The closest public street to the tower is 10"' Avenue SW and 12"' Avenue SW. The parcel number is 192104-9003. The existing transmission lattice tower is 125.1 feet in height; no height increase is proposed. The equipment cabinets and enclosure will be located next to the tower on a newly constructed concrete slab and fenced enclosure. The Process II application was submitted and determined to be complete on January 8, 2016. The proposal is found to be consistent with the provisions of Federal Way Revised Code (FWRC) Chapter 19.60, 'Process II — Site Plan Review,' and Chapter 19.255, `Personal Wireless Service Facilities.' The Process II proposal is hereby approved based on the following statements of fact: 1. Zoning & Land Use _ The zoning designation for the subject property is Single Family Residential (RS7.2). PWSFs are pennitted in the RS zone pursuant to the zoning chart found in FWRC 19.200.190. 2. Review Process — According to submitted materials, the applicant proposes to add anew PWSF on an existing Bonneville Power Administration (BPA) transmission lattice tower within the BPA trail. The new improvements include six antennas, five equipment cabinets on new concrete pads within a fenced area. Ancillary equipment and hybrid cables are also included. No height increase is proposed. The placement of a PWSF on an existing structure in the BPA trail in an RS7.2 zone is subject to Process I1 Site Plan Review. However, by staff error the applicant was told to submit a Process I Master Land Use Application. There are minimal differences in review and given staffs error, the City collected fees associated with a Process I application, but reviewed the application pursuant to FWRC 19.60, Process 11 `Site Plan Approval.' 3. Prioritized Locations — The prioritized location analysis per FWRC 19.255.010(4) establishes `Structures located in the BPA trail' as the first priority. PWSF Development Standards— PWSFs located on existing structures shall meet development standards prescribed in FWRC 19.255.020(1). The following are staff responses to each criterion: a. (ii) The PWSF exceeds the minor facility thresholds for number of antennas and size, but creates no more adverse impacts than a minor facility. Based on site photos and detailed drawings, the proposed facility will not create substantially more adverse impacts to surrounding area and the applicant has demonstrated that the number of antennas (6) is the minimum necessary. b. There is no height increase; this section does not apply. c. This section does not apply as the proposed PWSF is not in a right-of-way. d. The proposed antennas will be painted to match existing conditions. The impacts to surrounding uses will be no greater with the new facility. e. The proposed size and number of the PWSF is necessary to meet coverage objectives as depicted in the project narrative and Radio Frequency (RF) documentation provided by applicant. f. The proposed ground equipment will be added under the existing tower, meeting all required setbacks. 5. Screening Standards — PWSFs are required to be screened using best available technology and design. The antennas will be painted to match the existing structure to blend into the surrounding area. The at -grade equipment cabinets are screened using a 6-foot-tall solid wood fence. 6. Equipment Enclosure Standards — PWSF electronic equipment shall meet development standards prescribed in FWRC 19.255.020(5) & (6). The following are staff and applicant responses to each criterion: a. The applicant proposes to place the cabinet underneath the existing BPA transmission tower outside of the right-of-way. b. The equipment enclosure is located underneath an existing structure and therefore, meets setback requirements. c. The equipment enclosure is fully screened from the public right-of-way by distance, location, topography, and solid wood fence. d. The equipment enclosure is designed, located, and screened to minimize visual and functional impact to the pedestrian environment. e. The cabinets are not located within any known sight distance triangles. The equipment enclosures will not adversely impact vehicular sight distance. f. The proposed 6-foot solid wood fence meets security fencing requirement. For safety and security reasons, it is a BPA policy that they no longer allow landscaping around the ground equipment fencing. 7. State Environmental Policy Act (SEPA) — The proposed improvements are exempt from State Environmental Policy Act review as the scope of work meets categorical exemption WAC 197-11- 800(25)(a)(i), the collocation of new equipment, removal of equipment, or replacement of existing equipment on existing or replacement structures that does not substantially change the physical dimensions of such structures. 8. Process II Criteria — The proposed improvements meet Process II purpose criteria set forth in FWRC 19.60.050; including compliance with applicable provisions of FWRC Title 19 'Zoning and Development' and health, safety, and welfare standards. 