Dear Mr. Palda:
The Community and Economic Development Department and other city staff have reviewed the Planned
Action SEPA (PAS) checklist you submitted. We have determined that the water quality improvement
proposal at The Commons of Federal Way does qualify as a planned action as provided in Federal Way
Revised Code (FWRC) 14.15.130(3)(fl(iii) s%follows:
The subject property is located within the area targeted by the PAS conducted by the city in 2006.
The applicant submitted a PAS checklist that demonstrates that the water quality improvements are
eligible to be considered as a planned action, and therefore exempt from further review under the
State Environmental Policy Act (SEPA). This is because:
(1) The improvements are accessory to the sale of retail goods and services and are therefore
consistent with the uses reviewed under the PAS pursuant to FWRC 14.15.130, and no mitigation
measures from the EIS associated with the PAS are necessary;
(2) The proposed use will not generate any new PM peak hour trips; and
(3) The proposed use meets decisional criteria of FWRC 14.15.130(3)(d)(ii) as follows:
(a) The proposal is not otherwise exempt from SEPA because more than 500 cubic yards of soil
are proposed to be disturbed;
(b) The water quality improvement -project is consistent with Federal Way Comprehensive Plan
(FWCP);
(c) The project is implementing a project that had its significant adverse environmental impacts
adequately identified in the EIS;,.
(d) The project falls under the planned action qualifications from FWRC 14.15.130(3)(c) as
follows:

i. The project is accessory to the retail goods and services use;
ii. The proposal does not involve expansion of additional square footage;
iii. The proposed project is located within the City Center -Core zoning district, and is in
the planned action area;
iv. The: project does not add to PM peak hour trips as it does not involve expansion of
square footage;
v. The project does not result in any changes in impacts to any of the elements of the
environment that were identified in the EIS; and
vi. This project will be constructed within the 2014 horizon identified in the PAS. Also,
environmental conditions have not changed from those analyzed in the EIS, thus the
planned action designation remains applicable;
(e) The SEPA official has determined that the project's adverse impacts are able to be mitigated
with applicable requirements and conditions;
(f) The project complies with all applicable local, county, state, and federal regulations, and
where appropriate needed modifications have been approved; and
(g) The water quality improvements are not an essential public facility.
This letter confirms that information submitted by the applicant adequately addresses relevant PAS
criteria to the city's satisfaction and furthei environmental review of the redevelopment project under
SEPA is not required.
Our decision not to require additional environmental review does not mean that the license, permit, or
approval you are seeking from the city has been granted. Approval or denial of the proposal will be made
by the appropriate administrative or legislative body vested with that authority. The PAS environmental
record is considered by the decision maker(s) and conditions will be imposed to reduce identified
environmental impacts, as long as the conditions are based on adopted and designated city policy.

Dear Mr. Brown:
The proposed work exceeds the State Environmental Policy Act (SEPA) exemption levels in that more
than 500 cubic yards of material will be disturbed (as I understand). Typically, this would require
submittal of a SEPA checklist, posting of the site, mailing a notice to adjacent property owners, a fee of
$1,764.50, and a two week comment period followed by a two week appeal period.
In this case, the city has adopted a Planned Action SEPA document, whose geographic boundaries
include the mall. The Planned Action document has pre -identified impacts of a wide spectrum of
development activity and potential mitigation measures.
In order to verify the development activity is in keeping with that anticipated in the Planned Action
document; please submit the enclosed abbreviated Planned Action checklist (with enclosed resubmittal
form) with the fee of $322. Upon receipt of the checklist and verification of consistency with the Planned
Action document, the Planning Division will approve the project.

This checklist is used to determine whether a proposed project is eligible to be
considered a Planned Action; and therefore, exempt from further review under the
State Environmental Policy Act (SEPA).

existing sub -basins surrounding The Commons at Federal Way.

Please describe the proposed project in detail. Include the square footage of each proposed
use. Also, describe any existing uses currently on site and indicate if they will be removed.
Currently, the Commons at Federal Way is broken into 14 sub -basins with existing storm drainage systems to
manage surface water runoff. This project is to construct water quality treatment facilities for 11 of the 14
basins at the Commons at Federal Way.
2. Please provide an estimate of the probable, net PM peak -hour vehicle trips to be generated by
the proposed use(s). (You may deduct vehicle trips currently/previously generated by pre-
existing uses on the site.) Please provide references and/or technical support for your
estimates.
No additional PM peak -hour trips will be generated by the construction of the water quality facilities. There
may be a temporary slight increase in trips due to the construction activities but these additional trips will
be minimal and short term.

3. In order to be considered a "Planned Action" project, pursuant to the Federal Way Revised
Code (FWRC) 14.15.130(3)(d)(ii), a project must meet all of the following criteria. Please verify
that the proposed project meets these criteria. Feel free to provide explanatory notes, if
applicable.
a. ❑ The proposed project is not otherwise exempt from SEPA; and
The project is not otherwise exempt from SEPA under any other condition. This project would
normally require a SEPA process for the disturbance of more than 500 cubic yards of material.
b. ❑ The proposed project is consistent with the City of Federal Way Comprehensive
Plan (FWCP) adopted under RCW 36.70A; and
This project is consistent with the City of Federal Way Comprehensive Plan. By providing water
quality treatment for the existing storm drainage this project is consistent with the goals and
policies of Chapter 9 — Natural Environment. In particular this project meets the following goals
and policies:
NEG2 - Protect the public health and safety and prevent property damage by reducing surface
water problems.
This proposal will provide water quality treatment for the stormwater generated by the parking
surfaces at The Commons. As such the cleaner water will is safer and better for the public.
c. ❑ The proposed project is subsequent to or is implementing a project which has had
its significant adverse environmental impacts adequately identified in the City
Center Planned Action EIS; and
This property and primary use (retail) were included in the City Center Planned Action EIS. The
planned action project area is located in the City Center of the City of Federal Way, bounded on the
north by South 312th Street; on the south by South 324th Street; on the west by Pacific Highway
South and on the east by 23rd Avenue South. The proposed Zoning Code amendment would apply to
the entire City Center Core zoning designation. The planned action designation applies to proposed
residential, retail, office, hotel, civic, and structured parking development failing within the
development envelope analyzed in the EIS. This project is considered an accessory use to the retail
that is provided at The Commons and as such it's adverse impacts were adequately identified in the
City Center Planned Action EIS.
d. ❑ The proposed project falls within the Planned Action qualifications identified in
FWRC 14.15.130(3(c); and
The proposed project qualifies as an accessory use to the Retail Goods and Services Use that
was analyzed in the EIS. It does not exceed any of the thresholds spelled out as requiring
additional SEPA review, and it is within the planned action area.
e. ❑ The proposed project's adverse impacts are able to be mitigated through the
application and/or inclusion of mitigation measures detailed in the Mitigation
Document, as well as other applicable City, county, state, and federal requirements
and conditions, which together constitute sufficient mitigation for the significant
environmental impacts associated with the proposed project; and
This project will not have any adverse impacts but will rather be improving environmental impacts
by providing a higher level of water quality treatment for the existing stormwater that is generated
on the site.

f. ❑ The proposed project complies with all applicable local, county, state, and federal
regulations, and where appropriate, the proposed project complies with needed
variances or modifications or other special permits have been identified; and
The proposed project is in compliance with all local, county, state, and federal regulations as they
apply to the design and construction of water quality treatment facilities.
g. ❑ The proposed project is not an essential public facility.
The proposed project is not an essential public facility and is privately owned property.
