The development includes porches, stairs and concrete pads containing amenity space for each cabin and fourteen gravel parking spaces with curb -stops with landscape planters. Per the applicant, State Park staff have cleared approximately 18,000 sf of a former tent camping area removing brush, several trees and ground -cover. Public Works and Community Development staff conducted site visits on January 22°d and 27t", 2016. TECHNICAL REVIEW The following items must be addressed prior to the Community Development Department issuing approval of the Use Process I 'Director's Approval'. The applicant is required to apply erosion and sediment control measures (ESC) and flow control Best Management Practices (BMPs). The Process I MLU application is hereby conditionally approved as it meets the review criteria set forth in Federal Way Revised Code (FWRC) 19.55.020. The Director's conclusions are based on the review and findings made by the Department's Planning Division below. The Development Services Division, South King Fire and Rescue, Lakehaven Utility District and the State Department of Archaeology and Heritage Preservation completed technical reviews. The applicant resubmitted plans on February 24, 2016, and revised landscaping plans on March 2, 2016, removing two cabins proposed within a 50-foot slope buffer containing grades greater than 15 percent. CONCLUSIONS Various sections of the zoning and development code indicate that certain developments, activities, or uses are permitted only if approved using Process I — Director's Approval. Based on the findings below, the proposed improvements to the developed site meet the following Process I approval criteria and land use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020: 1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but not limited to: Permits and Review Processes; Process I — Director's Approval; Clearing, Grading and Tree and Vegetation Retention; Community Design Guidelines; and the Suburban Estate (SE) zoning district. 2. The health, safety, and welfare of the citizens of the city are preserved. 3. The proposal is a minor improvement, modification, or addition to the subject parcel that is exempt from SEPA review. FINDINGS OF FACT 1. Proposal — Washington State Parks has submitted a Use Process I application for after -the -fact consideration of clearing and grading work in a former tent camping site. The applicant also proposes to install five 240 square -foot pre -fabricated cabins (12' x 20'). The total improvement area is approximately 18,000 square feet with 1,200 square feet of new gross floor cabin area. The cabins will be placed on `Super RV Jack Pads' and contain no ground foundation. Park staff will clear and grub the 18,000 square -foot area, planting replacement trees, vegetation and landscaping.The cabins will Mr. Van DeVanter March 4, 2016 Page 2 connect to existing public water and patrons will access public restrooms directly across an internal park road beside the development. Each cabin will have heat, A/C, a covered porch and a picnic area containing a table and fire -pit. The applicant shall obtain electrical permits for this project. 2. Location — The cabins are located in the south-east section of the state park, accessed through the south entrance along SW Dash Point Road. 3. Comprehensive Plan & Zoning Designation — The comprehensive plan designation is Parks and Open Space and the zoning designation for the property is Suburban Estates (SE). Pursuant to FWRC 19.195.160, public parks are an allowed use in the SE zone. The proposal achieves the policy intent of the Parks and Open Space Designation. 4. Setbacks, Height and Bulk Regulations —Cabin heights measured from the midpoint of the gable are 6.5 ft., and will not exceed the maximum allowable height (determined on a case -by -case basis). The proposal meets coverage and setback regulations. Critical Areas and Site Elevations — Changes in existing site elevations are such that staff evaluated existing topography using two -foot contours to determine if FWRC 19.145 - Critical Areas, particularly geologically hazardous areas (GHAs), apply. Along the western limits of the disturbed area an elevation change occurs, approximately 14 feet from the lowest to highest point. The area contains percent slope ranges of 15-20 percent and 20-90 percent. Accordingly, this would require a geotechnical study to analyze if any new structures within the standard 50-foot GHA setback/buffer are at risk of damage due to the geologic hazard and would not lead to or create any increased slide, or erosion hazard. The Washington State Parks department opted to locate all proposed cabins and improvements outside of the 50-foot buffer. Parking/Parking Areas — Pursuant to FWRC 19.195.160 and FWRC 19.130, the required number of parking spaces for a `Public park' defined as, "a natural or landscaped area, provided by a unit of government to meet the active or passive recreational needs of people," shall be detennined by the parks director. The applicant proposes 12 new gravel parking spaces with bumper stops and parking lot landscaping. The park provides several public lots and other parking areas. Accordingly, the Community Development Director approves this proposal on behalf of the Parks Departrr,ent. 7. Community Design Guidelines — The prefabricated cabins meet applicable Community Design Guidelines of FWRC Chapter 19.115.050 for site planning in context with the surrounding uses. The subject property is located within a State Park and is not visible from a public right-of-way. CONDITIONS OF APPROVAL 1. Proposal subject to Planning Division site inspection. Call 253-835-2644 to schedule an inspection prior to public use. Per FWRC 19.125.090(a), all required landscaping shall be installed prior to final inspection, unless the applicant submits a performance assurance as noted in FWRC 19.125.090(1)(b). 2. APPEALS The effective date of this decision is March 7, 2016, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by March 21, 2016. Any appeal must be in the form of a letter delivered to the Community Development Department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. However, in that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. RECEIVED DEC 2 3 2015 CITY OF FEDERAL WAY THE DASH POINT CABIN CDS PROJECT We have started by clearing an area 90' by 200' which was primarly used as Tent Camping, in doing so we removed Indian Plumb & Himalayan Black Berry foliage. This area will have a new lawn area and native plants. This area will be occupied with 7 new Park Model Rv Styled Cabins. These cabins will have heat and A/C, cabins also sleep 5 and has an outside covered porch and picnic area with table and fire pit. There will be paths to the graveled parking area. Each cabin will have its own 30 amp electrical service. One of the cabins is ADA accessible and one will be Pet Friendly. This will be another way for families to enjoy the Park without purchasing a Tent or RV. These cabins are close to the Restroom and Showers. This experience will give the customers an overnight accomodations in the outdoors with reasonable rates rather than the big chain Hotels. The area has a high potential for archaeological resources including shell'midden and human remains. Human burials have been documented in proximity to Dash Point State Park. Identification of archaeological resources during construction is not a recommended detection method because inadvertent discoveries often result in costly construction delays and damage to the resource. We request a professional archaeological survey of the project area be conducted prior to ground disturbing activities.