9. Additional Permit Requirements — The installation of the 6 panel antennas and cabinets within the BPA trails is exempt from obtaining a building permit per 2012 IBC section 105.2.3. This Process II approval does not constitute approval of an electrical permit. The effective date of this decision is February 8, 2016, three days from the date of this letter, per FWRC 19.05.360. Pursuant to FWRC 19.60.080, the applicant, any person who submitted written comments or information, any person who has specifically requested a copy of the decision, or the city may appeal the decision to the Federal Way Hearing Examiner by February 22, 2016. Any appeal must be in the form of. a letter delivered to the Department of Community Development with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision. No work on the proposal can commence until the end of the appeal period. In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. This Process II approval is valid for five years from the effective date of this.decision per FWRC 19.15.100. The site is named Kitts Corner and is located on BPA's tower no. 4/2 of its Tacoma — Covington nos. 3 & 4 lines, site no. SEA Kitts Corner. BPA has developed a co - location program whereby we allow wireless companies to locate antenna facilities on our structures. This is in keeping with the Telecommunications Act, which encourages agencies to make their facilities available for co -location. Because BPA's transmission facilities and structures are federal property, BPA is not required to obtain county or local permits to install or replace facilities on its system, including the PCS equipment. Nevertheless, BPA itself tries to comply with local requirements to the extent possible and consistent with its operational needs. BPA urges telecommunication providers to work with local jurisdictions to provide project information and obtain whatever permits they deem are needed. We are asking Verizon to make available to the County pertinent information regarding this installation on federal property. The information Verizon submits to BPA on the design, types, and numbers of antennas and other tower appurtenances will be used by BPA to evaluate the suitability of this PCS wireless facility for installation on this particular tower. BPA must ensure that the pending site installation does not violate our responsibilities to maintain the stability and reliability of the federal electric transmission system in the Pacific Northwest. BPA will be evaluating the structural loading on the tower based on the information provided by Verizon for this PCS wireless installation. Using this information, the EIA/TIA Standard EIA-222-G Section 14.1 Standard and Annex E, and the National Electric Safety Code, BPA's qualified engineers closely evaluate all installation parameters. When completed, the structural design and installation (both on the structure and ground radio equipment) will comply with all recognized national codes and meet all utility code and industry requirements. One issue that has continued to surface when planning these wireless co -location sites is a requirement from the local jurisdiction for landscaping to screen the ground equipment from view. While we can certainly understand the desire to minimize the visual impact caused by the additional equipment on the ground, there are several reasons, mostly safety and security driven, for which BPA has made it policy that we can no longer allow this landscaping to obstruct the view of BPA's property. WAY Network Engineering s Verizon Wireless ��" 3245 15811 Ave SE M/S 231 Bellevue, WA 98008 SEA Kitts Corner — Radio Frequency (RF) Documentation Overview: Verizon Wireless strives to provide excellent wireless service with a network of cell sites that allows our customers to reliably place and receive mobile phone calls. In this particular case, we are trying to remedy capacity and coverage challenges in this area in Federal Way. Specifically, the SEA Kitts Corner site will provide increased capacity/coverage of LTE voice and data service for the surrounding residential area, offload our existing out of capacity sites, provide seamless handoff of the users call/data session between the neighboring sites and provide reliable coverage so that the user can make a 911 call anywhere in this location without dropping calls. The proposed SEA Kitts Corner site is needed in this area to meet Verizon Wireless coverage objectives. Therefore, Verizon Wireless is placing antennas on an existing Bonneville Power Administration tower with a tip height of 44'. Verizon Wireless's proposed telecommunication facility will be located on the existing tower and consist of six (6) panel antennas, auxiliary equipment, and equipment cabinets. In -building penetration, coverage/capacity challenges, and continued growth in our customer base, and call traffic in this area has dictated the need for the proposed site. Capacity: An additional function of some wireless sites, such as the subject SEA Kitts Corner site, is to provide additional capacity in an area. The capacity of wireless networks is limited by the spectrum availability, the number of available antennas, and the radios and amplifiers associated with those antennas and spectrum. When a mobile user attempts to make a call on a wireless network where capacity is limited by these factors, the resulting delay and busy signal can be very frustrating. To remedy capacity issues, additional sites and or spectrum, which are directly correlated to the number of antennas at the site as outlined below, are added to an area to provide additional calling capacity for Verizon Wireless customers. There are some Verizon Wireless sites in the immediate vicinity that are at or near capacity. To remedy the reduced capacity, the subject site is being proposed so that calls at surrounding sites can be "off- loaded" to the proposed site and thus creating more wireless capacity for the vicinity. In order for this capacity off-loading to be successful, precise placement of the new antennas is necessary. If the site is too far away, the signal will not have adequate strength to capture calls from the impacted existing sites or cells. Similarly, sites that are too close together will not provide the needed capacity relief to the existing sites. Thus for new site/cell capacity solutions to work, site placement and