The Community Development Department is in receipt of your recent inquiry regarding an allowable land
use classification for a proposed 14,000 square -foot, 16-bed residential treatment facility for mental health
inpatient evaluation and treatment. Your inquiry states: "[t]he facility will operate 365 days per year, 24
hours per day and will have an average length of stay of 3-14 days per client. The facility will be a secure
facility and clients will not be able to come and go given the involuntary treatment component."
Following review of the definition section of the Zoning and Development Code; the Hospital definition set
forth in Federal Way Revised Code (FVWRC) 19.05.080 is the appropriate allowable land use category for
your proposal as it provides inpatient health services for those suffering from mental conditions.
Hospital is defined as:
"an institution providing primary health services and medical or surgical care to persons, primarily
inpatients, suffering from illness, disease, injury, deformity and other abnormal physical or mental
conditions, and including, as an integral part of the institution, related facilities such as laboratories,
outpatient facilities, extended care facilities and/or training facilities."
Hospital uses are permitted in the city's Community Business, City Center Core and Frame, and
Office Park zones. The proposal will require a Use Process III application with environmental
checklist. Following the land use decision and environmental threshold determination, site
development and building permits can be issued. A preapplication meeting with city, fire and utility
staff will be required prior to submitting a Use Process III application. I have enclosed information
regarding the preapplication conference with this letter.

A month or so ago you helped me at the counter about a project I was working on. I wanted to provide you some
additional information so that we can figure out how best for me to proceed.
My company has been awarded a contract with King County to operate a 16 bed Residential Treatment Facility that will
be licensed by the State (DSHS) as a mental health inpatient evaluation and treatment facility per WAC 246-337 and 388-
865. The contract intends for us to provide these involuntary treatment services (ITA) in the South County region and
your City is one of the jurisdictions we are considering. The facility will be a new ground up construction, approximately
14,000 square feet in size and built as an R2 occupancy. The facility will operate 365 days per year, 24 hours per day and
will have an average length of stay of 3-14 days per client. The facility will be a secure facility and clients will not be able
to come and go given the involuntary treatment component.
I am asking the various municipalities I am working with to assist me by identifying the use classification for this project
so that I may focus my property search on appropriate zoning per your local code. Please let me know if this email
provides you enough information to work with to classify the use and if a fee is required to make such a determination.
If that is the case please indicate how to start that process.
Also, if your City has an economic development manager I would appreciate being contacted by that person.
