MINUTES
1.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:00 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Council members Ray
Tomlinson, Ron Gintz, Skip Priest, Hope Elder. Excused absence: Councilmember Bob Stead.
City Staff present: City Manager Ken Nyberg, City Attorney Carolyn Lake, Deputy City Clerk
Chris Green.
II.
PLEDGE OF ALLEGIANCE
Council member Priest led the flag salute.
III.
PROCLAMATION
Mayor Gates read and presented the American Public Works Association "Public Works Week"
proclamation to Public Works Director Philip Keightley.
IV.
CITIZEN COMMENT
David Kaplan - expressed his appreciation for the Council's assistance in obtaining the parks fee-
in-lieu-of funds from King County; Mary Ehlis - thanked the Council for their past support of
Family Fest and requested authorization to place banners across major city thoroughfares for
advertisement of this year's festival; Glenda Seles - supports adoption of ordinance restricting
aggressive panhandling within the city; Al McVay - discussed the need for community spirit and
fundraising and available grants for city properties; Bob Bush - read and presented a citizen
petition in opposition to certain road improvements to Military Road located south of Star Lake
Road, across from the proposed Heritage Woods development; David Morrison, representing
Parklane Ventures - as the developer of Heritage Woods, said he is currently working with
surrounding area residents to address the impact of the proposed development.
Mayor Gates responded to the citizen comments. She referred Ms. Ehlis to the
Finance/Economic Development Committee for discussion of banner possibilities, and advised
Mr. Bush that city staff is currently working with the Heritage Woods developer.

Deputy Mayor Watkins asked Ms. Lake about negotiations for the parks fee-in-lieu of funds
being received from King County; she referred to her memorandum dated May 3, 1994, which
explains a modification of the proposed interlocal via a footnote on page 9.
Motion by Deputy Mayor Watkins to approve consent item (e); second by Councilmember
Elder. Motion to authorize approval of the agreement between the City and King County
relating to transfer of parks development and fee-in-lieu of funds passed as follows:

An aid from King County Councilmember Pete von Reichbauer's office announced Mr. von
Reichbauer had a previous engagement tonight, but would like to formally present the county's
check to the City of Federal Way tomorrow at 11:45 a.m., in Council Chambers.

Following discussion on the proposed resolution, Councilmember Gintz moved for approval of
consent item (h); second by Council member Priest. Motion to approve RESOLUTION NO.

VI.
INTRODUCTION ORDINANCE
Council Bill #88/1994 Budget Adjustment
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, RELATING TO BUDGETS AND FINANCE,
REVISING THE 1994 BUDGET (AMENDS ORDINANCE 93-194).
Mayor Gates presented the introduction reading of Council Bill #88/1994 Budget Adjustment
Ordinance.
Management Services Director Iwen Wang provided information and responded to inquiries of
Council members; one area of discussion included the cost of jail services.
VII.
COUNCIL BUSINESS
a.
1995 Legislative Agenda
Management Assistant Dena Laurent presented the 1994 legislative session review memo and
preliminary suggestions for the 1995 A WC legislative agenda. Mayor Gates said she would like
all Council members to give some guidance for the city's priorities, so Councilmember Priest can
take the city's recommendations back to A WC's Legislative Committee, of which he is a
member.
Motion by Council member Gintz to take the position that the City Council does not want A WC
to take positions on initiatives; second by Deputy Mayor Watkins.
Mayor Gates said she is not in favor of sending such a statement to A WC at this time--she
prefers to hear both sides of the issue and then make a final decision at the June 7 meeting.