height are critical factors and must be chosen carefully. Coverage: In order to provide excellent Cellular service, which Verizon Wireless defines as —85 dBm or better, the antenna height and site location need to provide a line of sight to the roads, offices, and homes where our customers work and reside. Six (6) antennas are being proposed, in order to provide the necessary radio frequencies supporting all of Verizon Wireless voice and data services. The proposed antenna height of 44' is the minimum height needed for the effective functioning of the proposed antennas. Propagation Maps: There are several methods for determining where coverage gaps exist within a given network of wireless sites. One of these is through the use of propagation maps. The propagation map is a computer simulation of the strength of Verizon Wireless signals at a given height and location in the context of the network. Propagation maps are one tool for determining whether a proposed site will meet the coverage objective and what antenna height is needed to provide robust service for Verizon Wireless customers. The radio propagation tool is designed to take factors such as terrain, tree coverage, and existing buildings into account, so that it depicts a reliable estimate of coverage that would be provided by a proposed site. The propagation maps that follow show three levels of service, designated as the following colors: Red >_ -85 dBm, a level of service adequate for providing reliable coverage inside a building and outside. Users will experience seamless calls and high speeds while using any data applications on their phones. Yellow <_ -90 dBm & >_ -105 dBm, poor coverage inside buildings, users will experience very slow speeds and dropped calls inside buildings. Blue <_ -105 dBm, very poor unreliable signal strength, may not be able to make calls and no data usage. It is also offloading the surrounding sites in this area that was struggling to provide service here. Site Location: The location of the subject site has been selected based on its relationship with surrounding Verizon Wireless sites within the City of Federal Way and surrounding areas. Antenna Diversity: Antenna diversity, also known as space diversity, is one method of enhancing wireless signal to improve the quality and reliability of a wireless link. Often, in urban environments such as the environment surrounding the subject site, there is not a clear line of sight between the antennas and customers' handsets. In these cases, the signal may be reflected along multiple paths before it finally reaches the receiver. These reflections can result in phase shifts, time delays, attenuations, and signal distortion that the customer may experience as an echo or warbling in the signal, or the signal dropping altogether. Antenna diversity is especially effective at remedying these types of issues because multiple antennas provide several "observations" of the same signal. Each antenna will experience a different interference environment resulting in an added 5-8 dB in processing gain in the RF link budget. So, for example, if one antenna is experiencing a deep fade it is likely that another antenna physically separated, but in the same sector, will have sufficient signal. Providing receive signal diversity then, is absolutely necessary for providing robust signal at the proposed location. RF Documentation — SEA Kitts Corner Page 3 of 4 Spectrum: This site will utilize our 850 MHz Cellular B Band, PCS A5 & C3 1900 MHZ frequencies, 700 MHz LTE Upper C Block, and AWS AB 2110-2130 MHz. It will basically be one wireless facilities located in a physical equipment area, with separate antenna requirements for each frequency set as outlined below. For the SEA Kitts Corner site each frequency set will represent a separate technology with technology dependent design and optimization requirements furthering the need for separate antenna systems for each frequency band. The proposed technology will be LTE on the 850, PCS (1900), AWS (2100) and 700 bands. Design: Each licensed frequency has specific propagation characteristics further influenced by hardware power limitations. The 750 MHz and 850 MHz band have better propagation characteristics than the 1900 MHz (PCS) and AWS band. The lower frequency bands received signal will be stronger at the mobile phone than the higher frequency signal if all are transmitted from the same base station with the same output power and same coding scheme. With the addition of the new LTE band and AWS licenses, and recognizing jurisdictional need to minimize the number of antennas per sector/site Verizon Wireless has made the design decision to utilize Cross pole tri band antennas for all frequencies. The Cross pole antennas can be thought of as two vertically stacked antennas in the same physical package. The aforementioned processing gain for spatial diversity in the RF link budget is reduced or eliminated depending upon the environment for all frequency sets. Wireless E- 911 Approximately 400,000 Wireless 911 calls are made every day nationwide, and this number continues to increase. (source: CTIA, the Wireless Association) Wireless E-911 service depends on reliable signal strength and a fairly dense network of antenna sites in order to function effectively. Because of our federally -mandated obligation to provide wireless E-911 service, signal reliability is paramount. This noise survey extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing ambient sound levels of the site were measured on November 6, 2014 with a Svantek 971 sound level meter. Measurements were conducted as close to the proposed location as possible. The average ambient noise level was 55 dBA primarily due to local traffic. The weather during the measurements was overcast. Code Requirements The site is located within the City of Federal Way Zoning jurisdiction on Residential zoned property. The site is within the BPA transmission line easement. The nearest receiving properties are the residential properties to the north and south of the site. The proposed new equipment includes equipment support cabinets. The equipment support cabinets are expected to run 24 hours a day. Federal Way Municipal Code Section 7.10.050 adopts by reference the maximum noise levels set forth in WAC 173-60. WAC 73-60 identifies Residential properties as Class A EDNA. Under WAC 173-60, noise from equipment on a Class A EDNA property is limited as follows: Class A EDNA Receiver: Noise is limited to 55 dBA during daytime hours. During nighttime hours, between the hours of 10 p.m. and 7 a.m., the maximum permissible sound level is decreased by 10 decibels. Verizon is licensed to operate in the United States by the Federal Communications Commission (FCC). Verizon is currently upgrading its network in the King County area to make available improved telephone service and provide wireless capacity to its subscribers. This proposal describes the scope of the proposed project by providing specific information regarding the project location, zoning, specifications, and required services. It is Verizon's desire to work with the City of Federal Way to ensure that this project is consistent with local ordinances and zoning regulations while providing wireless coverage to Verizon's customers and provide critical communication services for emergency, business, and personal use. Project Goals The goal of the Verizon SEA Kitts Corner new build is to upgrade Verizon's existing network to provide better telephone service. Verizon intends to achieve these network goals consistent with all policies and ordinances of the City of Federal Way. Application Request Plan The applicant is requesting the following: Personal Wireless Service Facility Process 1 Permit ■ Building Permit GENERAL PROJECT DESCRIPTION Project Overview The applicant, Verizon, proposes to install a telecommunication facility near SW Campus Drive (parcel number 1921049003) to provide expanded services. The proposed project scope is as follows: install one (1) equipment shelter, six (6) panel antennas, five (5) equipment cabinets, ancillary equipment, and hybrid cables. Please see Sheets Verizon Wireless SEA Kitts Corner Page 1 A-2 and A-3 in the enclosed drawings for more detailed information on the antenna and equipment installation. Facility Specifications ■ Antennas — Verizon is proposing to install six (6) existing antennas. Please see Sheet A-3 for detailed information. ■ Auxiliary Equipment — Verizon is proposing to attach the following auxiliary equipment: remote radio units and surge protectors will be placed on the existing tower. Please see pages A-3 for additional information. ■ Color — The proposed screening will be painted to match the existing building to blend with the surrounding architecture. ■ Equipment Cabinet — Five (5) equipment cabinets will be placed in a proposed fenced enclosure. See pages A-2 for additional information. ■ Facility Maintenance —The facility is generally serviced once a month. One (1) to two (2) employees are on site for an average of four (4) hours of maintenance checks. This check is typically for preventive maintenance purposes. In the event of a problem, a crew is dispatched to the site immediately. ■ Screening —The antennas and tower mounted equipment will be painted to match existing conditions. (FWRC 19.255.050[1][b]) Attached are four (4) views of the proposed facility. See the enclosed photosimulations for more details. 3. A coverage chart of the proposed PWSF at the requested height. (FWRC 19.255.050[1][d]) See the attached RF Letter for coverage chart. 4. Written explanation of the need for that facility at that height and in that location. (FWRC 19.255.050[1][d]) See the attached RF Letter for height justification. 5. Analysis of the feasibility of locating the proposed PWSF in each of the higher priority locations as identified in FWRC 19.255.010(4), and documentation of why locating the PWSF in each higher priority location and/or zone is not being proposed—FWRC 19.255.050(a)(d)—this documentation shall include analysis of the applicant's technical and network location requirements. The antenna array will be located on an existing structure in the Bonneville Power Administration trail which is the highest priority location in the FWRC. 6. An inventory of other PWSF sites operated by the applicant or other providers within a one mile radius of the proposed PWSF location, including specific information about location, height, and design of each facility. (FWRC 19.255.050[1][e]) Please find the enclosed inventory of wireless facilities and antennas within a one mile radius. If the PWSF electronic equipment cabinet is proposed to be located above ground regardless of the proposed location, whether on private or public property or within public right-of-way, an explanation of why it is Verizon T4 reless SEA Kitts Corner Page 3 impracticable to locate the cabinet underground or any higher priority location not being proposed. (FWRC 19.255.020[5][a] and 19.255.050[1][g]) The proposed equipment facility will be placed within the BPA trail which is the FWRC's highest priority location. Bonneville Power Administration will not let us dig under the tower and placing the equipment underground would cost significantly more than above ground. 