On November 5, 2019, the City of Federal Way received your request for third party review of the October
29, 2019, Wetland and Fish and Wildlife Habitat Assessment, prepared by Soundview Consultants. The above
listed parcels are currently within unincorporated Ding County. The proponent would have to annex into
Federal Way. This wetland peer review was conducted as if the property was in Federal Way. This letter is for
informational purposes only and is not a guarantee or determination that the property will be annexed.
The city forwarded your request to our wetland consultant, Landau, for their review. Landau completed a site
visit, reviewed relevant documents, and prepared a December 23, 2019 memorandum (enclosed) in which
they agree with the delineated boundary and rating of Wetland A included in the October 2019 report.
According to the Federal Wiry Revised Code (FWRC), Wetland A is a Category III wetland with an 80-foot
buffer based on its habitat score of five points. Please review the memorandum from Landau, in particular
peer review comments #1-3; #2 pertains to future project submittal preparation.
When planning future development on the parcels, note FWRC 19.145.160: "Unless otherwise provided,
structures shall be set back a distance of five feet from the edges of a critical area buffer. The following may be
allowed in the building setback area: (1) Landscaping; (2) Building overhangs; and (3) Fences and railings six
feet and less in height." The wetland, buffer, and additional critical area building setback must be delineated on
the site plan of any development application in conformance with FWRC 19.145.150(4). Any future land use
application submittals to the city should include a copy of the October 2019 wetland assessment, Landau's
December 23, 2019 Memorandum, and this letter.

Introduction
This technical memorandum provides Landau Associates, Inc.'s (LAI's) peer review comments on the
October 2019 Wetland and Fish and Wildlife Habitat Assessment, 3014 South 3201h Street &
31625 32"d Avenue South (October 2019 Report), prepared by Soundview Consultants, LLC
(Soundview Consultants LLC 2019).1 The assessment evaluated wetland and fish and wildlife habitat at
the parcels noted above, collectively referred to as the subject properties.
The purpose of this peer review was to provide a professional opinion regarding applicable regulatory
requirements in the City of Federal Way (City) Revised Code (FWRC) Title 19.145 (Environmentally
Critical Areas), specific to Article IV Wetlands.
Peer review comments regarding the October 2019 Report are as follows:
1) LAI staff conducted a reconnaissance of the subject properties on December 18, 2019 and agree
with the delineated boundary and rating of Wetland A included in the October 2019 report. LAI
was able to locate all sample plot and boundary flagging, as shown on Figure 1 of the October
2019 Report. The boundary of Wetland A was observed to generally follow the grade change of
the subject properties.
2) LAI recommends that the wetland boundary flagging be surveyed, if not already completed, for
inclusion on future site plans. LAI acknowledges that Figure 1 of the report presents a scaled site
map of the wetland boundary and flagging; however, the report does not provide an indication of
the method used for locating the boundary flagging shown on the figure (i.e., GPS or other land -
survey methods are not referenced). LAI also notes that evidence of possible survey activities on
the subject properties may have been initiated or completed, based on the presence of additional
flagging on the subject properties and minor clearing, which would provide access to -the wetland
and associated boundary flagging.
3) LAI acknowledges the intent of the October 2019 Report was to provide a summary of existing
conditions on the subject properties, and it satisfies the applicable reporting requirements of

impacts, mitigation sequencing, and other applicable development requirements included in
FWRC 19.145.080(2) (g through j) and FWRC 19.145.410(2)(b) are expected to be included in
subsequent development application submittals, as necessary.
This technical memorandum has been prepared for use by the City in evaluating the adequacy of the
summary of baseline conditions presented in the October 2019 Wetland and Fish and Wildlife Habitat
Assessment, 3014 South 3201h Street & 31625 32"d Avenue South. The purpose of the review was to
assess the adequacy of the submitted documents for compliance with City requirements, as
promulgated in FWRC Title 19, and conformance with conventionally accepted wetland/waterway
delineation practices. No other party is entitled to rely on the information, conclusions, and
recommendations included in this document without the express written consent of LAI. Further, the
reuse of information, conclusions, and recommendations provided herein for extensions of the
project or for any other project, without review and authorization by LAI, shall be at the user's sole
risk. LAI warrants that within the limitations of scope, schedule, and budget, these services have been
provided in a manner consistent with that level of care and skill ordinarily exercised by members of
the profession currently practicing in the same locality under similar conditions as this project. LAI
makes no other warranty, either express or implied.

Dear Stacey:
Landau Associates, Inc. (LAI) is pleased to provide this proposed scope of services and cost estimate
for peer review services to the City of Federal Way (City) for the above -referenced project. This
proposal is in response to your request dated November 8, 2019 and is based on a brief review of the
information provided with your request in the Consultant Authorization form (attached) and LAI's
experience on similar projects. LAI will provide the services requested on the Consultant Authorization
form. Assumptions for the proposed scope of services are summarized below.
Assumptions
■ The City will coordinate necessary access permission to the subject property, and the
applicant will provide necessary access permissions to offsite properties, as necessary.
• Onsite soil sampling test pits, if necessary, will be excavated by hand for comparison with
conditions noted in the Technical Memorandum.
■ Written responses to the Technical Memorandum and resubmitted/corrected documents will
be provided in technical memorandum format.
• A draft version of the LAI's third -party review technical memorandum will be provided for City
review. A final version will be provided after addressing/incorporating any City comments, as
appropriate.
• A meeting with the applicant's biologist, if requested, will occur at the time of LAI's initial site
review; costs for this meeting are included with the cost estimate.
• LAI's scope of services does not include delineation of waterways or wetlands.
Deliverables
• Electronic (Adobe PDF) copies of LAI's draft and final Third -Party Review technical
memorandum.

Cost Estimate
LAI proposes to provide our services on a time -and -expenses basis in accordance with the existing
professional services agreement with the City for Third -Party Wetland/Stream Review and Evaluation
(signed August 9, 2019). The estimated cost for the scope of services is $7,287, which consists of
$5,251 for review of the initial application materials and up to $2,036 for review of revised
documents, if necessary (see attached table).
If project requirements change, or unforeseen conditions are encountered, that require services
beyond the scope outlined above, LAI will bring these to your attention and seek approval for
modification to the scope of services and budget, as appropriate. LAI will not exceed the total
estimated cost for our services without prior authorization from the City. If the scope of services and
cost estimate are acceptable, please provide us with written authorization.

The normal course of action is for the city to set up an account to be funded by the applicant and drawn
down by the work performed by Landau. Please note that if any of the funds are not used, they will be
returned to the applicant, To begin this process, provide following items to the Permit Center: the enclosed
invoice, a check in the amount of S7,287.00, payable to the City of Federal Way, a signature on the enclosed
consultant authorization form along with the enclosed Resubmittal Form.
Please review the enclosed November 18, 2019, letter from Landau. Additional reviews or meetings beyond
that detailed in the letter will require a supplemental cost and authorizadon. As they requested, please provide
the city with documentation authorizing Landau to access all seven parcels. You will be responsible for
