MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:05 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Council members Ray
Tomlinson, Ron Gintz, Skip Priest, Hope Elder. (Clerk's note: one position open at this time)
City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk
Maureen Swaney, Deputy City Clerk Chris Green. .
II.
PLEDGE OF ALLEGIANCE
Council member Priest led the flag salute.
III.
PRESENT A TIONS
City Manager Nyberg announced this month's SPIRIT award honors GIS staff Nami Mally and
Curt Ryser for their outstanding work on GIS projects and their willingness to assist other city
departments. Curt thanked Council and staff for the honor. Nami was unable to attend as she
is currently visiting with her family in India.
Mayor Gates read and presented the Martin Luther King, Jr. Day Celebration proclamation to
Beverly Kim and Diane Turner, members of the MLK Organizing Committee; she also invited
Diversity Commissioners to speak to the celebration. Ms. Turner thanked Mayor Gates for the
proclamation, and extended an invitation to all to attend the upcoming celebration on January
16, at Decatur High School.
IV.
CITIZEN COMMENT
Nancy Kragh, former Human Services Commission applicant - she recently declined an
invitation to reapply for a commission vacancy, as she feels there is a problem with the grant
process; Cynthia Sporleder, President of Saghalie Safety Committee - supports photo radar;
Mary Ellen Stone, King County Sexual Assault Center - concerned about the Human Services
grant process and reduction in the center's 1995 allocation; Kevin Beck, Puget Power
representative - advised their local office has temporarily been relocated to Auburn and are
currently looking for permanent office space in Federal Way;

Jerry Fitts - opposes photo radar; John Metcalf - feels Council should change their mind about
instituting photo radar since project is unpopular with citizens; George Paulose - spoke about
his recent trip to Hachinohe and the possibility of establishing future trade routes and business
opportunities between the Puget Sound area and Japan. Mayor Gates responded to the citizen
comments.

Mary McCumber and Jerry Dinndorf of the Puget Sound Regional Council presented a video
on Vision 2020 and briefed Councilmembers on the draft Metropolitan Transportation Plan. The
key focus is currently on the final adoption of the three county transit plan, with open houses
scheduled for the next couple of weeks, a general assembly workshop on March 16, and action
by the General Assembly on April 27. Ms. McCumber thanked the City Council for the
opportunity to present the video update, and thanked Federal Way staff for their continued
technical assistance. Mr. Dinndorf also presented a brief update on the Regional Council's
environmental studies regarding airport noise.
Assistant City Manager Keightley presented information on SSB5038. It mandates local
governments to convene in order to analyze areawide service needs. Cities and counties must
enter into joint agreements for regional services and establishment of responsibilities. Deputy
Mayor Watkins indicated he prefers the city to be self-representing and not controlled by SCA;
Councilmember Gintz concurred, as he feels SCA should control regional issues only, thus
enabling Federal Way to control its own local issues. Council member Tomlinson suggested one
of the Council Committees review the mandates of the bill. Mayor Gates feels the full Council
should review all issues, possibly at the next regular meeting.
On the added item of conducting a public opinion survey on photo radar, Councilmember
Tomlinson expressed concerns about citizen reaction to the proposed project.
Motion by Councilmember Tomlinson to authorize the City Manager to have staff conduct a
public opinion telephone poll with a sampling of residents, monitor the results and report back
to Council; and, further, not to execute the photo radar professional services agreement until the
survey has been analyzed; second by Councilmember Elder.
Deputy Mayor Watkins moved for substitution of the main motion, which would authorize the
City Manager to abandon negotiations for the professional services agreement at this time, and
postpone the public survey until a time when Council decides to proceed with the photo radar
project; second by Councilmember Priest.
Deputy Mayor Watkins said he feels there are too many other important issues before the
Council at this time, e.g., land use and growth management. Council member Priest said he
appreciates Councilmember Tomlinson's contribution and feels he shouldn't have been personally
attacked for his dedication to the proposed project. Council member Elder also spoke in support
of photo radar by saying she doesn't want a limited number of citizens controlling a project.
It was noted that a majority of citizen concerns came from those opposing the operation of photo
radar on the city's major roadways.Councilmember Tomlinson advised his main focus for
photo radar operation was in neighborhood areas. City Attorney Londi Lindell said the vendor
would have to agree to operate at a loss, if locations were limited to lower volume areas such
as neighborhoods and school zones. Mayor Gates said she is not in favor of pursuing a' public
opinion survey because of the cost involved.

VII.
CITY MANAGER REPORT
Mr. Nyberg reported Public Works Director Cary Roe's health condition has improved and he
should be returning to work shortly.
Assistant City Manager Keightley briefed Council on the recent rains and said he was pleased
to announce the city had suffered no significant flooding problems, largely due to the excellent
work and foresight of the street and surface water crews.
City Manager Nyberg reminded Council of the upcoming special session on Monday, January
9, for purposes of interviewing and appointing a new Council member. It was decided to divide
the 26 applicants into two groups for the purpose of conducting the initial interviews for fifteen
minutes per person. Council will then go into an executive session and return to special session
to allow full Council to interview each finalist for thirty minutes. Councilmember Priest
suggested the City Attorney or City Clerk conduct a lot draw of all applicants in advance of the
interviews to enable notification to applicants of a specific time. The two Council panels will
be drawn by the City Clerk on January 9, at 3:00 p.m., just prior to commencement of the
interviews.
VIII.
CITY COUNCIL REPORTS
Councilmember Tomlinson announced the Land Use Process III public hearing regarding the
Visitation Retreat Center will be held Wednesday, January 10, at 7:00 p.m.; no SEPA appeals
were filed within the required appeal. period.

Councilmember Elder reported the Public Safety/Human Services Committee Will meet this
Thursday at 7:30 a.m., and expressed the committee's appreciation to the Human Services
providers.
Deputy Mayor Watkins has recently been appointed as the District Director of Congressional
Representative Randy Tate's local office. .
Councilmember Priest reported the next meeting of the Land Use/Transportation Committee will
be held January 30. Councilmember Gintz requested the committee review citizen requests to
install signal lights near Saghalie Jr High School at 21st and 336th Streets.
Mayor Gates advised Councilmembers they need to select replacement members for several SCA
positions, to fill the vacancies created by Councilmember Stead's resignation.-She has already
discussed and received appointment approval from Council members Tomlinson, Gintz and
Priest.

Mayor Gates reminded Council members they will be scheduling a retreat in the near future. She
would like to poll Councilmembers next week for their opinions as to what they hope to gain
from the retreat and what dates are preferred.
City Manager Nyberg mentioned that a special recognition celebration honoring all city
commissioners and board members is being planned for January 31.
Mayor Gates reminded all Councilmembers of the Council candidate interviews on Monday, at
3:00 p.m., and that she needs two questions to be used during the process from each of them
by this Friday.

ADJOURNMENT
There being no further business to come before the Council, Mayor Gates adjourned the regular
meeting of the Federal Way City Counci at the hour of 9:25 .m..
