Within the time of your extension request, Washington State Legislature passed Engrossed House Bill (EHB) 42152. This change to the approval timelines associated with plats effectively alters the expiration date of your preliminary plat to nine (9) years from the date of preliminary plat approval. Consistent with EBB 42152, the six -lot Noyes Preliminary Plat, which received Federal Way City Council approval on June 28, 2005, will now expire on June 28, 2014. Therefore, an extension pursuant to city code is not required and your extension request will be closed. A refund in the amount of $344.50 for the concurrency application will be issued to you separately. The referenced plat is a six -lot short subdivision granted approval by Federal Way City Council on June 28, 2005. The expiration date for the plat was extended seven (7) years from the date of preliminary plat approval, consistent with Substitute Senate Bill #6544, passed by the Washington State Legislature, and as interpreted by the City of Federal Way City Attorney. That expiration date of preliminary plat approval is June 28, 2012. The city's subdivision regulations allow the director to administer extensions if criteria within Federal Way Revised Code (FWRC) 18.05.090(2) can be satisfied. ADDITIONAL INFORMATION REQUESTED Before this current extension can be approved, the applicant must submit a concurrency application with related processing fee of $344.50. A copy of the application is enclosed with this letter. The city's traffic division will evaluate the application and determine if there is adequate capacity in the transportation network, or if additional transportation improvements will be required. The city is supportive of your extension request, but we will withhold issuance of an extension approval until this analysis is complete and adequate capacity has been verified. For your information, the extension will likely be conditioned as noted below: Conditions: 1. Applicant shall be subject to current transportation impact fee (TIF). For estimation purposes, the current TIF fee for a single family is $3,112 per dwelling unit (lot). 2. Applicant shall be subject to the adopted 2009 King County Surface Water Design Manual and Federal Way Addendum requirements as a replacement for the prior 1998 manual. CLOSING Please submit a concurrency application with related processing fee of $344.50 at your earliest convenience. Also, be advised that unless a future extension is granted, the Noyes Short Plat shall be completed per conditions of preliminary approval, or the short subdivision shall expire by limitations set forth in FWRC 18.30.260. Because it's been so long since Lakehaven provided any comments on this application/development, I've updated (where/if necessary) & included those comments (and current documents) below (as if following a DRC meeting w/applicant). WATER A Certificate of Water Availability issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications (check with land use agency for requirement). It appears the last Certificate issued by Lakehaven for this application was on 6/2/2003, and Lakehaven development requirements remain unchanged. The following criteria are sufficiently met: a) Circumstances have been beyond my control to meet the original time restraint. The first year was spent in a modification to the design only allowed months after initial approval was granted. Thus making the project economically feasible. The following year was spent in seeking financing, a partner or a buyer. By the beginning of 2007, economic forecasts and conditions were such that that the project become untenable from a financial risk standpoint. b) The requested extension will not create or continue adverse conditions. c) Physical conditions have not changed, contrary to the public interest. Financial commitments have not been possible due to existing economic conditions. Economic conditions are projected to improve in the second half of this year, and that before the end of this time extension, developers are expected to reenter the residential market for projects with a one to two year outlook. Completion of this proposed development remains in the public interest. It will connect two existing dead-end streets, thereby improving neighborhood access for residence and fire department.
