MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:03 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Council members Ray
Tomlinson, Ron Gintz, Skip Priest, Bob Stead, Hope Elder.
City Staff present: City Manager Ken Nyberg, City Attorney Carolyn Lake, City Clerk
Maureen Swaney, Deputy City Clerk Chris Green.

Cinco de Mayo Proclamation
City Manager Nyberg presented the SPIRIT award to Aurora McDonald, in appreciation of her
friendliness and willingness to assist various departments of the city.
Mayor Gates read and presented the Asian/Pacific proclamation to Sally Ramos and Art Cowan,
and the Cinco de Mayo proclamation to Maria Lopez and Art Cowan.
IV.
CITIZEN COMMENT
M.C. Scheerer - discussed the recent ethics hearing, spoke in favor of opening the Visitation
Retreat beach property to the public and addressed traffic problems in the city; Rae Morrison -
spoke in favor of the installation of a traffic island and associated revisions at the intersection
of South 300th Street and 26th Avenue South, and provided written information to Council;
Cheri Harris-Smith of the Parks/Recreation Commission and Jeanne Burbidge of the Arts
Commission briefed Council on their recent joint meeting to discuss activities at the Visitation
Retreat Center; Carrie Cubbage - addressed social service needs of the community and provided
a preschool informational brochure to Councilmembers; Harry Mills - thanked the Council for

funding special population programs, and thanked parks staff for recently assisting with a special
population's youth dance; Roger Simmons, Dee McGinnis and Glenda Seles - opposed to
homeless shelters in neighborhood areas; Bev Tweddle, Federal Way Water/Sewer
Commissioner - discussed GMA as related to ground water protection and provided written
information to Council for their review.
Mayor Gates responded to citizen comments and referred concerns to city staff where applicable.

Deputy Mayor Watkins pulled consent item (b) and Council member Gintz pulled item (d) for
additional discussion.
Motion by Council member Stead to approve items (a) and (c) of the consent agenda; second by

Deputy Mayor Watkins requested a correction to the minutes at page three, paragraph five--when
he inquired about proper advertisement for the additional property included in the proposed
annexation area, he directed the inquiry to Ms. Lake and not Mr. McCormick.
Deputy Mayor Watkins then moved for approval of the minutes, as corrected above; second by
Council member Priest. Motion to approve consent agenda item (b) passed as follows:

Council member Gintz made an inquiry into the proposed resolution for parks grant acceptance,
and then moved for approval of the resolution to provide for acceptance of parks grant funds,
with the caveat that the parks master plan be reviewed from a housekeeping point of view at the
next regular meeting; second by Council member Stead. Motion to approve consent item (d),
RESOLUTION NO. 94-173 "Acceptance of Parks Grants Funds" passed as follows:

VI.
COUNCIL BUSINESS
a.
Regional Transit Agency (RT A) Briefing
Mayor Gates introduced Southend Project Manager Barbara Gilliland and Regional Transit
Manager Martin Baker from the Regional Transit Authority. They briefed the Council on the
current status of Phase I of the regional transit system project, reviewed the three options
proposed and responded to a variety of questions by Council members. Concerns centered
around cost vs. benefit to the Federal Way community, as none of the proposed rail options
service the city. They reported RT A has been working with Metro to establish another park and
ride lot at 21st Avenue. Another concern of Council focused on the fact that Federal Way is
currently in the planning stages of a comprehensive plan to identify Federal Way as an urban
center, and they feel it could possibly create a problem if light rail isn't available within city
boundaries.
b.
Regional Commission on Airport Affairs (RCAA) Professional Services
Agreement
Mayor Gates called on citizen Peter Townsend, who previously requested that he be allowed to
address the Council on the RCAA issue; he spoke in favor of the proposed agreement.
Motion by Deputy Mayor Watkins to approve the professional services agreement with the
Regional Council on Airport Affairs; second by Council member Elder. Motion passed as

1995 Legislative Agenda
Management Assistant Dena Laurent presented a brief staff report and responded to Council
inquiries. Mayor Gates said she prefers to poll individual Council members for their preferences
and doesn't want to rush the process. Since Council member Priest is on the A WC Legislative
Committee, the city is afforded some additional response time. She asked Council members to
advise Ms. Laurent of their priorities and made a request for staff to reschedule the final
recommendations to the May 17 agenda.
d.
Employee Health Benefit Proposals
Motion by Council member Stead to adopt the City Employee Health Benefit Committee's
recommendation to remain with AWC, the city's current health carrier, at this time; second by
Council member Priest. Motion passed as follows:

VII.
CITY MANAGER REPORT
City Manager Nyberg invited Council members who are interested in serving as A WC conference
voting delegates to contact him as soon as possible--the Council will then name three delegates
at the May 17 regular meeting.
Mr. Nyberg discussed the recent memorandum from Parks Director Joe Stevens with respect to
negotiations for parks fee-in-lieu-of monies due the city from King County. The anticipated
payment is in the amount of $197,503, and will paid to the city in a lump sum.
Mr. Nyberg made a request of Council to schedule his employment evaluation and contract
extension review at the May 17 meeting. Since Council member Stead will be unable to attend
on that date, Mayor Gates asked staff to schedule the special meeting/executive session on June
7, at 6:00 p.m..
VIII.
CITY COUNCIL REPORTS
Council member Stead reported the GMPC is now working on a final decision for
recommendation to King County and Metro--there will be a 6-hour meeting on May 4 and all
day meetings scheduled for the next two Saturdays. He asked Council members to make any
recommendations known to him as soon as possible.

Council member Priest announced the Land Use Committee will meet again on May 16. The
appointment process for expiring Planning Commissioners was discussed at last night's meeting
and will come before the full Council on May 17.
Council member Elder announced the next regular meeting of the Public Safety/Human Services
Committee is scheduled for May 5 at 7:30 a.moo She reported she has been contacted by King
County Executive Gary Locke and invited to attend an all day public safety meeting on June 8.
A public safety solutions meeting is scheduled at Olympic View Elementary School on May 11.
Mayor Gates reported on the Council's mini-retreat held on April 28--agenda items included
1995 goal setting, control of contracts, financial planning, comprehensive planning,
neighborhood safety, better usage of staff and Council energy, and operation streamlining.
IX.
EXECUTIVE SESSION
Property Acquisition/Pursuant to RCW 42.30. 110(b)
Mayor Gates recessed the regular meeting at 9:30 p.m., and announced a brief executive session
to discuss property acquisition pursuant to RCW 42.30. 110(b), with action anticipated at the
conclusion.
Mayor Gates adjourned the executive session at 9:34 p.m., and reconvened the regular meeting.
Motion by Council member Priest to approve the purchase of Fisher's Bog property for the sum
of $564,375 (less than the appraised value); second by Council member Elder. Motion passed
as follows:
