Dear Ms. Elliot:
The Community Development Department has completed review of the Process I Master Land Use
(MLU) application to install a 1,150 gallon vertical propane tank and dispensing unit at the above -
mentioned location. The Process I MLU application is hereby approved pursuant to conclusions based'on
findings made by the department's Planning Division.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings below,
the proposed improvements to the developed site meet the following Process I approval criteria and land
use review thresholds of Federal Way Revised Code (FWRC) 19.15.030(1) and 19.55.020:
1. The proposed improvements are consistent with applicable chapters and articles of FWRC Title
19 including, but not limited to: Permits and Review Processes; Process I — Director's Approval;
Community Design Guidelines; Outdoor Activities and Storage; Accessory Uses; and
Commercial Enterprise (CE).
2. The health, safety, and welfare of the citizens of the city are preserved.
3. The proposal is a minor improvement, modification, or addition to a site that is exempt from
SEPA review.
FINDINGS
The zoning for the site is Commercial Enterprise (CE). The existing U-Haul self -storage, vehicle rental,
and retail use is allowed in the CE zone pursuant to FWRC 19.240.050 and 19.240.070. The sales and
distribution of propane gas is considered accessory to the existing use, reviewed as outdoor activities and
storage, FWRC 19.125.170. The propane tank was reviewed as an administrative land use process
pursuant to FWRC Chapter 19.55, `Process I — Director's Approval'.
The proposed propane tank is setback 30 feet from the side property line and 23 feet from the building. A
concrete slab on grade measuring 11'-3" x7' will be laid as a base for the propane tank and dispensing
unit. The mechanical equipment will be screened by a solid screen enclosure. Additionally, landscaping
cannot be used as screening for public safety; the propane tank must be 10' away from existing
landscaping. The 1,150 gallon vertical propane tank is 18'-6" in height. The tank cannot be painted to
match the building per the Nation Fire Protection Association (NFPA) codes, which requires propane

tanks to be painted a heat reflective color, the safest color is white. The propane tank is located across
from an industrial use site and is not visually obtrusive nor detracts from the aesthetic quality of the
overall development. No additional screening is necessary.
The unit takes up three existing parking spaces; however, a sufficient amount of parking is available. The
trailers that are currently stored and taking up customer parking along the east side of the building will be
removed to allow additional customer parking. The propane tank does not create new impervious area;
does not reduce the amount of required landscaping, buffering, open space, or public areas; and does not
change pedestrian connections, utilities, or easements.
BUILDING PERMIT ISSUANCE REQUIRED
The City's Building Division is currently reviewing the associated building permit (File #'s 14-103972-
CO) for the propane tank. No work may begin until the building permit is issued. Please contact the

APPEALS
The effective date of this decision is December 26, 2014, or three days from the date of this letter.
Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal
this decision to the Federal Way Hearing Examiner by January 9, 2015. Any appeal must be in the form
of a letter delivered to the Department of Community Development with the established fee. The appeal
letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in
the Director's decision, including the identification of specific findings and conclusions made by the
Director disputed by the person filing.
In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal
this decision). Waiver of the right to appeal does not affect the effective date of this decision.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval is valid for one year from the effective
date of this decision. If no further action is taken within one year, this decision will expire. Per FWRC
19.15.110, a one-year extension may be granted if a written request is submitted to the City's Community
Development Department at least 30 days prior to the expiration of the decision.

Dear Ms. Elliot:
The City of Federal Way's Department of Community Development is reviewing your Use Process I
application for a propane tank and dispensing unit. The propane tank is accessory to the existing use and
is reviewed as outdoor activities and storage per Federal Way Revised Code (FWRC) 19.125.170,
"Commercial and industrial uses." The following planning comments must be addressed before land use
approval may be granted.
1. Per FWRC 19.125.170(3), the mechanical equipment inside the canopy must be screened from view
on the north and east sides. One of the following options must be implemented: the north and east
walls of the canopy must be extended to the ground, a solid -screen fence must be placed around the
canopy, or additional solid -screen landscaping must be provided so the equipment inside the canopy
is not visible from the right of way.
The propane tank does not need additional screening since the tank itself is not visually obtrusive.
However, it must be painted to match the existing building. The signage on the propane tank would
not be allowed as it does not meet dimensional requirements of a freestanding sign.
City staff conducted a site visit on October 1, 2014. While onsite we observed the canopy was placed
on a landscaping island on the north side of the building. The site plan depicts the propane tank and
dispensing unit on the north side of the building, taking up three customer parking stalls. Please
confirm the location of the propane tank and dispensing unit. If it is to be placed within the landscape
island, a revised site plan showing actual proposed location and verification that the parking lot
landscaping meets the required 22 sq. ft. of landscaping per parking stall is required.
In 2012, a parking analysis was submitted for the Process III land use review for U-Haul, indicating
that 46 parking spaces for self -storage facility were needed. In addition, 14 parking spaces were
required for the retail use. A total of 60 spaces were required and 60 spaces were depicted on the site
plan. The placement of the propane tank and dispensing unit eliminates three required parking spaces.
Additionally, we observed that a large number of the customer parking spaces have been occupied by
equipment, such as trailers. Please explain how adequate customer parking will be provided onsite.

