A copy of your letter will be forwarded to the applicant and will be included as an exhibit in the Decision and Staff Report. All comments will be taken into consideration when issuing a decision on the project. The Decision and Staff Report will address several of the concerns brought up in the comment letter. The change of use from Motel to Emergency Shelter is an administrative review process, Process III, Project Approval, with the Director of Community Development issuing a decision after application materials have been reviewed based on criteria provided in Federal Way Revised Code (FWRC) 19.65.100, Director’s Decision. Today is the last day for public comment on the Notice of Application (NOA). There is no public hearing for Process III land use review, unless the decision is appealed. Next steps in the process; the application for the Stevenson Motel Emergency Shelter Change of Use is still under staff technical review. Once a decision on the application is made by the Director, a Decision and Staff Report will be issued by the City. A copy of the Decision will be mailed to each person who submitted written comments or information and to any person who has specifically requested it. I have you on the list to receive the Decision/Staff Report when it is issued. Per FWRC 19.65.120, a decision of the director may be appealed by the applicant, any person who submitted written comments or information, any person who has specifically requested a copy of the decision, or the city. The 2023 fee to appeal a Process III Decision is $1,328. A written notice of appeal must be delivered to the department within 14 calendar days after issuance of the decision of the director. The notice of appeal must contain: (a) A statement identifying the decision being appealed, along with a copy of the decision; (b) A statement of the alleged errors in the director’s decision, including identification of specific factual findings and conclusions of the director disputed by the person filing the appeal; and (c) The appellant’s name, address, telephone number and fax number, and any other information to facilitate communications with the appellant. Appeals are governed by FWRC 19.70 Process IV – Hearing Examiner. Thank you for your comments. Please let me know if you have any questions regarding this process.
