Federal Kty Revised Code (FWRC) 18.55.060 requires residential land divisions to provide 15 percent of the gross land area as open space; or as an alternative, applicants may request to provide a fee -in -lieu of the onsite open space in the amount of 15 percent of the most recent assessed land value of the property just prior to recording the plat document. The fee -in -lieu method was your chosen method of meeting the city's open space requirement. The city's subdivision and zoning regulations do not grant administrative authority to waive open space requirements; however, a recently passed ordinance that allows mitigation payments to be deferred may provide some measure of relief. Your short subdivision is eligible to defer the payment of open space fees until the closing of sale of each developed property, or five years from the date of plat recording, whichever is earlier. In order to qualify for this deferral, a covenant will be recorded on each lot concurrently with the plat document stipulating the deferred payment obligations. Dear Sir or Madam, � ,� A_�. As you are aware, a City of Federal Way water drainage pipe empties at the south end of my lot and renders my property unbuxldable. As Per Previous communications with you, I intend to as outlined sub -divide the lot into two parcels. I have complied with most of the r�eaq a sues caused by the reents by the City. One of the requirements is for me to take care of the drerg is city pipe. I have hired a civil engineer who has completed the plans for e a di enclosed on of e water. He has included a cost estimate of the project which is $ document.) The City requires a fee of 15% of the county -estimated value of the lot. The current assessed value for the pre -divided lot for 2011 is $297,000.00. This means hatthe hCity' amounts to a fee ($44,550.00) plus the cost of fixing the water problem ep paragraph) total of $84,897-00. With the depressed, real -life market value of the property,this amounts to approximately the value of one of the lots, once the sub -division is granted. It seems to me that the City had the obligation to establish proper water drainage as opposed to dumping it onto private land. In my situation, the City failed in this. I am requesting for the City of Federal Way to waive the subdivision of a fee so that I can subdivisionisproperly divert the water from the City's drainage pipe. Otherwise, my pursuit unfeasible.
