On February 7, 2018, the City of Federal Way's Department of Community Development received your
zoning inquiry about Devry University at the above address. The following information covers specific
questions included in the request. In the interest of clarity, the questions are listed below in bold, with the
city's response following.
The property referenced above has two zoning designations. The east side of the property is zoned Office
Park (OP-1) and the west side of the property is zoned Office Park (OP-3). The current use of this
property is a college. Pursuant to Federal Way Revised Code (FWRC) 19.235.040, schools and colleges
are a permitted use in Office Park zones.
The adjacent property designations are as follows:
North: Office Park (OP-1 and OP-2)
South: Office Park (OP-1)
West: Office Park (OP-1)
For zoning information on the adjacent property to the East, you will need a separate verification letter
from King County since it's out of the City of Federal Way's jurisdiction. It should also be noted that the
adjacent properties to the North aren't immediately adjacent as they're separated from the subject
property by State Highway 18.
The subject property is not part of a Planned Unit Development, nor is it part of an Overlay District.
The subject property is currently regulated by Council Agreement 94-210 and City Ordinance 93-190.
Both documents are attached to this letter. The subject structure was also developed in accordance to the
attached ordinance and council agreement.
Pursuant to FWRC 19.30.200, if the property is nonconforming and is damaged by sudden accidental
cause, that use or development, including associated improvements, may be reconstructed if it meets the
following requirements:
(1) The use or development, including associated improvements, as reconstructed, is not any
more nonconforming than it was immediately prior to the damage.

(2) The applicant applies for building and any land use permits to reconstruct the damaged
improvement within six months of the date of the damage and reconstructs the improvement
pursuant to such permits.
Records do not show any building or zoning code violations on the subject property. There are also no
unresolved complaints about the subject property.
