Soundview Manor Preliminary Plat
Dear Mr. Deaver:
This letter grants conditional approval of the extension to the 180-day deadline for submitting requested
information for the above -referenced preliminary plat application, Federal Way file #07-103109-00-SU.
This preliminary plat application, originally submitted on June 7, 2007, involves the subdivision of a
difficult site with topographic issues and critical area buffers. City staff met with you and your client
several times in order to provide direction for revisions to the plat layout, and we remain encouraged that
your preliminary redesigns, submitted on September 29, 2010, appeared to address a number of the site
challenges.
Pursuant to Federal Way Revised Code (FWRC) 18.05.080, `Application Cancellation, " the Director of
Community and Economic Development may grant an extension to the 180-day request for information
timeline, as long as specific criteria are met.'
Your letter dated April 13, 2011, does demonstrate that circumstances beyond the applicant's control
prevent compliance with the 180-day time limits, that you are making substantial progress in responding
to the request for information, and that you need an additional 180 days of time. Your request for an
additional 180 calendar days to provide the information requested in the City's November 9, 2010, letter
is approved subject to the following conditions:
Conditions of approval
1. As noted in a previous extension approval letter dated August 12, 2010, with any subsequent
extension, the project shall be required to comply with the storm water regulations from the 2009
King County Surface Water Design Manual (KCSWDM) and any amendments adopted by the
City. This means that any resubmitted information including Technical Information Reports
(TIR) and storm drainage plans shall be designed to meet standards of the 2009 KCSWDM.
2. As further noted in the August 12, 2010 extension, the project is now required to comply with the
Traffic concurrency review process and Traffic Impact Fee (TIF). This means that a new
concurrency review application with a $1,584.00 application fee must be submitted. The project

is also now subject to traffic impact fee (TIF) mitigation per FWRC 19.91. Note that the TIF
mitigation replaces the previous pro-rata share mitigation amount of $157,506.
As provided under FWRC 18.05.080, all information that was requested by the City in their November 9,
2010 letter, the above noted conditions of approval; and concurrency review application and applicable
fees shall be submitted no later than November 7, 20112 or the preliminary plat application shall be
determined to be null and void.

I am writing this letter to request a 180 day time extension for the preliminary plat of
Soundview Manor. As you aware we have worked through and resolved many of the issues
with this project. However several issues still remain to be addressed. My client and I
continue to believe the Soundview Manor project is viable even in these tough economic
times. Per your e-mail you requested the extension request conform to the Federal Way
municipal code section 18.05.080 (2) Extension request. I have broken each section down as
follows.
(a) That ebrumstance beyond the applicant- control prevent compliance with the time limits of
subsection (1) of this section; The preliminary plat layout has been modified several times
to comply with city requests. I believe we now have a layout that is in an acceptable
format to the city. However all the reports need updating to address the reduced
number of lots. Some of the original consultants on this project no longer exist and
therefore it has taken longer to address the issues out line in the November 9"' 2010
letter.
(b) That the applicant is making substantial p,,ogress in responding to the requestfir information so
that review of the application can be furthered when that information is submitted; The revised
preliminary plat layouts have essentially been approved by city staff. This opinion is
based on the comments from the November 9, 2010 letter. The remaining work
consists of updating the geotechnical, storm, traffic and wetland reports.
(c) The Number of additional calendar days necessary to provide the requesled information. We
request 180 additional days to complete the necessary information.
