The Process II application is hereby approved based on the enclosed Findings and Conclusions for Application No. 01-100174-00-UP. The effective date of the decision is March 19, 2001. Pursuant to Federal Way City Code (FWCC) Section 22-368, this decision may be appealed in the form of a letter delivered to the Department of Community Development Services (33530 First Way South, PO Box 9718, Federal Way, WA 98063-9718) by April 2, 2001, by any person who submitted comments or receives a copy of this decision. An appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusions of the Director of Community Development Services disputed by the person filing the appeal, and must include the appeal fee of $121. Any appeal of this Process II decision will be heard by the Federal Way Hearing Examiner. Please be advised that since you are the only party of record for this application, you may waive your right to appeal. The City must receive this waiver in writing. Waiver of the right to appeal does not effect the issuance date. Therefore, if you choose to waive your right to appeal, you could begin work on the proposal on March 20, 2001, provided you have obtained the necessary building permit. Unless modified or appealed, this site plan approval is valid for one year from the effective date of this decision. If no further action is taken within one year, the decision will expire. The applicant has proposed to replace the existing fuel canopy, raise the canopy to 14'6" clear height, and replace with new 4' 0" fascia with light well. Perimeter landscaping will be installed and upgraded along Military Road South and South 288"' Street. 2. Zoning for the subject site is Neighborhood Business (BN). This zoning district permits vehicle service station uses pursuant to Federal Way City Code (FWCC) Section 22-723. The proposal is subject to Process II, Site Plan Approval, as it does not meet the land use process exemptions under FWCC Section 22-32. 3. The proposed canopy replacement and expansion is exempt from SEPA review pursuant to Washington Administrative Code (WAC) 197-11-800, "Categorical Exemptions." 4. The proposal has been reviewed for consistency with all applicable zoning regulations including FWCC Section 22-723, "Neighborhood Business, Vehicle Service Stations"; FWCC Article VI, "Site Plan Approval"; FWCC Article IV, "Nonconformance"; FWCC Article XVII, "Landscaping"; and Article XIX, "Community Design Guidelines." 5. Nonconformance: The proposal involves alterations and changes to an improvement that is nonconforming and the fair market value of the alteration exceeds 50 percent of the assessed value of that improvement. Pursuant to FWCC Section 22-334(6), in the event that this subsection is triggered with respect to a particular use at a site, the applicant shall meet all development regulations applicable to that use on the property. This will be achieved by upgrading the perimeter landscaping in the geographic portion of the site related to the fuel canopy. 6. Landscaping: The proposal includes providing Type III landscaping five feet in width in the existing perimeter landscape bed located on the corner of Military Road South and South 288`h Street. The applicant shall install a new six-foot wide landscape island with curbing and five feet of Type III landscaping to the north of the northerly entry on Military Road South. The applicant shall install a six-foot wide landscape island between the two existing entry drives along South 266`" Street. This landscape bed will be planted with five feet of Type III landscaping and curbing shall be provided around the landscape island. 7. Design Guidelines: Pursuant to FWCC Section 22-1632, all commercial applications for alterations or changes shall meet only those provisions of "Community Design Guidelines" that are determined by the Director of Community Development Services to be reasonably related and applicable to the area of expansion or remodeling. This will be achieved by using materials and design features for the new canopy that reflect the materials and design of the primary structure. 8. The Public Works Department has determined that this project does not trigger any street improvements as the cost of improvements proposed on the subject site do not exceed 25 percent of the assessed value of all existing structures on site. 9. Pursuant to FWCC Section 22-394(b), and the forgoing findings, the proposal is found to be consistent with the Federal Way Comprehensive Plan; all applicable provisions of the FWCC; and with the public health, safety, and welfare. Final construction drawings will be reviewed for compliance with specific regulations, conditions of approval, and other applicable City requirements. These findings shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. You state in your letter that this project is identical in scope to another canopy replacement that underwent a pre -application conference with the City on November 30, 2000. You requested an exemption from pre -application conference requirements because the City has already reviewed a similar development proposal in the same zoning district and it is unlikely further pre -application review will provide any benefit to the City or applicant. Pursuant to Federal Way Code (FWCC) Section 22-1653, a pre -application waiver may be granted by the Director of Community Development Services if the applicant submits a written request for a waiver from the requirements based on such a condition. In light of the above listed considerations and pursuant to FWCC Section 22-1653(2)(a) "Pre - application Conference," the City of Federal Way agrees to grant a waiver from the required pre -application process for this project. However, be advised that waiver of pre -application review increases the risk of the application being incomplete or that the processing time will be increased. The zoning for this site is Neighborhood Business (BN). Your application is deemed complete as of today's date, February 5, 2001. However, in order to continue the processing of your application, the following information is required. Landscape Requirements You have submitted a landscape plan that indicates some existing vegetation in the perimeter landscape beds located on the corner of Military Road South and South 288th Street, and along Military Road South. Pursuant to Federal Way City Code (FWCC) Section 22-334(6), if an applicant is making any alteration or change to an improvement that is nonconforming and the fair market value of the alteration exceeds 50 percent of the assessed value of that improvement, then the applicant shall comply with those development regulations applicable to geographic portion of the site occupied by that use. It has been determined that the perimeter landscaping along Military Road South and South 288th Street must be brought into compliance with current City code in conjunction with this project. Pursuant to FWCC Section 22-1566(e)(1), Type III landscaping five feet in width is required along all properties abutting public rights -of -way for this site. To achieve geographic compliance with this landscape requirement, the existing landscaping beds depicted on the submitted landscape plans must be augmented with deciduous trees and ground cover. Submit a modification request for the existing landscape bed between the two driveway entry points along Military Road South. This particular landscape area is well established with tall shrubs, and in order to plant trees or groundcover, the existing vegetation would have to be disturbed. Instructions for modification submittal requirements are enclosed. In addition to augmenting the existing perimeter landscaping, a five foot wide planting strip must be installed along the lot line facing the right-of-way between the two driveways fronting South 288th Street. Please see redlined site plans for details. This area is to be planted with a mixture of deciduous trees interspersed with large shrubs, 24" in height and ground cover planted at 18" on center in a triangular pattern, as per code requirements listed in FWCC Section 22-1565. Permanent 6" high concrete curbing shall be provided along all landscape areas. Please revise the landscape plan to reflect these requirements. The perimeter lot line to the north of the northerly entrance on Military Road South also fails to meet Federal Way City Code in terms of landscaping requirements. There is currently nothing separating the parking stalls facing the right-of-way from the sidewalk on Military Road South. Pursuant to FWCC 22-1567(e), parking areas adjacent to public right-of-way shall incorporate berms at least three feet in height within perimeter landscape areas; or alternatively, substantial shrub plantings may be added to the required perimeter landscape type. Please submit a revised landscape plan showing a five' wide planting strip of Type III landscaping on a 3' berm along the northern 70' of the perimeter lot line abutting Military Road South. The enclosed redline landscape plans detail this requirement. Parking Please be advised that the parking that is currently accommodated in the northwest corner of the site will need to be re -striped in conjunction with the installation of the required perimeter landscaping in this area. Pursuant to FWCC Section 22-1567(c) a minimum 6' landscape island is required to the south of the parking row. A Type IV landscaping consisting of trees, shrubs and ground cover is required :for parking:lot landscape islands. Please see the redlined site plan and enclosed landscape chapter for details. In amending your landscape plans please clearly reflect the property line. Your submitted plans show existing arborvitae and pine trees that would appear to be located on the adjoining property. The landscape plan should only reflect vegetation located on the subject site. Canopy Size Please refer to the enclosed comments from Lakehaven Utility District. The applicant may wish to ensure that the new canopy is large enough to meet the District's pretreatment requirements for:pump island discharge, should the pump island ever be required to connect to sanitary sewer in the future, as is the case for all new service stations . Please contact Brian Asbury at (253) 946-5407 for the specific requirements. Also, please revise sheet A-O on your site plans to reflect an accurate vicinity map. The submitted plans appear to be for the Tosco site located on 21� Avenue SW. After receipt of the requested information we will notify you within 14 days whether any additional information is needed to further process your application.
