The Community and Economic Development Department has completed an administrative land
use review of the proposed installation of an above ground LPG fuelttank located at in the Sear's
parking lot at 1701 South 320th Street. The zoning designation for the subject property is City
Center Core (CC-C). The fuel tank is an accessory use to the `retail shopping center, retail' use of
the property and as such is a permitted use in the zone. The City hereby approves the Process I
application, subject to the following condition of approval:
1. The applicant is to install screening acceptable to the city on the south side of the
fuel tank. Screening shall be either: (1) landscaping adequate to provide
substantial screening of the tank; or (2)°a fence/wall made of attractive materials.
The Process I land use approval is supported by the following finding of facts:
As shown in the Process I submittal packet, installation of the 1,000 gallon
horizontal LPG tank will occupy three parking stalls. Pursuant to the Federal
Way Commons Parking Analysis conducted by the Transpo Group in 2006, there
is a shared parking agreement, with a required 3,068 parking stalls. At this time,
3,525 parking stalls exist at the mall. The loss of three stalls will not impact
required parking.
2. The proposed improvements do not reduce required parking, landscaping,
buffering, open space, or public areas; do not change the location of utilities or
easements; and create no impacts to sensitive areas or significant trees.
3. The applicant will install appropriate screening pursuant to the below condition
of approval.

4. The city has determined that the proposal is exempt from State Environmental
Policy Act (SEPA) review pursuant to Washington Administrative Code (WAC)
197-11-800(a)(iii).
5. South lr N Fire & Rescue is currently reviewing the associated permit (file #12-
101370-FP). Installation of the proposed tank may not begin until the permit is
issued.
Based on the City's review, the Process I land use application for the proposed installation is
approved.
CLOSING
The effective date of this decision is May 21, 2012, or three days from the date of this letter.
Pursuant to Federal Way Revised Code (FWRC) 19.55.050, any person who received notice of
the administrative decision may appeal the decision to the Federal Way Hearing Examiner by
June 1, 2012 (14 calendar days). The appeal must be in the form of a letter delivered to the
Community and Economic Development Department with the established fee. The appeal letter
must contain clear reference to the matter being appealed and a statement of the alleged errors in
the director's decision, including the identification of specific findings and conclusions made by
the director disputed by the person filing.
As you are the only party of record, you may waive your right to appeal by submitting a letter in
writing to this effect to the city. Waiver of the right to appeal does not affect the effective date of
this decision. This decision shall not waive compliance with future City of Federal Way codes,
policies, and standards relating to this development.

CRITICAL AQUIFER RECHARGE AND WELLHEAD
PROTECTION AREAS
I. WHY SHOULD THIS INVENTORY STATEMENT BE FILLED OUT?
Critical Aquifer Recharge (CARAs) and Wellhead Protection Areas (WHPAs) are considered
"critical areas" pursuant to Federal Way Revised Code (FWCC), Title 14, "Environmental Policy."
This inventory statement must be filled out by the applicant or agent for any proposed activity listed
in Section II of this handout, and which are located within Wellhead Capture Zones 1, 5, and 10 as
shown on the Critical Aquifer Recharge and Wellhead Protection Areas Maps. Please refer to the
handout on Critical Aquifer Recharge and Wellhead Protection Areas for a description of the review
process.

Cardiac effects While there is no evidence that exposure to industrially acceptable levels of hydrocarbons
have produced cardiac effects in humans, animal studies have shown that inhalation of high
vapor levels of the components of this product have produced cardiac sensitization. Such
sensitization may cause fatal changes in heart rhythms. This latter effect was shown to be
enhanced by hypoxia or the injection of adrenaline -like agents.

• Odor may fade due to chemical oxidation in improperly prepared new tanks and cylinders
or from rust, air, and water in used containers that have been allowed to stand open to the
atmosphere.
• Odor may be absorbed and adsorbed by the walls of containers and distribution systems.
• Odor in the gas escaping from underground leaks may be absorbed by certain types of
soils.
■ Effectiveness of the odorant may be reduced by cold temperatures.
■ Other odors, such as from cooking or from a musty basement, may mask or cover up the
mercaptan odor in propane.
• Exposure to the mercaptan odor of propane for extended periods of time may affect a
person's ability to detect the odorant.
• Physical disabilities or the use of alcohol, tobacco, or drugs may decrease a person's
ability to detect the odorant.
