Dear Mr. Elamin:
I have reviewed your request to keep the unauthorized improvements on your single-family residence that
has not yet received a Certificate of Occupancy due in part to the enclosure of the deck that resulted in the
height measurement for the house to exceed the 30-foot limitation. As the enclosed deck causes the house
to exceed the 30-foot height limitation, the Community Development Department is unable to allow it to
remain. On July 22, 2009, the department sent a letter to your surveyor that identified this issue and
provided options so you could move forward with the inspection process.
In closing, the department has no authority to allow you to exceed the 30-foot height limitation. Enclosing
the deck area was not approved by the City. You will need to remove the enclosing walls in order to
continue the process for final inspection.

Dear Mr. Bennett:
We are in receipt of your request, on behalf of Mr. O'Elamin, to clarify the issues regarding the height of
his residence located at 33337 42nd Avenue SW, Federal Way. It appears that the height of the house
exceeds the maximum allowed for a structure in this zone.
We have consulted with the Building Department who has informed us that the house plans were
approved with the bottom deck open, not enclosed. By enclosing the bottom deck, that area is now
considered an extension of the primary structure and the height would be measured from the low end of
the deck at finished grade.
However, there may be adjustments you can make that will allow you to keep the deck in place and still
meet code requirements. One alternative is to remove all the enclosure walls on the bottom deck and
restore it to the specifics that were originally approved as part of the building permit for the house. By
doing so, the height of the structure would not exceed the maximum allowed, and there is no issue to
prevent getting final approval of the project. Another alternative would be to open up the enclosures by
removing a majority of the walls, by creating "columns" on each side of the deck. If the deck structure
would be more "open," then the deck would not be included in the height measurement as there would be
no walls.
Please advise us how you intend to resolve this issue. If you intend to use one of the alternatives
suggested above, please submit a revised building permit and submit new plans of the deck structure. If

Dear Mr. Conlen,
March 27, 2009, 1 completed a Height Elevation Certificate, which showed the
structure on the property identified above, was built within code. Our office was
recently contacted about an addition made to the structure which was not shown
on the approved plans or constructed at the time we were originally on site.
The structure is a deck in the backyard. If the lowest corner of the structure is
taken as a base elevation, the house will be out of compliance.
What I need to know. is does this deck need to be part of the height evaluation?
Can the deck be detached from the house and not affect the home? What does
the City of Federal Way need on file to allow the house and deck to be in
compliance? The owner would like to leave the deck in place and keep our
elevation certificate in force.

The home being constructed at 33337 42nd Avenue Southwest under permit #07-
103982 was elevated on March 27, 2009. The elevations were taken to certify
the height measurement requirement of the City of Federal Way Building
Department.
A Temporary Benchmark was set on the Watermeter on the Southeast corner of
Lot 8, directly North of this property at the elevation of 100.00 feet. The highest
ground elevation is 100.94 feet; the lowest ground elevation is 91.39 feet, which
makes a ABE is 4.755 feet and an elevation of 96.17 feet.
The highest point on the ridge is 131.37 feet. The eave elevation is 120.17 feet,
the average elevation is 125.74 feet. When the ABE is subtracted from mid-
point, the height of the roof is 29.57 feet.
