Wild Waves Canonbowl Ride; 36201 Enchanted Parkway South
Dear Ms. Zier:
The Department of Community and Economic Development is in receipt of your Process I Master Land
Use (MLU) application for the construction of a new water slide, called Canonbowl, at Wild Waves
amusement park located at 36201 Enchanted Parkway South. The Process I MLU application is hereby
approved pursuant to condition listed below and the conclusions based on findings made by the
department's Planning Division. Please note — this approval is limited to land use review of the proposed
improvements and does not constitute -building permit approval that is required prior to construction.
CONDITION
Prior to final approval of the associated building permit (11-101542-00-CO) all parking spaces taken
out of use as a result of ride placement shall be replaced on site; pursuant to the conditions of the
concomitant agreement.
CONCLUSIONS
The subject property is zoned OP-4. Development activity at the Wild Waves Theme Park is subject to
the development regulations contained in Exhibit C of the concomitant agreement adopted by ordinance
98-310. Therefore, pursuant to section 8.2 of the concomitant agreement and section 4 of Exhibit C, the
proposed improvements are subject to Use Process I approval. Based on the findings below, the proposed
improvements to the developed site meet the following Process I approval criteria and land use review
thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but
not limited to: Permits and Review Processes; Process I— Director's Approval;
2. The health, safety, and welfare of the citizens of the city are preserved;
3. There is no change of use;
4. Tliere is no reduction in the amount, ul required landscaping. bLrlTer-ing, open space, or public areas:
5. There is no material change or reduction in the amount of required parking;

6. There is no material change in the location of utilities, easements, or pedestrian connections;
7. There is no material change to the approved architectural design; and
8. There are no additional adverse impacts to sensitive areas or significant trees.
FINDINGS 0
1. Proposal —The Japplant omitted a Process I MLU application on January 28, 2011, proposing to
construct an addition to an existing waterslide consisting of a tubular slide apparatus supported by
columns, a new inter -tube elevator, and a catching pool. The proposal was revised to shift the
improvements to north of the existing ride. The revised location requires the removal of a small
number of parking spaces, which will be replaced on -site.
2. Comprehensive Plan & Zoning Designation —The subject property is located within the Office Park
comprehensive plan designation and an Office Park (OP-4) zoned area. Water slides (known as
Regional Commercial Recreational Facilities) are permitted, subject to UPI approval in the OP-4
zone.
3. Community Design Guidelines Compliance —The proposed improvements are not subject to the city's
community design guidelines pursuant to section 8.2 of the concomitant agreement.
4. Parking— Section 4.2.2 of the concomitant agreement addresses parking for additions/improvements
to the theme park. The agreement states that if new improvements are made outside the boundaries of
the existing park, a corresponding amount of new parking shall be added to address parking impacts.
The proposed improvements are located within the existing development area and are therefore, not
subject to the need for additional parking. Replacement parking is required; however, as the proposed
location of the ride displaces a small number of existing parking stalls. This land use decision is
conditioned to require the replacement of displaced parking spaces, on site, prior to final approval of
the associated building permit.
5. Height — The proposed improvements are in Area 3 of the park as designated on Exhibit E of the
concomitant agreement. Pursuant to section 3.4 of the concomitant agreement structures in Area 3 are
allowed up to 125-feet in height. The proposed improvements are approximately 40-feet in height.
6. Environmental Review — The proposed ride is categorically exempt from an environmental threshold
determination pursuant to State Environmental Policy Act Rules 197-11-800(1). New improvements
include a pool building of approximately 450 square feet and a tubular waterslide network supported
by columns. The total building square footage of 450 square feet is less than the categorical
exemption of 12,000 square feet.
Traffic Impact Fees — Traffic impact fees, if any, will be determined prior to issuance of the building
permit.
LAND USE REVIEw FEE
An hourly Use Process I review tee of $370 ($74/hr for five hours) must be submitted prior to building
permi; issuance. See enclosed invoice.

BUILDING PERMIT ISSUANCE REQUIRED
The department's Building Division will review the building permit for these improvements once
submitted. No work may begin until the building permit is issued.
APPEALS
The effective date of this decision is May 9, 2011. Pursuant to FWRC 19.55.050, any person who
commented on the application or requests a copy of this administrative decision may appeal the decision
to the Federal Way Hearing Examiner by May 23, 2011. Any appeal must be in the form of a letter
delivered to the Department of Community and Economic Development with the established fee.
However, as you are the only party of record, you may waive your right to appeal this decision. If you
wish to waive your right to appeal, you must do so in writing to the Department of Community and
Economic Development. No work on the proposal may begin until the end of the appeal period or receipt
of your waiver.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and
standards relating to this development. This Process I approval does not constitute approval of a building

Norpoint Entertainment, LLC, DBA Wild Waves Theme Park, submitted a Land Use Permit for a New Ride
the Wild Waves Tantrum Ride. We have changed the ride and are now doing a resubmittal for the
change. The ride has been changed from the Tantrum to the Cannonbowl.
The Cannonbowl is a one or two person tube ride. The ride will be located next to the Zooma Falls
water attraction.
