Dear Mr. Heather:
The Community Development Department is in receipt of your December 28, 2016, one-year extension
request for city file no. 15-106477-UP, for five cabins (recreational trailers) located in a clearing at Dash
Point State Park. The city's zoning and development regulations allow the Director to administer
extensions if the review criteria of Federal Way Revised Code (FWRC) 19.15.110(2) are satisfied. The
Use Process I approval will expire March 7, 2017.
TIME EXTENSION CRITERIA
Pursuant to Federal Way Revised Code (FWRC) 19.15.110(4), "Lapse of Approval — Time Extension,"
the Director may grant a one-year extension of time for Use Process I applications in order to
substantially complete construction and applicable conditions of approval, subject to the following
criteria. City staff reviewing your extension request have responded to each criterion using information
provided by the applicant and relevant city policies justifying the extension approval. Please see the
analysis below:
(a) Except for the first request for time extension, the applicant has made substantial progress to
complete the project;
Staff Response — This is the applicant's first request; staff finds criterion (a) has been met.
(b) There are circumstances beyond the applicant's control which prevent compliance with the time
limits;
Staff Response — The application was routed to the Department of Archaeology and Historic
Preservation (DAHP) and the State requires an archeological survey prior to site development. This
was a condition of approval of the UP I. Washington State Parks is experiencing project delays due to
an internal backlog on cultural resources studies. The applicant retained an outside consultant in order
to complete the survey and field work will be completed shortly. Staff finds criterion (b) has been
met.

(c) The extension will not create or continue conditions that constitute a code violation or an attractive
nuisance, contribute to erosion and sedimentation problems, or impact the public health, safety, and
welfare;
Staff Response — Site conditions have remained relatively unchanged and unimproved since the
development was granted approval; therefore, code violations, attractive nuisances,
erosion/sedimentation problems, and impacts to public health, safety, and welfare should not arise
due to the extension approval.
Washington State Parks addressed existing erosion control issues by re -grading the site in order to
drain away from the northern side of the project area, containing geologically hazardous areas/slopes
of 15-20% and 20-90 % (approval condition #3). The applicant installed perimeter erosion control
measures, hydro -seeding with topsoil and cedar tree plantings to establish a lawn pursuant to approval
condition #2. The Public Works Department followed up with inspections in spring 2016. Staff finds
criterion (c) has been met.
(d) Whether either physical conditions in the vicinity of the project or codes and requirements of the city,
applicable agencies, and utility providers have changed to such a degree since initial approval that it
would be contrary to the public interest to extend the life of the project.
Staff Response — Staff finds criterion (d) has been rnet per the responses noted below.
(i) Whether the adoption of new codes and/or standards would substantially affect project layout and
storm drainage design;
Staff Response — Public Works Development Services Division staff note criterion (d)(i) has been
met.
(ii) The adequacy of mitigation and/or impact fees to address the cost of mitigation at the end of the
expiration period;
Staff Response — The proposal will not generate any net new trips during the weekday PM peak
period, as such mitigation and/or impact fees requirements do not apply to this proposal. Public
Works Traffic Division staff note criterion (d)(ii) has been met.
(iii) Whether the delayed project is an impediment to other development projects in the vicinity as a
result of traffic concurrency reserved capacity.
Staff Response — Public Works Department Traffic Division has determined a project delay will
not be an impediment to other development projects.

This one year approval extension will expire on March 7, 2018, or one year following the expiration of
the site plan approval (15-106477-UP). Please be advised unless future extensions are granted, the five (5)
Dash Point cabins shall be completed per conditions 1-6 of the Process I approval, or the project will

Dear Leila,
State Parks requests an extension to the above noted Application expiring on March 7,
2017 due to State Park's limited cultural resource staffing capacity. The project site has
been stabilized with erosion control measures installed and approved by the City last
summer.
In accordance with FWRC 19.15.110 Lapse of approval —Time extension, we have the
following in reference to the attached Application Conditions of Approval:
(2)(a): State Parks has made substantial progress to complete the Project by re -grading
the drainage away from the steep slopes (Condition of Approval #3) and temporary
perimeter erosion control (Condition of Approval #2) with inspection and approval by the
f �1 City. In addition, hydroseeding with topsoil and Cedar tree plantings were completed to
establish lawn and prevent erosion (portion of Condition of Approvals #1 and #4).
2)(b): State Parks in-house cultural resource review (Condition of Approval #5) has
been backlogged requiring outside consulting. Electrical permit applications (Condition
of Approval #6) will follow the cultural resource review process.
(2)(c): erosion control measures were completed and approved by the City last summer
therefore the extension request will not contribute to erosion and sediment problems,
constitute a code violation, attractive nuisance, or impact public health, safety and
welfare.
(2)(d): there have been no changes to the original permit requirements and there are no
other development projects planned within the Park adjacent to the site.
Cultural Review and DAHP approval for the Project will be completed in January or
February 2017 and Park Staff will complete placement of cabins with electrical service,
gravel parking and pedestrian circulation, planting and mulching and final hydroseeding
with City inspection and approval by as early as possible in May 2017 prior to the
summer recreation season.
