Dear Mr.Gakin:
The City of Federal Way is in receipt of your request to intrude approximately 30 feet into the required 50-foot
buffer (setback) of a minor stream located to the east of 26th Avenue SW in order to locate and repair a damaged
conduit and cable.
Pursuant to FWRC 19.150.080 Exemptions, the following activities are exempt from the provisions of Chapter
19.150, Critical Areas Administration:
(1) Emergencies that, in the opinion of the director of community development, threaten the public health,
safety and welfare;
(2) Normal and routine maintenance and repair of the following facilities, for which a maintenance plan has
been approved by the public works director:
(a) Existing drainage ditches; provided, however, that this exception shall not apply to any ditches used
by salmonids other than to permit free migration of salmonids to their spawning grounds;
(b) Surface water facilities; provided, that such activities shall not involve conversion of any regulated
wetland not currently being used for such activity;
(c) Existing public facilities and utility structures or rights -of -way.
Replacement of the conduit and cable will require power outages to Decatur High School and approximately 170
customers. You have requested an emergency exemption pursuant to FWRC 19.150.080(1) because the work must
be done tomorrow in order to avoid interference with the Decatur Gator Day activities scheduled for next week
and there is not enough time to prepare a maintenance plan pursuant to FWRC 19.150.080(2).
The requested stream setback intrusion is hereby approved based on the work being done in accordance with Best
Management Practices in order to minimize any adverse impacts to the stream and 50-foot stream buffer. This
approval does not exempt the project from other local, state, and federal permit requirements. If you have any

Re: Emergency request to work within a minor stream setback 14-104161-OOAD
An existing PSE power conduit crosses under a minor stream between a switch and a vault. The power
cable between the two is failing and customer interruptions are imminent. We had intended to remove
the old cable and replace with new but have not been successful so now believe the conduit is crushed .
An excavation to locate and repair the damaged conduit is required. The stream bed itself should not be
affected. There is no water currently running in the stream but erosion control measures will be
installed regardless.
Replacing the cable will require outages to Decatur High School and approximately 170 customers. This
work is tentatively scheduled for 8/15/14.
This work is not covered by a maintenance plan with the Public Works Department referenced in
19.150.80, nor is there time to create one so the PW Director has referred this work to be performed
under section "(1) Emergencies" as there is potential for service interruptions & outages for both
neighborhoods & the high school.
19.150.080 Exemptions.
The following activities are exempt from the provisions of this division:
(1) Emergencies that, in the opinion of the director of community development, threaten the public
health, safety and welfare;
(2) Normal and routine maintenance and repair of the following facilities, for which a maintenance plan has
been approved by the public works director:
(a) Existing drainage ditches; provided, however, that this exception shall not apply to any
ditches used by salmonids other than to permit free migration of salmonids to their spawning
grounds;
(b) Surface water facilities; provided, that such activities shall not involve conversion of any
regulated wetland not currently being used for such activity;
(c) Existing public facilities and utility structures or rights -of -way -
The maintenance plan may be designed to address individual facilities or facility components, area -wide
facilities or city-wide systems. The maintenance plan shall identify the nature of the potential maintenance or
repair activities, specifications for work which may occur within potential sensitive areas, specifications for
restoring and/or mitigating impacts, specifications for timing of maintenance or repair activities, and process for
contacting or notifying the city of pending maintenance or repair activities to ensure compliance with the
approved plan. The public works director may require that an appropriate bond or security be maintained with
the city to ensure restoration of disturbed areas.
Please approve an emergency request to intrude into the setback area to make this repair.
