Dear Mr. Archer:
The Community Development Department has completed the review of your Process I Master Land Use
(MLU) application for the minor exterior building and site revisions at the SE corner of the existing
Brookdale Foundation House assisted living facility located at 32290 1" Avenue South. The Process I
application is hereby approved pursuant to the findings and conclusions noted below.
FINDINGS
■ The zoning district for the subject property is Office Park (OP). The existing assisted living facility
and proposed memory care use are permitted in the OP-1 zoning district per Federal Way Revised
Code (FWRC) 19.235.060. The existing assisted living facility was originally approved by the City of
Federal Way on February 23, 1999, via a Process III Site Plan Approval decision under file number
98-100304-UP.
• In summary, the proposal includes building and site revisions in the area of the SE corner of the
building, generally including the following: converting existing Assisted Living to Memory Care in
one wing of the first floor; constructing a courtyard with an eight -foot high fence enclosure;
eliminating four parking stalls; minor modification of landscape and pedestrian areas; minor fagade
modifications; exterior painting; and refinishing.
There is no expansion of interior floor area. The site and building modifications are all within the
existing building envelope and existing parking area envelope.
■ The site modifications and exterior building modifications are subject to Process I review pursuant to
FWRC 19.15.030(1). Process I is an administrative land use review process pursuant to FWRC
Chapter f 9.55, "Process I — Director's Approval."
■ The interior of the building is also being remodeled, but is exempt from land use review per FWRC
19.15.020.

+ The proposed exterior modifications comply with FWRC Chapter 19.115 "Community Design
Guidelines," as appropriate for minor exterior revisions to an existing building. The exterior fagade
modifications are consistent with the existing fagade treatments and building design.
+ The proposed minor site revisions do not trigger nonconforming development compliance
requirements in FWRC 19.30.090.
• The proposal includes elimination of four existing parking spaces. Following elimination of the four
parking spaces, the site and use will still comply with the required minimum parking stall count for
the use identified in FWRC 19.235.060 as follows: 1 space for every 3 beds + 1 space for each 2
employees.
212 beds X .33 = 70 resident spaces
30 employees X .5 = 15 employee spaces
Total Required Spaces = 85 spaces
The number of spaces that will exist after the change, including the four spaces to be removed, is 104.
• The proposal does not add and/or replace more than 5,000 square feet of impervious surfaces, and is
therefore exempt from any stormwater requirements.
• The proposed change from assisted living units to memory care units for a portion of the building is
so minor it's still within the existing vehicular trip generation.
• The proposed improvements do not exceed allowable building height; do not reduce the amount of
required landscaping, buffering, screening, parking; and do not change access, pedestrian
connections, or easements. The structure meets all of the minimum zoning setback requirements. The
proposed modifications do not extend improvements any closer to the adjacent wetland and 100-foot
wetland buffer than currently exists.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings above,
the proposed improvements to the developed site meet the following Process I approval criteria and land
use review thresholds of FWRC 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19
including, but not limited to: Permits and Review Processes; Process I — Director's
Approval; Office Park (OP); and Nonconformance.
2. The health, safety, and welfare of the citizens of the city are preserved.
3. The proposal is `minor new construction' and is categorically exempt from SEPA review
per the city's flexible thresholds per FWRC 14.15.030.

BUILDING PERMIT ISSUANCE REQUIRED
The city is currently reviewing the building permit (file 17-105213-00-CO) associated with the exterior and
interior improvements. No work may begin until the building permit is issued. Please contact the permit
center at 253-835-2607, or permitcenter@cityoffederalway.com, if you have any questions regarding the
building permit.
APPEALS
The effective date of this decision is December 21, 2017, or three days from the date of this letter.
Pursuant to FWRC 19.55.050, any person who received notice of the administrative decision may appeal
this decision to the Federal Way Hearing Examiner within 14 calendar days, or by January 4, 2018. Any
appeal must be in the form of a Ietter delivered to the Department of Community Development with the
established fee. The appeal letter must contain a clear reference to the matter being appealed and a
statement of the alleged errors in the director's decision, including the identification of specific findings
and conclusions made by the director, disputed by the person filing. You may waive your right to appeal,
if desired, by writing the city a letter to this effect.
APPROVAL DURATION
Unless modified or appealed, the Process I decision is valid for one year from the date of issuance of the
decision. A one-year time extension to the decision may be requested prior to the lapse of approval
following the provisions listed in FWRC 19.15.110. The improvements must be substantially completed
within the one-year time period, or the land use decision becomes void.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of the
building permit, which is still under review. If you have any questions regarding this decision, please