Following discussion, Council member Gintz moved acceptance of Mayor Gates' proposed
amendment to postpone any Council decision until June 7, for purposes of obtaining additional
information; second by Mayor Gates. Amendment to the main motion failed as follows:

Council member Priest said he would like legislative priorities placed on the June 7 agenda for
the Council's recommendations, so he can take those issues to A WC at its June 8 meeting.
b.
A WC Voting Delegates
Mayor Gates announced Bob Stead, Hope Elder, Ken Nyberg and Dena Laurent plan to attend
AWC's annual conference.
Motion by Council member Gintz to appoint Bob Stead, Hope Elder and Dena Laurent as
delegates, and naming Ken Nyberg as an alternate, freeing up the City Manager to visit with
attendees, instead of requiring his attendance at all meetings during the conference; second by
Councilmember Tomlinson.
Council member Elder said she feels Mr. Nyberg should be named as one of the three delegates.
Councilmember Priest said he appreciates the position of Councilmember Gintz, but prefers to
name Ms. Laurent as the alternate. Council member Gintz accepted the suggestions of Council-
members Elder and Priest as a friendly amendment; Council member Tomlinson concurred.
Motion to appoint Council members Stead and Elder and City Manager Nyberg as voting
delegates, with Management Assistant Dena Laurent named as an alternate, passed as follows:

City Council Committees
Mayor Gates announced a change in Council Committee structure and referred to her recent
memorandum dated May 16, 1994, establishing the following committees and membership:

Mayor Gates said it is also necessary to amend the current Council Rules to reflect the changes,
at which time she moved for amendment of the current Council Rules of Procedure, Section
21.1, to delete the reference to the Oversight Committee, and amend Section 21.8 to read the
Mayor shall serve as an "ex officio" member of each committee, and the Deputy Mayor may
serve as "ex officio" orbe appointed to a committee; second by Councilmember Elder. Motion

The amendment to the existing Council Rules and Procedure Resolution will be scheduled for
approval at the June 7, 1995, regular meeting.

Planning Commission Vacancies
Following Council discussion on various ways of filling three upcoming vacancies on the
Planning Commission, Councilmember Gintz moved to open the process to all eligible Federal
Way citizens; second by Council member Tomlinson. Motion passed as follows:

VIII.
CITY MANAGER REPORT
As a housekeeping item, Mr. Nyberg reported the Council hasn't approved a formal or informal
design plan for Steel Lake Park, however, the design plan is currently being serviced under
SEP A review as outlined for capital projects. Parks Maintenance/Operations Superintendent
Jenny Schroder responded to Council questions and explained this plan was presented for lAC
funding considerations for Steel Lake Park Phase I redevelopment.
Motion by Council member Gintz to approve Phase I of the Master Plan of Steel Lake Park;

He reported the new postal service facility landscape plan has been submitted and is currently
being reviewed by the city. Mr. Nyberg reminded everyone the security alarm at city hall has
been activated tonight--the janitor will set the alarm at 11:00 p.m., following each Council
meeting. There is an upcoming vacancy on the Ethics Board, so that position will be advertised
at the same time as the Planning Commission's. He expressed the city's appreciation to King
County Executive Gary Locke and Councilmember Pete von Reichbauer for their assistance in
obtaining the parks fee-in-lieu of funds.

IX.
CITY COUNCIL REPORTS
Discussion centered around the city's representation at regional levels, e.g., Regional Transit
Authority (RTA), with concerns being identified. Mayor Gates said she will discuss those
concerns with Council member Stead. She said she recognizes the need for more regional
briefings to Council during regular meetings.
There was also discussion about the Photo Radar program. Councilmember Elder reported the
item is scheduled for discussion at the June 2 meeting of the Public Safety/Human Services
Committee. She also reported the final PT A Youth Violence Program will be held at Twin
Lakes Elementary School on May 25.
Deputy Mayor Watkins reported he will be a speaker tomorrow evening at the Thomas Jefferson
High School Honor Society program.
Council member Gintz reported the Economic Development Board will meet tomorrow morning
at 7:30, and the Finance/Economic Development Committee will meet on May 26 at 7:30 a.moo
Council member Priest announced the Land Use/Transportation Committee will meet June 6.
Mayor Gates reported the Oversight Committee is scheduled to meet on May 31. She also
reported recent regional rumors include the City of Federal Way with the first phase of the
proposed light rail project.