referenced items and two copies of corrected full size plans with the enclosed resubmittal form. Please be
advised that changes made to the land use plans must also be shown on the building plan set as well.
PROJECT CANCELLATION
Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information to the city within 180
days of being notified that such information is requested, the application shall be deemed void and the
city shall have no duty to process, review, or issue any decisions with respect to such an -application.

Hi Becky;
Thanks for the update on the permit to date. I had a chance to speak with U Haul regarding the height concern of the
desired tank and I wanted to share their comments:
1. Vertical propane tanks are a key component of the UHaul brand and are visible, which allow customers to find
the location easily.
2. Vertical tanks have a smaller footprint and allow more customer parking on site.
3. Our national program providing 1,150 gallon vertical tanks to U Haul utilizes engineered drawings and structural
calculations for the concrete pad, anchoring of tank and hurricane, wind and earthquake protection.
Thanks for sharing this with your manager. I would be happy to show you or someone from your team the planned
location. I saw in the written code that the director can approve a different height limitation after considering the
zoning of the site and the surrounding properties. This proposed tank is across the street from a cement factory and the
street does not do through so the only traffic is only going to the cement factory or U Haul.

U Haul Federal Way would like to install a 1,150 gallon propane tank and dispensing unit at their
location 35205 Enchanted Parkway S, Federal Way, WA 98003. This tank will be used to meet the needs
of customers and residents to fill BBQ cylinders and recreational vehicle tanks. There is ample room for
RV's to enter parking lot on 352"d Street, refill their tanks and exit back onto 352"d Street.
Visual impact of propane tank is lessened due to 352"d St. not being an actual right of way as the street
does not go all the way through. The business directly across the street from proposed location of
propane tank is a cement processing business. Photos have been submitted to show the limited
visibility of tank from Enchanted Parkway.
The propane tank will be located approximately 54' from property line on 352"d St. and 217' from
property line on Enchanted Parkway. A cement slab measuring 16' x 7' will be laid to be base for
propane tank, dispensing unit and canopy. Metal canopy is being installed to protect the dispensing unit
and customers from rain. Engineered calculations have been provided in application for anchoring of all
materials.
The landscaping end cap will not be disturbed. Parking is ample and clearance is 90' to first parking
space. Clearance to building opening is 90'. Clearance to closest source of ignition is a security camera
that is located 11' up building towards roof. No empty propane cylinders will be accepted at this
location. Emergency shut off valve will be located at tank and at building.

Dear Ms. Chapin;
The responses are as follows for the referenced items in the Technical Comment Letter dated Oct 8,
2014.
1. There will no longer be a canopy included in this installation. Resubmitted engineered drawing
reflect this change. U Haul has agreed to install a solid screen fence around the mechanical
equipment after equipment has been installed and passed final fire inspection. (Existing canopy
cannot be modified to have walls extend to ground and propane tanks must be 10' from existing
landscaping).
U Haul understands the limitations on signage on the propane tank.
Regarding the tank being painted the color of the building, NFPA 58 states that propane
containers must be painted a heat reflective color. This national code refers to the safety of
propane tanks being able to reflect heat, not absorb it to avoid expansion of propane in the
tank. Safety is paramount to us all and we would ask that the tank in question be allowed to
remain the safest color known for propane tanks which is reflective white.
2. The canopy is just being stored on landscaping unit. The site for installation of propane tank
remains the same on the north side of the building. Canopy will be removed now that it will not
be part of installation.
3. All trailefs that are currently being stored in existing parking spaces will be removed. CAstomer
parking will remain adequate onsite.
