MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:00 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Council members Ray
Tomlinson, Ron Gintz, Skip Priest, Bob Stead, Hope Elder.
City Staff present: City Manager Ken Nyberg, City Attorney Carolyn Lake, City Clerk
Maureen Swaney, Deputy City Clerk Chris Green.

CITIZEN COMMENT
Vern West - representing Homeless Relief Program, wants to continue doing business in the
Federal Way area and reported his organization already has a city business license; David
Wallis, Roger Simmons, Dee McGinnis - opposed to locating homeless shelters in neighborhoods
because operated as businesses in residential zones; Rubi Williams, Chair of Diversity
Commission, thanked the Council and staff for their support of this year's Martin Luther King
birthday celebration.

Following on explanation on the voucher list, Councilmember Tomlinson moved for approval

Following an explanation on the December financial report, Council member Priest moved for

In response to inquiries on the proposed graffiti ordinance, City Attorney Lake distributed state
statute information to Council to clarify juvenile charges, sentencing and punishments. Motion
by Council member Gintz to approve item (d) of the consent agenda; second by Councilmember
Priest. Motion to approve ORDINANCE NO. 94-208 "Prohibiting Graffiti" passed as follows:

V.
CITY MANAGER REPORT
Homeless Briefing
City Manager Nyberg introduced Community Development Services Director Greg Moore who
presented a brief background report on the homeless issue to date. Councilmember Stead said
he would like staff to obtain information on how other cities in our area address the issue, and
Councilmember Gintz would like statistics on the number of unrelated persons allowed per
residential dwelling in other areas. Deputy Mayor Watkins questioned the methodology used
in calculating the number of families turned away from shelters--are they counted more than
once if turned away from multiple shelters. Mr. Moore will investigate and respond to the
Council requests.
Council member Tomlinson said he would like to see the homeless issue referred to the Land Use
Committee for additional review. Deputy Mayor Watkins said there are actually two separate
issues on the subject, and that any code amendment would require a public hearing. Mayor
Gates suggested referral to the Public Safety/Human Services Committee, then to Land
Use/Transportation.
Motion by Councilmember Elder to refer the homeless shelter issue to the Public Safety/Human
Services Committee; second by Council member Priest. Motion passed as follows:

Mr. Nyberg reminded the Council of the necessity for an executive session and reported an
additional litigation item was added to the session's agenda.
VI.
CITY COUNCIL REPORTS
Mayor Gates reported on yesterday's Council retreat. The Council reviewed programs already
established by the city; discussed connecting with neighborhoods, businesses, churches ah.d other
public utilities to make the community a safer place to live; discussed the recent gun buy back
program being established by Police Chief Bob Evans; and discussed "Squash It", a program
offering coping mechanisms to enable people to walk away from violence.

Councilmember Stead reported on his attendance at recent growth management hearings; the next
meeting will be held on February 16.
Council member Priest briefly discussed his recent phone conversation with a South Carolina
police chief on such subjects as school truancy enforcement, curfews, gun program, graffiti and
parole hearings.
Councilmember Gintz reported the Finance/Economic Development Committee will meet with
the Public Safety/Human Services Committee on Thursday, February 3, at 7:30 a.moo
Council member Tomlinson reported the first meeting of the Parks/Recreation Committee is
scheduled for February 7, at 8:00 a.moo
Council member Elder reported the joint committee meeting on Thursday has a full and
interesting agenda.
Mayor Gates announced a public safety issues meeting is scheduled for February 7, at the new
Public Health Building.
VII.
EXECUTIVE SESSION
Potential Litigation/Pursuant to RCW 42.30. 110(i)
Mayor Gates recessed the regular meeting at 8:00 p.m., and announced a I5-minute executive
session to discuss potential litigation pursuant to RCW 42.30.110(i), with the possibility of
action being taken at the conclusion.
Mayor Gates adjourned the executive session at 8:10 p.m., and reconvened the regular meeting.
Motion by Councilmember Gintz to authorize the City Attorney to enter into the appropriate
documentation to remove any cloud of title, with respect to the Anthony quiet title litigation,
without costs to any party; second by Councilmember Priest. Motion passed as follows:
