The Community Development Department is in receipt of your Process I Master Land Use (MLU)
application for a proposed building with a drive -through window for Gravity Coffee. The Process I MLU
application is hereby approved pursuant to conclusions based on findings made by the department's
Planning Division.
FINDINGS OF FACT
1. Proposal — The applicant proposes a 312 square -foot building to be constructed directly below the
existing drive -through canopy of a vacant bank at 35007 Enchanted Pkwy S, zoned Commercial
Enterprise (CE). The new building will be occupied by Gravity Coffee. A drive -through aisle will
accommodate vehicular customers. A second aisle will be provided for pass -through traffic. The site
was most recently used by The Cellular Connection for retail sales in the site's adjacent building,
which is a permitted use per FWRC 19.240.070. Past occupants of the adjacent building include
Umpqua Bank and Rainier Pacific Bank, permitted per FWRC19.240.080. The proposed use is a
drive -through coffee shop, which is classified as a fast food restaurant per FWRC 19.05.060. Fast
food restaurants are a permitted use in the CE Zoning District per FWRC 19.240.010.
Comprehensive Plan & Zoning Designation — The comprehensive plan and zoning designation for
the property is Commercial Enterprise (CE). Per FWRC 19.240.1 10, fast food restaurants are an
allowed use in the CE zoning district.
3. Height — The 12-foot 4-inch height of the proposed building meets the 40-foot maximum height limit
of FWRC 19.240.110.
4. Setbacks — The required setbacks for a fast food restaurant are 5 feet for the front yard and 5 feet side
and rear yards along non-residential zones, per FWRC 19.240.110. As proposed, no portion of the
building encroaches upon the required setbacks.
5. Parking — For The Cellular Connection, FWRC 19.240.70 required 1 parking space for each 300
square feet of floor area. Required parking for fast food restaurants is 1 parking space for each 80
square feet of floor area. The site currently provides 9 parking spaces, thereby satisfying the code's
parking requirement of 4 spaces for the 312 square -foot building.

Landscaping — The existing landscaping will remain and no additional landscaping is proposed or
'required.
7. Community Design Guidelines Compliance— Improvements are consistent with applicable sections
of Community Design Guidelines set forth in FWRC Chapter 19.115.
a. A pedestrian pathway from the parking area to the building is accessible and clearly
delineated.
b. The existing dumpster is enclosed and oriented away from the right-of-way.
c. The proposed drive -through window does not face the right-of-way.
d. A by-pass lane is provided.
e. No side of the building exceeds 60 feet in length; therefore, building modulation is not
required.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings below,
the proposed improvements to the developed site meet the following Process I approval criteria and land
use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but
not limited to: Permits and Review Processes; Process I — Director's Approval; Community Design
Guidelines; and Commercial Enterprise (CE).
2. The health, safety, and welfare of the citizens of the city are preserved.
3. The proposal is a minor improvement, modification, or addition to a site that is exempt from SEPA
review.
BUILDING PERMIT REQUIRED
Prior to building construction, you must secure a building permit fi-om the city. The building permit
application (416-103712-00-CO) submitted on August 1, 2016 is on hold because, among other issues,
the proposed building encroaches upon a natural gas easement. Additionally, a business license from the
city is required before opening the proposed business.
APPEALS
The effective date of this decision is October 10, 2016, or three days from the date of this letter. Pursuant
to FWRC 19.55.050, any person who commented on the application or requests a copy of this
administrative decision may appeal the decision to the Federal Way Hearing Examiner by October 24,
2016. Any appeal must be in the form of a letter delivered to the Community Development Department
with the established fee. The appeal letter must contain a clear reference to the matter being appealed and
a statement of the alleged errors in the Director's decision, including the identification of specific findings

and conclusions made by the Director disputed by the person filing. However, in that you are the only
party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver
of the right to appeal does not affect the effective date of this decision.
CLOSING
This decision shall not waive compliance with future City of Federal Way codes, policies, and standards
relating to this development. This Process I approval is valid for one year from the effective date of this
decision. If no further action is taken within one year, this decision will expire. Per FWRC 19.15.110, a

two-year extension may be granted if a written request is submitted to the City's Community

Land Use Issues — Stormwater
This project is exempt from Core Requirement 43; therefore, the applicant must provide a Simplified
Drainage Review in accordance with Appendix C I of the King County Surface Water Design
Manual.
2. The project lies within a Conservation flow control area, thus the applicant must design the flow
control facility to meet this performance criteria. In addition to flow control facilities, Best
Management Practices (BMP's) are required as outlined in the KCSWDM. The project also lies
within an Enhanced Basic Water Quality Area. Water Quality Treatment shall be designed to meet
the treatment criteria of the Enhanced Basic Water Quality Menu.

Land Use Issue — Existing Easement

2. If dedication of additional right-of-way is required to install street frontage improvements, the
dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must
have clear title prior to recording.
3. All stormwater treatment and detention requirements outlined above may apply to any improvements
within the public right-of-way.
4. FWRC 1 1.05.1 10 requires that overhead utility lines be relocated underground if over 500 feet, or
three spans are affected by a project.

