The applicant proposes to subdivide one commercial lot into two commercial lots. The site is located at 35500 Enchanted Parkway South (King County tax parcel 282104-9106). The department received your application on October 25, 2012, and deemed the application complete on November 9, 2012. The City of Federal Way hereby grants preliminary approval of the Taco Time BSP. This approval corresponds to the BSP drawing, date -stamped as resubmitted December 28, 2012. Pursuant to Federal Way Revised Code (FWRC), Binding Site Plan applications shall be processed in accordance with the provisions of short subdivisions; therefore, this Decision of the Director is based on the enclosed Statement of Facts and Conclusions and in accordance with decision criteria set forth in FWRC 18.30.110(2). CONDITION OF APPROVAL Frontage improvements along Enchanted Parkway South and access to Lot 2 shall be constructed per approved plans prior to recording the Binding Site Plan document. RECORDATION After meeting the condition of approval, please submit the following four items to the permit center with the enclosed resubmittal form: (1) one set of signed and notarized mylars; (2) two sets of paper copies of the signed/notarized mylars; (3) current King County recording fee payable to City of Federal Way (verify with project planner Matthew Herrera); and (4) one copy of this decision. The department will record the mylars and route the conformed copy to the applicant. APPEAL PROCESS Pursuant to FWRC 18.30.140, any person who receives a copy of this decision may appeal the decision within 14 days of the date of issuance. The decision may be appealed in the form of a letter delivered to the Community and Economic Development Department by 5:00 p.m., February 26, 2012. An appeal letter must contain a clear reference to the matter being appealed, along with a copy of the decision. A statement of the alleged errors in the decision and required appeal fee must be included. Mr. kimdrt February 12, 2013 Page 2 SEPA THRESHOLD DETERMINATION Pursuant to the State Environmental Policy Act (RCW Chapter 43.21C), the proposal is exempt from SEPA review. DURATION OF APPROVAL Binding Site Plan preliminary approval shall expire five years from the date of issuance of this decision. However, the applicant may submit a written request in the form of a letter with supporting documentation to the Community and Economic Development Department requesting an extension pursuant to FWRC 18.05.090. OTHER AGENCY PERMITS The applicant is responsible for identifying and obtaining all required state, federal, or other agency permits, as may be required. REQUESTS FOR CHANGE OF VALUATION Any affected property owners may request a change in valuation for property tax purposes, not withstanding any program of revaluation. CLOSING This decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. These findings are based on review of existing city documents and BSP sheets 1-3 submitted by the applicant stamped by the Permit Center December 28, 2012: 1. Proposal — The applicant proposes to subdivide one commercial lot into two commercial lots. The BSP will result in two lots measuring 54,531 square feet (Lot 1) and 55,444 square feet (Lot 2) as shown on Page 3 of the BSP document. 2. Review Process — Pursuant to Federal Way Revised Code (FWRC) Chapter 18.20, `Binding Site Plans', the proposed BSP is subject to administrative review and a decision by the Director of Community and Economic Development. The proposal has been reviewed by the Development Review Committee, which includes staff from the City's Planning and Building Divisions, Public Works Department, Lakehaven Utility District, and South King Fire and Rescue. 3. Comprehensive Plan & Zoning — The subject property is located within a Commercial Enterprise (CE) zone. The proposed land use for proposed Lot 1 is fast-food restaurant, a permitted use in CE zones with no minimum lot size prescribed in FWRC 19.240.110. No proposed land use has been identified at the date of this BSP decision for Lot 2. Future uses and regulations for Lot 2 will be limited to those identified in FWRC Chapter 19.240 `Commercial Enterprise' and any future amendments thereto. 4. State Environmental Policy Act (SEPA) —The proposed BSP is exempt from SEPA pursuant to Washington Administrative Code (WAC) 197-11-800(6)(a). 5. Ingress/Egress — Access to Lots 1 and 2 will be via a 50-foot-wide utility and access easement. Full access to Enchanted Parkway South from the access easement will be permitted per a Conditional Right -of -Way Modification granted by the Deputy Public Works Director December 14, 2012. 6. Stormwater — The applicant has designed a stormwater facility to mitigate the effects of runoff from the proposed fast-food restaurant development of Lot 1. Future proposals for Lot 2 will be required to design a stormwater facility that meets current city standards. 7. Street Frontage Improvements — The applicant is required to construct frontage improvements along Enchanted Parkway South associated with the Lot 1 Taco Time proposal. Frontage and easement construction must be completed prior to the city recording the BSP document. 8. Transportation — The applicant has been issued a Capacity Reserve Certificate for the Lot 1 Taco Time proposal. A future proposal for Lot 2 will be subject to concurrency requirements. Developments on Lots 1 and 2 will be subject to the city's Transportation Impact Fee payable at the time of building permit issuance. 9. Engineering — The applicant will be required to obtain engineering approval from the Public Works Department for development of Lots 1 and 2. 10.
