Dear Ms. Zier:
The Department of Community and Economic Development is in receipt of your Process I Master Land
Use (MLU) application for the addition of a raft conveyor belt as a component of an existing waterslide
ride at Wild Waves amusement park located at 36201 Enchanted Parkway South. The Process I MLU
application is hereby approved pursuant to conclusions based on findings made by the department's
Planning Division.
CONCLUSIONS
The subject property is zoned OP-4. Development activity at the Wild Waves Theme Park is subject to
the development regulations contained in Exhibit C of the concomitant agreement adopted by ordinance
98-310. Therefore, pursuant to section 8.2 of the concomitant agreement and section 4 of Exhibit C, the
proposed improvements are subject to Use Process I approval. Based on the findings below, the proposed
improvements to the developed site meet the following Process I approval criteria and land use review
thresholds of Federal Wray Revised Code (FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19
including, but not limited to: Permits and Review Processes and Process I — Director's
Approval;
2. The health, safety, and welfare of the citizens of the city are preserved;
3. There is no change of use;
4. There is no reduction in the amount of required landscaping, buffering, open space, or
public areas;
5. There is no material change or reduction in the amount of required parking;
6. There is no material change in the location of utilities. easements, or pedestrian
connections;
7. There is no material change to the approved architectural design; and
8. There are no additional adverse impacts to sensitive areas or significant trees.
FINDINGS OF FACT
f _ Proposal— The applicant submitted a Process I MLU apphcauon on March 31, 2011. proposinu to
construct an addition to an existing waterslide consisting of a conveyor belt that transports inflatable
rafts from the exit pool of the Zooma Falls waterslide to the top of the ride.

2. Comprehensive Plan & Zoning Designation —The subject property is located within the Office Park
comprehensive plan designation and an Office Park (OP-4) zoned area. Water slides (known as
Regional Commercial Recreational Facilities) are permitted in the OP-4 zone, subject to UPI approval.
3. Community Design Guidelines Compliance —The proposed improvements are not subject to the city's
community design guidelines pursuant to section 8.2 of the concomitant agreement.
4_ Parking —The addition pccurs inside the existing boundaries of the park and does not add visitor
capacity. Xo additional,parking spaces are required.
5. Height — The proposed improvements are in Area 3 of the park as designated on Exhibit E of the
concomitant agreement. Pursuant to section 3.4 of the concomitant agreement, structures in Area 3
are allowed up to 125-feet in height. The proposed improvement is approximately 50-feet in height at
its tallest point.
6. Environmental Review — The proposed conveyor belt addition does not trigger State Environmental
Policy Act (SEPA) review.
BUILDING PERMIT ISSUANCE REQUIRED
The department's Building Division will review the building permit for these improvements once
submitted. No work may begin until the building permit is issued.
APPEALS
The effective date of this decision is April 4, 2011. Pursuant to FWRC 19.55.050, any person who
commented on the application or requests a copy of this administrative decision may appeal the decision
to the Federal Way Hearing Examiner by April 15, 2011. Any appeal must be in the form of a letter
delivered to the Department of Community Development Services with the established fee.
However, as you are the only party of record, you may waive your right to appeal this decision. If you
wish to waive your right to appeal, you must do so in writing to the Department of Community and
Economic Development. No work on the proposal may begin until the end of the appeal period or receipt
of your waiver.

This land use decision does not waive compliance with future City of Federal Way codes, policies, and

Wild Waves Theme Park is installing a conveyor belt system. This system will transport four person and
two person tubes from the exit pool of Zooma Falls to the top of Zooma Falls. The conveyor belt
system's main function is to reduce wear and tear on our existing tubes and improve the guest
satisfaction and efficiency of the ride.
