MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:01 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Council members Ray
Tomlinson, Skip Priest, Bob Stead, Hope Elder. Excused absence: Council member Ron Gintz.
City Staff present: City Manager Ken Nyberg, City Attorney Carolyn Lake, City Clerk
Maureen Swaney, Deputy City Clerk Chris Green.

City Manager Nyberg presented this month's SPIRIT award to Management Assistant Dena
Laurent for her outstanding accomplishments and service to the city. Mayor Gates read and
presented the Jaycees proclamation to Mike and Mary McDougal and Dena Laurent, and the
youth proclamations to Youth Commission Chair Jay Proudlock.
IV.
CITIZEN COMMENT
H. David Kaplan - reminded Council of the collection of parks fees-in-lieu-of due from King
County and distributed a New York Times news article discussing shopping centers; John
Metcalf - need for homeless shelters in community and more liberal shelter zoning regulations;
Jerry Bergman - in favor of city's proposed assumption of Water/Sewer District. Mayor Gates
responded to the citizen comments.

Councilmember Tomlinson pulled items (a) and (d); Deputy Mayor Watkins pulled item (k); and
Councilmember Priest pulled item (c) from the consent agenda.
Council member Stead expressed concern about the addition of a commission appointment under
consent item (1), which was not included with packet--he requested that all future agenda items
be included at the time of distribution. He then introduced and thanked the following newly
appointed commissioners: Parks/Recreation Commissioners Bobby Roach, Dean McColgan and
Bob Kellogg; and Diversity Commissioner Ernest Londino.
Motion by Council member Tomlinson to approve consent items (b), (e), (t), (g), (h), (i), 0),
(I); second by Council member Priest. Motion to approve passed as follows:

Councilmember Priest inquired about several items presented in the financial report, for which
staff will furnish information.
Motion by Council member Priest to approve item (c); second by Council member Stead. Motion
to approve the February Financial Report passed as follows:

Councilmember Tomlinson inquired about the planned usage of open space in the proposed West
Hill development; Associate Planner Mike Thomas responded.
Motion by Council member Tomlinson to approve consent item (d), RESOLUTION NO. 94-168
"West Hill Preliminary Plat"; second by Councilmember Priest. Motion passed as follows:

Councilmember Stead introduced guest Bob Roegner, who is working as a consultant for SCA
on the ratification and bylaws project; he presented a brief informational background of the three
regional committees and clarified the process.
Deputy Mayor Watkins expressed concerns with respect to the proposed resolution ratifying
appointments to the Metro/King County Regional Committees listed under consent item (k), and
moved for amendment to the proposed resolution as follows: Delete whereas paragraph four on
page one, delete whereas paragraphs two and six on page two, and delete sections two and three
on page three; second by Council member Tomlinson.
Following discussion of identified Council concerns and an inquiry from Councilmember Priest,
Ms. Lake suggested the addition of an amendment to provide for effectiveness of the proposed
resolution to not exceed December 31, 1994. Deputy Mayor Watkins said he prefers to continue
Council action to the next regular meeting, however, Mayor Gates pointed out the need to
provide the city's authority at this time due to committee deadlines. Councilmember

Tomlinson said he is comfortable with ratifying the appointment methods and SCA bylaws for
a period not to exceed December 31, 1994, which would enable the Council to reassess the
terms of the resolution at that time.
Deputy Mayor Watkins withdrew his earlier amendment to the proposed resolution.
Council member Tomlinson moved for amendment to the proposed resolution to add the
following new section: "Approval of the city expressed herein shall be effective for a period
not to exceed December 31, 1994"; second by Councilmember Elder. The amendment passed

Council member Stead reminded Council of the next Suburban Cities Association meeting on
April 13 at 6:00 p.m..
VI.
CITY MANAGER REPORT
Mr. Nyberg asked Ms. Lake to present a status report on the parks fee-in-lieu-of; she reported
there has been substantial progress made as a result of recent meetings with King County, and
explained the county is now in the process of preparing a formal analysis.
Mr. Nyberg introduced and welcomed the city's new Traffic Engineer Saeid Daniari and new
Management Services Director Iwen Wang. He reminded the Council of the upcoming visit of
Hachinohe dignitaries. He then directed Council's attention to an AWe memorandum asking
for the city's nominations for appointments to the 1994 A WC Nominations and Resolutions
Committees. Due to the April 8 deadline, it is necessary to forward the city's nominations to
AWC immediately.

Motion by Mayor Gates to nominate Councilmember Tomlinson for appointment to the
Nominations Committee and Council member Priest for appointment to the Resolutions
Committee; second by Council member Priest. Council members Tomlinson and Elder expressed
their preference to discuss A WC membership prior to forwarding nomination recommendations.
Motion by Deputy Mayor Watkins to table the nominations until April 19; second by
Council member Tomlinson. Motion to table failed as follows:

Councilmember Tomlinson withdrew his name from prior nomination and moved for amendment
to place Council member Elder's name for the city's nomination to the Nominating Committee;
second by Councilmember Priest. Amendment to the main motion passed as follows:

Mayor Gates reconfirmed that Council member Stead will continue as an earlier appointee to
AWC's Legislative Committee.
City Manager Nyberg reminded the Council of the scheduled 15-minute executive session to
discuss potential litigation and property acquisition prior to adjournment.

CITY COUNCIL REPORTS
Councilmember Stead reported the Oversight Committee has met once, has cancelled their
second meeting, and will be rescheduling another meeting within the next few weeks. He also
reminded Councilmembers of the next SCA meeting on April 13, and updated Council on recent
GMPC progress.

Councilmember Priest reported the Land Use/Transportation Committee will meet April 11.
Council member Tomlinson reported the next meeting of the Parks/Recreation Committee is
scheduled for April 11.
Council member Elder reported the Public Safety/Human Services Committee will be meeting
on April 7, and again on April 11 to review phase I of the police report.
Mayor Gates reported the RT A Committee will be meeting on April 7.
Mayor Gates recessed the regular meeting at 9:01 p.m., and announced a 15-minute executive
session to discuss property acquisition pursuant to RCW 42.30. 110(b), and potential litigation
pursuant to RCW 42.30. 110(i), with action anticipated at the conclusion.
Mayor Gates adjourned the executive session at 9: 17 p.m., and reconvened the regular meeting.

Councilmember Priest moved that the City Council satisfy the final contingency related to the
purchase of property commonly known as School Site #20 and authorize the City Manager to
finalize purchase of the site for $405,000 using the conservation future funds; second by
