RE: FILE #10-101998-AD; NOYES PRELIMINARY PLAT, FEDERAL WAY, WA
Dear Mr. Noyes:
This letter confirms that the expiration date of the Noyes Preliminary Plat shall be seven (7) years from
the date of preliminary plat approval, consistent with Substitute Senate BiII #6544, passed by the
Washington State Legislature, and as interpreted by the City of Federal Way City Attomey. This change
to the approval timeline became effective on June 10, 2010, the date that SSB #6544 became effective.
The six -lot Noyes Preliminary Plat, which received Federal Way City Council approval on June 28, 2005,
will now expire seven (7) years from the date of preliminary plat approval, or June 28, 2012.
Please contact Senior Planner Deb Barker at 253-835-2642 should you have any questions about the
Noyes expiration date or other subdivision issues.
Sincerely,

Re: File #03-104054-000-00-SU; Request Time Extension of Noyes Preliminary Plat
In accordance with City Code, I am requesting a 2 year time extension to subject
preliminary plat. This is the first extension request.
The following criteria are sufficiently met:
a) Circumstances have been beyond my control to meet the original time
restraint. The first year was spent in a modification to the design only allowed
months after initial approval was granted. Thus making the project
economically feasible. The following year was spent in seeking financing, a
partner or a buyer. By the beginning of2007, economic forecasts and
conditions were such that that the project become untenable from a financial
risk standpoint.
b) The requested extension will not create or continue adverse conditions.
c) Physical conditions have not changed, contrary to the public interest.
Financial commitments have not been possible due existing economic conditions. These
conditions are expected to improve, and that by the end of this year developers should
start to reenter the market or commence projects with a one to two year outlook.
Completion of this proposed development remains in the public interest. It will connect
two existing dead-end streets, thereby improving traffic access.
Included is a $75 hourly review fee. 0