Transportation Concurrency Analysis (FWRC 19.90)
A concurrency permit is required for this development project. The concurrency analysis will
determine if adequate roadway capacity exists during the weekday PM peak period to accommodate
the proposed development project. Please note that supplemental transportation analysis and
concurrency mitigation may be required if the proposed project creates an impact not anticipated in
the six -year Transportation Improvement Plan (TIP).
2. Based on the submitted materials for 312 square feet coffee stand building, the proposed project is
estimated to generate approximately 5 new weekday PM peak hour trips. This is based on six drive-
thru coffee stands in Portland, Oregon. The applicant's traffic engineer may submit a trip generation
study to determine the actual number of trips generated by the proposed development. At a
minimum, the trip generation study shall include three (3) studies for similar land use and settings
approved by the Traffic Division. The methodology for determining the trip generation shall be
based upon the guidelines established in the most recent edition of the ITE Trip Ge77eration
Handbook.
The estimated fee for the concurrency permit application is $822.00 (1 - 9 Trips). This fee is an
estimate and based on the materials submitted during the preapplication meeting. The concurrency
application fee must be paid in full at the time the concurrency permit application is submitted with
land use application. The fee may change based on the new weekday PM peak hour trips as
identified in the concurrency trip generation. The applicant has the option of having an independent
traffic engineer prepare the concurrency analysis consistent with City procedures; however, the fee
remains the same.

Transportation Impact Fees (TIF) (FWRC 19.91)
Based on the submitted materials for 312 square feet coffee stand building, the estimated traffic impact
fee is $10,140. Please note, the actual impact fee will be calculated based on the fee schedule in effect at
the time a building permit application is filed and must be paid prior to permit issuance.
Design Criteria (FWRC 18.55)
The drive through storage should be designed to accommodate the 95"' percentile queue lengths. At a
minimum, the drive through lane should store between 8 to 11 vehicles before impacting on -site vehicle
circulation.

2. Fire Flow at no less than 20 psi available within the water distribution system is a minimum of 2,500
GPM (approximate) for two (2) hours or more. This flow figure depicts the theoretical performance
of the water distribution system under high demand conditions. If more precise available fire flow
figures are required or desired, applicant can request Lakehaven perform a system hydraulic model
analysis (separate from, or concurrent with, an application for Availability). Current/2016 cost for a
hydraulic model analysis is $200.00. Fire flow rates greater than available in the existing distribution
system may be accommodated through water distribution system improvements. Please contact
Lakehaven for further detail.
Sewer
A Certificate of Sewer Availability (application form enclosed) issued separately by Lakehaven may be
required to be submitted with any building permit application (check with City Permit Center for
requirement). Certificate is valid for one (1) year from date of issuance. If Certificate is needed, allow i-

CLOSING
When resubmitting requested information, please provide a written response to each of the above -
referenced items and three copies of corrected full size plans with a resubmittal form (enclosed).
Building permit approval is required for this project; please be advised that amendments to the Use

PROJECT CANCELLATION
Pursuant to FWRC 19.15.050, if an applicant fails to provide additional information to the city within 180
days of being notified that such infonnation is requested, the application shall be deemed void and the
city shall have no duty to process, review, or issue any decisions with respect to such an application.

Re: Drive Thru Bldg Shell
This project consists of an enclosed 312 square foot building shell. The footprint will be constructed directly
below the existing drive-thru canopy. A general contractor has been selected and will be responsible to pick up
the necessary permit and add'I fees.
Site impacts include power, water & sewer hook-ups. The site basically remains the same, except for asphalt
cutting and patching as req'd per utility installations. Site contours, drainage to existing storm water catch
basins remain. An add'I 'Pass Thru' Aisle stripe is included to allow ample vehicular maneuvering around the
drive-thru.
Accessible curb ramps, detectible warning, striping & interior ADA compliant toilet room and toilet accessories
are included. A sidewalk is to be installed to allow accessible pedestrian access from the parking to the north
of the main building.
Building is type V-B construction wood framed walls, concrete slab on grade. Roof is existing above, but will be
weather sealed at joints. Openings include a drive-thru service window and operable sliding door on the north
and south elevations. Finish materials include: stone veneer exterior wainscot, horizontal tongue & groove
cedar siding, horizontal metal box panel on the existing drive-thru eave. Painted insulated hollow metal and
bronze anodized aluminum storefront included.
The proposed tenant is Gravity Coffee.
Responsibilities of the Tenant include:

a. Wolfe Architectural Group has designed multiple drive-thru lanes and
historically has applied 80 feet of vehicular stacking for each proposed lane
of traffic. The Gravity Coffee building will provide (2) service lanes - one on
each side of the building enclosure. Each lane is designed to provide 80 feet
of stacking within the property line boundary. Design intent is that every 20
feet of stacking will accommodate one vehicle. Therefore, Gravity Coffee will,
at minimum, allow for 8 vehicles of stacking - 4 on each side.

DRAINAGE REVIEW:
1. The proposed site improvements will neither increase nor decrease the impervious
area of the site. The existing canopy will remain in place, with its existing roof
drains. There will be a minimal amount of removal and replacement of hard surface
to facilitate utility construction. All existing catch basins will be protected from
sediment during construction.
PLAN SHEET C1.0:
1. Federal Way standard notes are found on Sheet C0.0
2. A 1' asphalt patch was added around the perimeter of the new coffee stand.