8. If the PWSF electronic equipment cabinet is proposed to be located in a public right-of-way, an explanation of why it is impracticable to locate the equipment cabinet on adjacent property outside the public right-of-way. (FWRC 19.255.050[1][h]) The proposed equipment facility will be placed under the exiting tower. Placing the cabinets underground is not financially feasible and not permitted by the BPA. The cabinets cannot be placed on adjacent property because the closest property is over 55' away. 9. Documentation of efforts to collocate on existing facilities. (FWRC 19.255.050[1][i]) The closest antenna array is located about .57 miles away. While it is in the BPA trail, it is too far south to achieve coverage objectives and the current tower would need significant structural upgrades to support additional antennas. This site was chosen not only due to its location on the BPA trail, but an antenna array in this area will better cover Verizon's coverage objectives. 10. A signed statement indicating that the applicant agrees to allow for the potential collocation of additional PWSF equipment by other providers on the applicant's structure or within the same site location —if an applicant contends that future collocation is not possible on their site, they must submit a technical study documenting why (FWRC 19.255.060[2])— collocation requirements shall not apply to PWSFs located on existing structures in appropriate public right-of-way within residential zones, neighborhood business zones, and professional office zones. Upon the exercise by the Company of the option provided for in Paragraph (b) the Company's obligation to the Assured under this Guarantee for the claimed loss or damage, other than to make the payment required in that paragraph, shall terminate, including any obligation to continue the defense or prosection of any litigation for which the Company has exercised its options under Paragraph 4. 7. Determination and Extent of Liability. This Guarantee is a contract of Indemnity against actual monetary loss or damage sustained or incurred by the Assured claimant who has suffered loss or damage by reason of reliance upon the assurances set forth in this Guarantee and only to the extent herein described, and subject to the Exclusions From Coverage of This Guarantee. The liability of the Company under this Guarantee to the Assured shall not exceed the least of: (a) the amount of liability stated in Schedule A or in Part 2; (b) the amount of the unpaid principal indebtedness secured by the mortgage of an Assured mortgagee, as limited or provided under Section 6 of these Conditions and Stipulations or as reduced under Section 9 of these Conditions and Stipulations, at the time the loss or damage assured against by this Guarantee occurs, together with interest thereon; or (c) the difference between the value of the estate or interest covered hereby as stated herein and the value of the estate or interest subject to any defect, lien or encumbrance assured against by this Guarantee. S. Limitation of Liability. (b) In the event of any litigation by the Company or with the Company's consent, the Company shall have no liability for loss or damage until there has been a final determination by a court of competent jurisdiction, and disposition of all appeals therefrom, adverse to the title, as stated herein. (c) The Company shall not be liable for loss or damage to any Assured for liability voluntarily assumed by the Assured in settling any claim or suit without the prior written consent of the Company. 9. Reduction of Liability or Termination of Liability. All payments under this Guarantee, except payments made for costs, attorneys' fees and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto. 10. Payment of Loss. (a) No payment shall be made without producing this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed, in which case proof of loss or destruction shall be furnished to the satisfaction of the Company. (b) When liability and the extent of loss or damage has been definitely fixed in accordance with these Conditions and Stipulations, the loss or damage shall be payable within thirty (30) days thereafter. 11. Subrogation Upon Payment or Settlement. Whenever the Company shall have settled and paid a claim under this Guarantee, all right of subrogation shall vest in the Company unaffected by any act of the Assured claimant. The Company shall be subrogated to and be entitled to all rights and remedies which the Assured would have had against any person or property in respect to the claim had this Guarantee not been issued. If requested by the Company, the Assured shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect this right of subrogation. The Assured shall permit the Company to sue, compromise or settle in the name of the Assured and to use the name of the Assured in any transaction or litigation involving these rights or remedies. If a payment on account of a claim does not fully cover the loss of the Assured the Company shall be subrogated to all rights and remedies of the Assured after the Assured shall have recovered its principal, interest, and costs of collection. 12. Arbitration. Unless prohibited by applicable law, either the Company or the Assured may demand arbitration pursuant to the Title Insurance Arbitration Rules of the American Land Title Association. Arbitrable matters may include, but are not limited to, any controversy or claim between the Company and the Assured arising out of or relating to this Guarantee, any service of the Company in connection with its issuance or the breach of a Guarantee provision or other obligation. All arbitrable matters when the Amount of Liability is $2,000,000 or less shall be arbitrated at the option of either the Company or the Assured.
