Dear Ms. Inigues:
The Community Development Department has received your February 16, 2016, Process I Master Land
Use (MLU) application for installation of an and permeator on a 5-foot by 5-foot concrete slab at the
existing Costco Gasoline Facility, located at 35030 Enchanted Parkway South. The Process I application
is hereby approved based on conclusions and findings below.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings below,
the proposed improvements to the developed site meet the Process I approval criteria and land use review
thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including,
but not limited to: Permits and Review Processes; Process I — Director's Approval; and FWRC
Zone Use Chart 19.240.050 Vehicle Service Station (CE).
2. The health, safety, and welfare of the citizens of the city are preserved.
3. The proposal is a minor improvement, modification, or addition to a site that is exempt from State
Environmental Policy Act (SEPA) review.
FINDINGS
The zoning for the site is Commercial Enterprise (CE). The existing fuel station facility is a permitted use
within the CE zone pursuant to FWRC 19.240.050. The proposed and permeator is considered a minor
improvement to the existing site, and therefore reviewed as an administrative land use process pursuant to
FWRC Chapter 19.55, `Process I — Director's Approval.'
The proposed arid permeator addition does not trigger, non-conformance review of the existing site
improvements under FWRC 19.30.090.
The proposed location of the and permeator is in the central interior of the site. The proposed
improvements do not exceed allowable building height, require no additional parking, do not reduce the
amount of required landscaping, buffering, or screening, and do not change pedestrian connections or
easements.

The proposed and permeator eliminates one parking stall at the site; however, based on the City of
Federal Way Process III site plan approval for the Costco Gas station (City file 00-102669 UP), finding
number 7 identifies the site currently exceeds the minimum number of parking stalls required for the
existing site and use. Therefore, elimination of one parking stall is permitted.
REVIEW BY OTHER DIVISIONS / DEPARTMENTS
+ An electrical permit is required by the City of Federal Way Building Division. No building permit is
required.
A permit for the arid permeator is required from South King Fire and Rescue. This permit process has
already been initiated.
• Lakehaven Utility District has no comment on this application/project, as based on the submittal it
appears no existing and/or future Lakehaven water/sewer facilities will be required, desired, or
affected by the proposed land use action. If any water or sewer utility conflicts are encountered,
applicant should promptly contact Lakehaven for additional information.
It is the applicant's responsibility to procure and comply with all required local, state and federal
regulations.
APPEALS
The effective date of this decision is March 4, 2016, or three days from the date of this letter. Pursuant to
FWRC 19.55.150, any person who received notice of the administrative decision may appeal this decision
to the Federal Way Hearing Examiner by March 18, 2016, (14 days after effective date). Any appeal must
be in the form of a letter delivered to the Department of Community Development with the established
fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the
alleged errors in the Director's decision, including the identification of specific findings and conclusions
made by the Director disputed by the person filing.
In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal
this decision). Waiver of the right to appeal does not affect the effective date of this decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of a building
