Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from the City has been granted. Approval or denial of the proposal will be made by the appropriate administrative or legislative body vested with that authority. The environmental record is considered by the decision maker(s) and conditions will be imposed to reduce identified environmental impacts, as long as the conditions are based on adopted and designated City policy. After a final decision has been made on your proposal (i.e., after approval has been issued or City Council action taken, as applicable), you may, but are not required to, publish a Notice of Action as set forth in RCW 43.21C.075. The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be made. A copy of the Notice of Action form and copies of RCW 43.21 C.080 and WAC 197-11- 680 providing instructions for giving this notice are available from the Department of Community Development Services. The following technical comments must be addressed prior to any further action on this application. ADDITIONAL INFORMATION REQUESTED Planning, David Lee (253-835-2622, david.lee(gcityoffederalway.com) L Item #1 on the response/resubmittal letter (submitted on May 13, 2009) indicates that building elevations have been included in the resubmittal letter. Building elevations were not submitted with this resubmittal. The Resubmittal Information coversheet submitted indicates "5 Mitigation Plans showing requested buffer setback" and "3 Amended Technical Information Reports (11R)" were submitted at that time. Please resubmit building elevations. 2. There is no record of payment of the $2,108 for the initial peer review (completed by ESA Adolfson) of the wetland study done by Genesis Resource Consulting to the city by either agent or owner of this project. If the applicant believes this amount has been paid, please submit a copy of the receipt issued by the. City of Federal Way. The receipt should indicate an "Environmental Pass Through" payment (receipt item #8045). Otherwise, the outstanding balance of $2,109 owed to the city for the initial peer review is still due. Another copy of the invoice has been enclosed with this letter. Additionally, I have included a copy of an invoice chronicling all payments made to the city by either Nishimura & Associates or Midway Samoan Assembly of God. 3. Please submit an updated and amended wetland report by Genesis Resource Consulting regarding the proposed wetland buffer intrusion and enhancement. Additionally, the report should address any impacts of surface water being drained into the stream, stream buffer, and wetland buffer. Any changes made to the site plan should be documented in the wetland report. 4. Upon further review, it has been indicated by Lakehaven Utility District that it is possible to connect the sewer line to the line located along the western margin of Military Road South. The connection at this location would avoid further impacts to the wetland and wetland/streambuffer. Please contact Brian Asbury at Lakehaven Utility at 253-941-1516 for installation/connection information. Per Federal Way City Code (FWCC) Section 22-1358(d), the specific location and extent of the intrusion must constitute the minimum necessary encroachment. Since there is an available alternative location for sewer service that does not intrude into the wetland, stream, and their associated buffers, the connection at that location must be utilized. - Mr.Nishimura aJune 9; 2009 Page 2 5. The proposed installation of the deep rock outfall pad and a small portion of the storm drain piping appears to be offsite. Additionally, the storm drain piping/deep rock outfall pad appears to be within the stream Based upon the TIR, it does not appear that this is the sole option for drainage. Please amend the site plan to remove the storm drain piping and deep rock outfall pad from the stream 6. Please update your SEPA checklist in regards to the project scope, the wetland categorization, intrusion into the wetland buffer, intrusion into the stream buffer, and mitigation measures. 7. As a reminder, per the review letter sent on May 11, 2007, written by Andy Bergsagel, a BLA for the elimination of the interior lot line must be completed and recorded prior to the issuance of a Certificate of Occupancy of the building. Existing onsite sewerage system is presumed. 2. There is an existing 15" diameter sanitary sewer trunk that runs along the property's easterly boundary that was constructed in the mid-1960s. There IS NOT an existing sewer service stub for the subject property on the existing trunk. Depth of trunk on property is approximately 8 feet. Lakehaven would allow connection to this trunk to serve the property. See enclosed map for additional info/detail. 3. There is an existing 8" diameter sanitary sewer main that runs in/along the westerly side of Military Road South in front of the property. Depth of main in ROW is approximately 9-10 feet. There IS NOT an existing sewer service stub for the subject property on the existing main. Lakehaven would allow connection to this main to serve the property. See enclosed map for additional info/detail. 4. Presuming Lakehaven's information is correct and the existing 8" sewer main is under asphalt pavement in Military Road South as indicated on the enclosed map; to avoid asphalt pavement cut/excavation connection could be made directly into the manhole that fronts the subject property via directional- drill/bore type construction. Owner/applicant may want to consider use of a private grinder pump station and a low-pressure sewer service line, to reduce ROW construction and/or restoration costs.
