The Comprehensive Plan and zoning designation for the subject property is Commercial Enterprise (CE). The subject property contains a retail shell building. Subsequent to tenant improvements, the occupant will operate a retail furniture sales business. Federal Way City Code (FWCC) § 22-867 allows such uses in CE zones. The Process I application was submitted and determined to be complete on May 21, 2008. The City's Department of Community Development Services hereby approves the Process I application. FINDINGS 1. As shown in the Process I submittal packet, the proposed improvements include the placement of a steel canopy above the service and receiving area located at the rear of the building. The proposed canopy will extend 30' from the existing building, measure 14' across, and have a clear height of 14'. According to the submitted site plan and photos, the proposed canopy will not be visible from public rights -of -way. 2. The proposed improvements do not reduce required parking, landscaping, buffering, open space, or public areas; do not change the location of utilities or easements; and create no impacts to sensitive areas or significant trees. 3. The City's Building Division is currently reviewing the associated building permit (File #08- 102518-CO). Construction of the proposed improvements may not begin until the building permit is approved. Based on the City's review, the Process I land use application for the installation of a steel canopy is approved. APPEALS The effective date of this decision is June 8, 2008, or three days from the date of this letter. Pursuant to FWCC § 22-368, any person who received notice of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by June 22, 2008. Any appeal must be in the form of a letter delivered to the Department of Community Development Services with the established fee_ The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in /•+11Yif Ad.i y June 5, 2008 Page 2 the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing the appeal. No work on the proposal can commence until the end of the appeal period. However, in that you are the only party of record, you may waive your right to appeal this decision. If you wish to waive your right to appeal, you must do so in writing to the attention of Associate Planner Matthew Herrera. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This Process I approval does not constitute approval of a building permit.
