Dear Mr. Ramsing:
City staff has reviewed the environmental checklist you submitted. We have determined that the proposal
will not have a probable significant adverse impact on the environment. As a result, an Environmental
Impact Statement (EIS) is not required to comply with the State Environmental Policy Act (SEPA).
A 14-day comment period is required by the SEPA rules (WAC 197-11-340). A notice inviting comments
will be published in the Federal Way Mirror on September 24, 2011. At the end of the comment period,
the department will decide whether the Determination of Nonsignificance (DNS) should be withdrawn,
modified, or issued as proposed. All final determinations may be appealed within 14 days following the
comment deadline. No licenses, permits, or approvals will be issued until completion of the appeal period.
The decision not to require an EIS does not grant the license, permit, or approval you are seeking from the
city. The environmental record is considered by the decision maker(s) and conditions will be imposed to
reduce identified environmental impacts, as long as the conditions are based on adopted and designated city
policy.
After a final decision has been made on. your proposal (i.e., after a permit has been issued), you may, but
are not required to, publish a Notice of Action as set forth in RCW 43.21 C.075. The Notice of Action sets
forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be
made. The city is not responsible for publishing the Notice of Action.

CIVIL ENGINEERING, LAND PLANNING, SURVEYING
On May 4, 2011, we met with you and your staff for a pre -application conference to discuss the
above -referenced re-establishment of an abandoned gasoline station. The branding of the proposed
re-established gasoline station has not been determined.
Since that meeting, it has been decided to proceed with the project in increments while the branding
details are worked out. We understand the need to process an application with the SEPA Checklist and
propose this action to be a tank installation or Grading Permit. We propose to perform this work in
increments so as not to delay long -lead time tasks such as processing the SEPA application for installing
the underground fuel storage tanks.
The proposed project activities are:
1. Excavate the area of the underground fuel storage tanks removed in 2005.
2. Install one (1) 20,000-gallon underground fuel storage tank and one (1) 10,000-gallon
underground fuel storage tank.
3. Install underground fuel storage tank vent stacks adjacent to the new tanks.
4. Install an overfill alarm device adjacent to the new vent stacks.
5. Install service piping from the new underground fuel storage tanks and cap for later extension
to new fuel dispensers to be installed under a separate permit.
6. Backfill excavation and rough grade.
The intent of this permit proposal is to limit all work to the immediate task of installing the new
underground fuel storage tanks. We do not intend to pave at this time, as we expect the trenching for the
service piping to the new fuel dispensers to be performed within a reasonable period of time.
