The Community Development Department is in receipt of your proposal to perform repairs and
maintenance work to the existing Lakota Creek fish ladder. The proposal is to install temporary stream
bypass facilities, construction of one and/or two additional rock weirs, relocation of boulder field
downstream and reintroduction of removed sediment back into the stream channel to reduce peak flow
channel scour. Additional maintenance includes cleaning the sediment trap, culverts, and stream channel
as necessary to promote passage of fish and improve the natural habitat. The proposed rehabilitation
project will maintain the effectiveness of the existing fish ladder and improve it with the addition of a
rock weir to reduce the fish jumps as recommended by the Washington Department of Fish and Wildlife
(WDFW).
The Director of Community Development may permit rehabilitation of a stream by allowing removal of
detrimental materials such as sediments and invasive, nonnative vegetation and corrective action for
degradation of the stream or riparian zone as necessary pursuant to Federal Way Revised Code (FWRC)
19.165.060 `Rehabilitation.' The above -mentioned Lakota Creek fish ladder repair project is hereby
conditionally approved, based on the conditions noted below.
CONDITIONS OF APPROVAL
1. As a minimum erosion control measure, silt fence should be installed where the gravel access
road is directly adjacent to stream (near sta 3+70 for example). A detailed erosion and sediment
control plan should be prepared, installed, and overseen by a CESCL and inspected by the City
prior to commencement of work.
2. Additional sand bags should be stored on site to protect the bypass culvert/pumping installation in
the event of a rain event.
3. It is recommended that the construction timeframe be late August to early September to work
within lowest stream flow rates. Work must be completed by September 30.
4. Contact Ann Dower at 253-835-2732 prior to start of work to discuss erosion control and when
the project is completed for final inspection.

5. A planting plan that depicts the quantity, size, and location of proposed vegetation shall
be submitted prior to re -planting; please email or provide a copy of the planting plan to
Associate Planner Becky Chapin, beck .cha in .ci cffederalwa .com for review and
approval.

1. ALL TEMPORARY EROSION AND SEDIMENT CONTROL MEASURES REQUIRED FOR THE PROJECT SHALL BE THE
RESPONSIBILITY OF THE CONTRACTOR- THE TESC BMPS SHOWN ON THE PLANS ARE THE MINIMUM REQUIREMENTS
FOR ANTICIPATED SITE CONDITIONS. DURING THE CONSTRUCTION PERIOD, THESE TESC FACILITIES SHALL BE

4. ALL REQUIRED EROSION/SEDIMENT CONTROL FACILITIES SHALL BE CONSTRUCTED AND IN OPERATION PRIOR TO
LAND CLEARING AND/OR OTHER CONSTRUCTION TO ENSURE THAT SEDIMENT LADEN WATER DOES NOT ENTER THE
DRAINAGE SYSTEM OR VIOLATE APPLICABLE WATER STANDARDS. ALL EROSION AND SEDIMENT FACILITIES SHALL BE
MAINTAINED IN A SATISFACTORY CONDITION UNTIL SUCH TIME THAT CLEARING AND/OR CONSTRUCTION IS
COMPLETED AND POTENTIAL FOR ONSITE EROSION HAS PASSED. THE IMPLEMENTATION, MAINTENANCE,
REPLACEMENT AND ADDITIONS TO EROSION/SEDIMENT CONTROL SYSTEMS SHALL BE THE RESPONSIBILITY OF THE
CONTRACTOR.
5. IN ANY AREA WHICH HAS BEEN STRIPPED OF VEGETATION AND WHERE NO FURTHER WORK IS ANTICIPATED FOR A
PERIOD OF 30 DAYS OR MORE, ALL DISTURBED AREAS MUST BE IMMEDIATELY STABILIZED WITH MULCHING, GRASS
PLANTING OR OTHER APPROVED EROSION CONTROL TREATMENT APPLICABLE TO THE TIME OF YEAR IN QUESTION.

Lakehaven Utility District is proposing to perform repairs and maintenance to the existing stream
enhancements which include installation of temporary stream bypass facilities, construction of
one and/or two additional rock weirs, relocation of boulder field downstream and possible re-
introduction of removed sediment back into stream channel to reduce peak flow channel scour.
Existing facilities within Lakota Creek include a sediment trap, two culverts, several embedded
logs, rock weirs, boulder fields and some stream bank armor. Additional maintenance includes
cleaning the sediment trap, culverts and stream channel as necessary routine maintenance to
promote passage of fish and improve the natural habitat. All work will be under the guidelines
of the 2011-2016 Washington Department of Fish and Wildlife (WDFW) — Hydraulic Project
Approval (HPA) permit. Construction work will occur between 1 July and 30 September when
precipitation is minimal. Erosion control measures will be installed during construction to
minimize soil disturbance and erosion potential.

Under RCW 77.55.181 you may qualify for a streamlined permit process with no local government fees if your project is designed
to enhance fish habitat. If your project meets the requirements below, you are entitled to the streamlined Hydraulic Project
Approval (HPA) process, exemption from the State Environmental Policy Act (SEPA), and exemption from all local government
permits and fees. To apply for the exemption process, you must provide, on the same day, a complete application package to: the
Department of Fish and Wildlife (WDFW) and all applicable local government planning and permitting departments. Local
governments have 15 days to provide comments to WDFW to aid it in deciding whether your project qualifies (see below for
details).
To QUALIFYfor the fish habitat enhancement exemption you must check at least one each from A and B and provide a
letter of approval from one of the agencies listed in B. It is highly recommended you discuss your proposal with the local
Habitat Biologist prior to submitting your application.

a If WDFW determines that your project meets the fish habitat enhancement exemption criteria, SEPA and all local government
permits and fees are waived. WDFW will process your HPA within 45 days of receiving your complete application.

Temporary bypass culvert or pumping installation will be installed before any in -stream work is performed, with
sand bags as necessary to isolate the work area. Fish within the work area will be captured and relocated.
Some existing vegetation and trees will be removed to provide access to the in -stream work area. Existing
boulder field will be relocated and the new rock weirs installed. When work is complete and accepted, the
temporary bypass will be removed. Bank vegetation will be restored with native plants as needed.
Lakota Creek culvert and channel downstream of sediment trap will be cleaned as found necessary.
Sediment accumulated in the sediment trap will be removed. Some or all of this material may be stockpiled near
the stream channel to be re -introduced into Lakota Creek as needed to minimize channel scour that has
occurred in the past and stabilized the fish habitat.

Project is routine on -going maintenance of an existing fish ladder as has been done for many years under
previous HPA authorizations. An EIS was prepared for the initial fish ladder construction which was in fact
mitigation for relocation of Lakota Creek to provide space to upgrade the Lakota WWiP to provide secondary
