Dear Sirs:
This letter is to confirm the zoning for the property located at 3450 South 344`h Way, City of Federal
Way, State of Washington, and comprised of Assessor parcel numbers 2221049040, 7261200195, and
7261200275 (the "Property"). The zoning designation for the Property is Office Park 1 (OP-1)_
The subject property is unique in that it is subject to a concomitant agreement (AG# 94-201 — enclosed),
which enumerates certain zoning requirements and which further vests development of the property to the
zoning code that was in effect at the time of the agreement in 1994.
The vested OP-1 zoning district permits the uses and density identified in Federal Way City Code
(FWCC) 22-826 of the City's Zoning Ordinance (a copy of which is enclosed). To the best of my
knowledge, the current use of the property is office use. This use is permitted within the OP-1 zoning
district.
Per FWCC 22-826 (a copy of which is enclosed), one parking space is required for each 300 square feet
of office space (one per 200 square feet for medical/dental office use). The 65,000 square -foot building
requires 217 parking spaces (assuming typical professional office uses). 287 parking spaces are provided.
Based on review of the land use and building permit files for the building on the subject property, it
appears to be in conformance with zoning code requirements regarding setback and height limitations.
Therefore, there are no known limits on rebuilding the improvements as currently constructed on the
Property (collectively, the "Project") following a casualty event, and the Project may be rebuilt in its
current form (i.e. no loss of square footage, same building footprints, etc.).

Based upon the foregoing and file information available at this time, it appears that the Project is legally
conforming as to its use and its structures, including, without limitation, building height and setback
requirements established for the zone set forth above. The City has no record of any uncured violations or
alleged violations of any zoning, building, or other ordinances applicable to the Property or the Project.
