cause undue and unnecessary hardship because of unique or unusual conditions pertaining to the specific parcel. The site is located within the City Center/Frame(CC-F)zoning district which contemplates commercial uses. To provide adequate access to its commercial use, the applicant must meet City standards which include the 20-foot wide travel surface and five- foot wide sidewalk. Meeting the setbacks for the sign would require its location in the center of the sidewalk,thus creating a public health and safety issue. b. The second criteria requires the applicant to show that a sign package would not provide its business with effective signs. While the applicant has stated that such is not presently possible,staff has recommended and the Examiner has imposed a condition of approval requiring the applicant to demonstrate a good faith attempt to secure a sign package agreement and submit written evidence to document that effort. The applicant testified at the hearing that the variance is actually a fall back position, and that the company is attempting to negotiate a sign package. c. The variance is necessary because of special circumstances relating to the shape, topography,location,and surroundings of the parcel. The variance is also necessary to provide said parcel with use rights and privileges permitted to other properties in the vicinity and zone classification. The special circumstances include the pipestem shape of the lot,unique to the immediate area. The sloping topography and visibility of the commercial site creates a special circumstance not present in surrounding ownerships. The variance will provide the applicant with similar location rights and privileges enjoyed by other properties in the vicinity and zone. Each property along the north side of 320t is entitled to one street side identification sign and without the variance the applicant would have to either locate the sign within the sidewalk or forego a sign. The variance is not granted for the convenience of the applicant or to accommodate a regional or national standard sign. While the sign may be the standard utilized by the business,such is not the reason for the variance. The variance is triggered by the City's driveway construction standards which require a pedestrian sidewalk between the street and main entrance to the hotel. • e. The special circumstances are not the result of the actions of the owner nor of a self-induced hardship,but are mandated by the sidewalk and landscaping requirements. f. Granting the variance will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. Locating the sign adjacent to the property line as opposed to three feet therefrom will actually improve the public health and welfare by placing a sign outside of a sidewalk. 9. Prior to obtaining a variance,the applicant must also establish that the request satisfies the criteria for Process IV review set forth in Section 22-445(c)FWCC. Findings on each criteria are hereby made as follows: a. The proposed variance is consistent with the City of Federal Way Comprehensive Plan, which in the CCF zone classification supports attractive and desirable commercial and office developments. The Plan also supports a vibrant city center with well-designed and functioning commercial areas, and encourages development along a street edge to provide pedestrian street access. All of the plan goals support a variance which will allow a safe sidewalk access to the business and at the same time an attractive,appropriately located, identification sign. The sign meets all other sign code requirements in every respect. b. The variance is consistent with all other applicable provisions of the FWCC. c. Granting the variance is consistent with the public health, safety, and welfare as it will allow placement of the sign along the edge of the five-foot sidewalk as opposed to the center,and therefore will actually improve the public,health, safety and welfare. Placement of the sign will also improve the visibility of the business to passing motorists and hotel guests. d. The streets and utilities in the area are adequate to serve the anticipated demand. e. S I -Inc • Page -5 IV, CONCLUSIONS • From the foregoing findings the Hearing Examiner makes the following conclusions: 1. The Hearing Examiner has jurisdiction to consider and decide the issues presented by this request. 2. The request for a sign variance satisfies all criteria set forth in Sections 22-1603(b)and 22-445(c) FWCC and therefore should be granted subject to the following condition: Prior to issuance of a sign permit, the applicant shall investigate and - document the provision of a"sign package"with adjoining commercial properties. Investigation and results of this effort shall be submitted in writing to the satisfaction of the Director of Community Development Services. In the event a sign package is utilized, this variance approval shall be deemed null and void. • DECISION: ' The request for a variance to the required three-foot property line setback to allow a business identification sign adjacent to the property line for Extended Stay America at 1400 South 320th Street is hereby granted subject to the condition contained in the conclusions above.
