Applicant: Enrico Galliano, 1837 Camas Avenue NE, Renton, WA 980.56 Location: 29020 Military Road South, Federal Way, WA Lead Agency: City of Federal Way Department of Community Development Services Staff Contact: David Lee, Associate Planner, 253-835-2622 The lead agency for this proposal has determined that it does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist, Federal Way Comprehensive Plan, final staff evaluation for this action, and other municipal policies, plans, rules, and regulations designated as a basis for exercise of substantive authority under the Washington State Environmental Policy Act Rules pursuant to RCW 43.31C.060. This information is available to the public on request. This DNS is issued under WAC 197-11-340(2). The lead agency will not act on this proposal for 14 days from the date below. Comments must be submitted by December 23, 2009. You may appeal this determination to Greg Fewins, Director of Community Development Services, at the City of Federal Way (33325 8"' Avenue South, PO Box 9718, Federal Way, WA 98063-9718) no later than 5:00 p.m. on January 6, 2010. The appeal must be in the form of a written letter stating the reason for the appeal of the determination. The appeal letter must make specific factual objections. Published in the Federal Way Mirror on December 9, 2009. Doc. 1.D. 52230 FILE CITY OF Federal Way December 8, 2009 Enrico Galliano 1837 Camas Avenue NE Renton, WA 98056-2702 RE: File #09-102980-00-SE; STEEL LAKE PLAZA 29020 Military Road South, Federal Way Dear Mr. Galliano: CITY HALL 33325 8th Avenue South Mailing Address: PO Box 9718 Federal Way, WA 98063-9718 (253) 835-7000 www.cityoffederalway.com This office and other City staff have reviewed the environmental checklist you submitted. We have determined that the proposal will not have a probable significant adverse impact on the environment. As a result, an environmental impact statement (EIS) is not required to comply with the State Environmental Policy Act (SEPA). A 14-day comment period is required by the SEPA rules (WAC 197-11-340). A notice inviting comments will be published in the Federal Way Mirror on December 9, 2009. At the end of the comment period, the department will determine if the DNS should be withdrawn, modified, or issued as proposed. All final determinations may be appealed within 14 days following the comment deadline. No licenses, permits, or approvals will be issued until completion of the appeal period. Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from the City has been granted. Approval or denial of the proposal will be made by the appropriate administrative or legislative body vested with that authority. The environmental record is considered by the decision maker(s) and conditions will be imposed to reduce identified environmental impacts, as long as the conditions are based on adopted and designated City policy. After a final decision has been made on your proposal (i.e., after approval has been issued or City Council action taken, as applicable), you may, but are not required to, publish a Notice of Action as set forth in RCW 43.21 C.075. The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be made. A copy of the Notice of Action form and copies of RCW 43.21 C.080 and WAC 197-11-680 providing instructions for giving this notice are available from the Department of Community Development Services. The City is not responsible for publishing the Notice of Action. However, the City is responsible for giving a notice (to parties of record to which there are none) stating the date for commencing a judicial appeal (including the SEPA portion of that appeal) if your proposal is one for which the City's action on it has a specified time period within which any'court appeals must be made. If you need further assistance, feel free to call David Lee, Associate Planner, at 253-835-2622. Sincerely. Greg Fewins, Director Community Development Services enc: DNS Staff Evaluation Doe. Model results depict the theoretical performance of the water system under high demand conditions and are not guaranteed to represent actual system perfornance. A design professional should be consulted for site specific design purposes. The calculated fire flow capacity in the above table is based on a currently available residual system pressure of 20 psi at the location modeled. The model indicates that Lakehaven's standard maximum allowable velocity of 10 ft/s is exceeded at a fire flow rate above 5300 gpm. Fire flow capacities greater than 5300 gpm may be accommodated through water system improvements.
