Dear Mr. Hagenson:
This letter responds to your request dated January 8, 2007, to waive required street
improvements along Military Road South associated with your proposed development.
After evaluating the existing and proposed conditions, review of Federal Way City Code (FWCC)
provisions (Sections 22-1474, 22-1477, 22-1496), and direction provided by the City Council,
the Public Works Department hereby modifies the requirements for street improvements based
on the following:
FWCC Section 22-1477 — Modifications, deferments and waivers: This code
section allows the Public Works Department to grant a request to modify, defer,
or waive the required street improvements only after consideration of four
specific reasons. The reason most applicable here is contained in FWCC 22-
1477(3) "Proper vertical or horizontal alignments cannot be determined because
the existing streets do not have correct alignments," and (4), "The required
improvement is part of a larger project that has been scheduled for construction
in the City's adopted Six -Year Transportation Improvement Program."
Military Road South is classified as an arterial street corresponding to Federal Way Roadway
Section "K". This roadway section requires a 44-foot wide paved street with vertical curbs, six-
foot planter strip, eight -foot sidewalk, three-foot utility strip, street lighting, and street trees all
within a 78-foot right-of-way.
This road section is also listed in the City's adopted Capital Improvement Plan for 2009-2020
(adopted in the Comprehensive Plan, Table III-19) with a project description requiring five
lanes. This project will require a minimum of 100 feet of right-of-way to meet the necessary
needs of the proposed improvements.
The existing right-of-way width on Military Road South across the frontage of the property is 60
feet. This width is inadequate based on the planned road sections listed above. Therefore,
based on FWCC 22-1474(c), the City will require the following right-of-way dedication and land
set aside:

Dedicate a nine -foot wide portion of the subject property parallel to the right-of-way
and extending across the entire property frontage for right-of-way purposes.
Set aside an 11-foot wide portion of the subject property parallel to the right-of-way
portion described above, extending across the entire property frontage. This area
shall be set aside as a "Tract X", which is reserved for future right-of-way. The City
will provide a Tract X agreement for signature approvals prior to the issuance of a
building permit.
After evaluating the existing conditions along Military Road South, review of Federal Way City
Code provisions (Sections 22-1496, 22-1477), and the direction provided by the City Council,
the Public Works Department hereby modifies the requirements for street improvements
applicable to your permit application, as follows:
No physical improvements to Military Road South are required. The applicant shall
sign a No Protest to Local Improvement District Agreement prior to the issuance of a
building permit.
The conditions of this right-of-way modification will be applicable for one year from the date of
this letter. If a building permit is not issued within the one-year time limit, the right-of-way
modification will be void, and a new request for modification must be submitted.

We are writing to request a modification to the Right of Way improvements required as part of
the Process IV Conditional Use Permit application for the subject project. We ask that the
proposed project be exempt from providing any Right of Way improvements to Military Road
South. The basis of our request is as follows:
1. The ROW improvements would likely push the project over the stormwater flow
Control exemption threshold, thereby forcing the project to install a storm detention
system and impose a difficult financial burden on this small project
2. The proposed project will not generate significant AM/PM Peak hour trips which might
otherwise trigger improvements. Large meetings are generally restricted to
weekends and off-peak hours.
3. It is our understanding that the proponent would be willing to sign a no protest
agreement to any future transportation Local Improvement District for the ultimate
improvements to Military Road South.
