Dear Mr. Waltz:
The Community Development Department has completed review of your Process I Master Land Use
application for proposed fagade/entrance upgrades to the existing Shari's Restaurant located at the above -
referenced address. The Process I application is hereby approved per the findings noted below.
FINDINGS OF FACT
1. The zoning for the subject property is Commercial Enterprise (CE). The existing restaurant is an
allowed use in the CE zone per Federal Way Revised Code (FWRC) 19.240.110, Entertainment.
2. The applicant is proposing to modify the entry area and other minor exterior upgrades to bring all the
national brand Shari locations into alignment with the current design guidelines for the remodel
program.
A raised entry with barrel roof, repainting existing roof/building, and new storefront door are
proposed. The new parapet is below the maximum height of 40 feet. No increase in square footage is
proposed.
4. New signage and logo will be reviewed under a separate sign permit.
5. The proposed upgrades will not create new impervious area; does not reduce the amount of required
landscaping, parking, buffering, open space, or public areas; and does not change pedestrian
connection, utilities, or easement.
CONCLUSIONS OF LAW
1. The proposed improvements are not exempt from Use Process review as they do not meet criteria set
forth in FWRC 19.15.020 — Exceptions.
2. Process I "Director's Decision" is the appropriate Master Land Use application as the improvements
are to a development site, and they do not exceed thresholds set forth in FWRC 19.15.030(1).

3. The proposed improvements are exempt from State Environmental Policy Act review as the scope of
work meets categorical exemption WAC 197-11-800(3) repair, remodeling, and maintenance activity.
4. The Federal Way Comprehensive Plan and zoning designation for the subject property is Commercial
Enterprise (CE). Pursuant to FWRC 19.240.110, the subject property's restaurant use is permitted in
CE zoning districts.
5. The proposed improvements meet Process I purpose criteria set forth in FWRC 19.55.020 including
compliance with applicable provisions of FWRC Title 19 `Zoning and Development' and health,
safety, and welfare standards.
APPEALS
The effective date of this decision is January 10, 2015. Pursuant to FWRC 19.55.150, any person who
received notice of the administrative decision may appeal this decision to the Federal Way Hearing
Examiner by January 26, 2015. Any appeal must be in the form of a letter delivered to the Community
Development Department with the established fee. The appeal letter must contain a clear reference to the
matter being appealed and a statement of the alleged errors in the Director's decision, including the
identification of specific findings and conclusions made by the Director disputed by the person filing.
In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal
this decision). Waiver of the right to appeal does not affect the effective date of this decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of a building

The intent of this Tenant Improvement is to bring all the locations of the National Brand into alignment
with the current Design Guidelines for the current remodel program.
Project Narrative
In this specific application, in addition to the interior remodel, the exterior scope of work will include the
following items:
1. Keep existing general exterior unchanged.
2. Refresh, Paint existing clay tile roof EP-6, to match new standing seam metal roof at entry.
3. Updated signage, new logo and logo -type, same square footage and same location where
possible. (Reference separate sign submittal)
4. New raised entry with barrel roof. (Reference exterior elevations and photographs from previous
remodel)
