We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal JVay City Code (FWCC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION The applicant proposes to subdivide one existing single-family residential lot located at 29929 Military Road South into either three or four single-family residential lots. Two scenarios were submitted. Scenario one subdivides the existing lot into four lots. Scenario two subdivides the existing lot into three lots. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. MS_ Tiguyenk 11 March 21, 2008 Page 2 Planning Division 1. Lots 2 and 3 in scenario one (four -lot short subdivision) do not meet the minimum lot size of 7,200 square feet. 2. Property is located in a Wellhead Protection Area (Capture Zone 5). A Hazardous Materials Checklist will be required. 3. A fee in lieu of open space will be required. • Public Works Development Services Division If the fully developed project (new homes and roads) creates over 2,000 square feet, but less than 10,000 square feet of new impervious, then Small Site Drainage Requirements apply. If the fully developed project creates over 10,000 square feet of new impervious areas, then Full Drainage Review shall apply. See Department Comments below, for additional information. • Public Works Traffic Division 1. A Concurrency Analysis is required in order to assess project impacts and determine traffic and safety mitigation measures. 2. Street frontage improvements and right-of-way dedication are required along Military Road South. The current proposal needs to meet access management standard. South King Fire and Rescue A fire department alternative turnaround may be approved when buildings are completely protected with an approved automatic fire sprinkler system. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the pre - application conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. PLANNING DIVISION (Matthew Herrera, 253-835-2638, matt.herrera@cityoffederalway.com) 1. Comprehensive Plan and Zoning Designation — The City's Comprehensive Plan designation for 29929 Military Road South is Single -Family Residential — High -Density. The property is currently zoned RS 7.2. The minimum lot area for residential lots in RS 7.2 zones is 7,200 square feet. Lots that contain a vehicular access easement, private tract, flag pole, or access panhandle shall not be credited in the calculation of minimum lot area. 2. Procedural Information — Short subdivision review is administrative. Preliminary approval is granted by the City's Director of Community Development. A notice of application with an accompanied two week comment period is required prior to preliminary approval. A two -week appeal period follows the Director of Community Development's short subdivision decision. Yard Requirements — Setbacks are: Front — 20 ft.; Rear — 5 ft.; Side — 5ft. (side yard setbacks for corner lots are 10 ft. for the portion of the lot not adjacent to the primary vehicular access). 08-100741 Doc ID 44569 4 Ms. Nguyen March 21, 2008 Page 3 4. Miscellaneous Residential Regulations a) Maximum height of structures -30 ft. above average building elevation. b) Maximum lot coverage — 60 percent. c) Required parking spaces — two per dwelling unit. • Driveway and/or parking pad may not be closer than five feet to any side property line. 5. Critical Areas —The subject property is located in a Wellhead Protection Area (Capture Zone 5). Development in Wellhead Protection Areas requires the applicant to complete and submit a Hazardous Materials Inventory Statement with the short subdivision application. City staff will analyze the inventory statement and determine if review under the State Environmental Policy Act is required. 6. State Environmental Policy Act (SEPA) — Typically short subdivisions are exempt from SEPA environmental review. This exemption does not apply if critical areas are located on the subject property. As mentioned above, City staff will analyze the Hazardous Materials Inventory Statement to determine if environmental review is required. A SEPA checklist is not required to be submitted with the short subdivision application. 7. Open Space — All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site. Short subdivisions satisfy this requirement with a fee in lieu payment calculated on 15 percent of the most recent assessed value of the property. This payment must be made to the City's Parks Department prior to recording the short plat with the King County Division of Records and Elections. 8. Landscaping and Significant Trees — A landscape plan prepared by a Iicensed landscape architect is required for all subdivisions. The plan shall identify existing wooded areas, significant trees', meadows, rock outcroppings, and other landscape features. The plan shall also show all proposed buffers, open spaces, street trees, and other ornamental landscaping. Significant tree retention and replacement requirements' will be implemented at the single-family building permit stage. 9. Landscape Tract — If it is determined that Lot 1 will access via South 300`h Street, a separate ten - foot -wide landscape tract shall abut the Military Road frontage. Type III landscaping shall be provided in the separate tract. Type III landscaping is defined as a mixture of evergreen and deciduous trees interspersed with larger shrubs and groundcover. For specific information regarding planting requirements please see the enclosed Landscaping Article from the City's zoning code. 10. Retention of Vegetation —All natural vegetation including, but not limited to significant trees, shall be retained on the site to be subdivided except vegetation that will be removed for improvements (e.g. streets and utilities). 1 Significant trees are defined as: (1)Twelve inches in diameter or 37 inches in circumference measured four and one-half feet above ground; and (2) In good health; and (3) Not detrimental to the community (e.g. is not diseased, dying, or likely of falling into public right-of-way, etc.) or obscuring safe site distance requirements. Significant trees shall not include red alder, cottonwood, poplar or big leaf maple. Z If the approved development will require the removal of more than 75 percent of the significant trees on the subject property, significant trees shall be replaced in amount to 25 percent of the significant trees which existed on the subject property prior to development. Administrative Fees — Current short subdivision review fees are $2,278.50. Be advised, this fee is for review of preliminary short plat approval only and does not include fees with regard to concurrency, engineering plan review, open space, etc. 12. Approval Duration — Short plat preliminary approval expires one year from the date of approval. No less than 30 days prior to the lapse of approval, the applicant may request a one-time extension limited to one year. 13. Recording— The City will record the short plat with the King County Division of Records and Elections subsequent to Public Works Department approval of submitted as -built plans. Prior to recording the short plat, all surveying and monumentation must be complete. In addition, all other required improvements must be substantially completed as determined by the departments of Community Development and Public Works. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Kevin Peterson, 253-835-2734, kevin.peterson@cityoffederalway.com) Land Use Issues — Stormwater Surface water runoff control and water quality treatment will be required per the 1998 King County Surface Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 1998 KCSWDM. a. If this project creates over 10,000 square feet of new impervious area, then Full Drainage Review is required. At the time of land use site plan preliminary short plat submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required. The project lies within a Level 1 flow control area, thus the applicant must design the flow control facility to meet this performance criteria. The project also lies within a Basic Water Quality Area. Water Quality Treatment shall be designed to meet the treatment criteria of the Basic Water Quality Menu. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1 " = 100', five-foot contour plammetric maps that may be used for basin analysis. b. If this project creates over 2,000 square feet, but less than 10,000 square feet of new impervious area, then drainage requirements as set forth in Appendix C Small Site Drainage Requirements of the KCSWDM will apply. C. If the project creates slightly over 10,000 square feet of new impervious area, the City is willing to look at Low Impact Development (LID) solutions, in order to allow for reducing the effective impervious area. Proposed LID solutions, as well as the expected square footage area over 10,000, should be discussed with staff, prior to a formal submittal. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. Detention and water quality facilities for short plats must be above ground (i.e. open pond). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 08-100741 Doc 1 D 44569 ,— , ,.--) Ms. Nguyen March 21, 2008 Page 5 4, Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 5. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at http://www.ecy.wa.gov/programs/sea/pac/index.html, or by calling 360-407-6437. Right -of -Way Improvements See the Traffic Division comments from Soma Chattopadhyay, Traffic Engineer, for traffic related items. 2. If dedication of additional right-of-way is required to install street frontage improvements, the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 3_ All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 4. Public Works Streets Division records indicate that South 300`h Street may be laterally open -cut for utility connections, without requiring mitigation and/or full -width overlay. Verify any street cut requirements with Kathleen Messinger, Street Systems Engineering Technician, at 253-835-2725. Engineering (EN) Permit Issues Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the City. Engineering review fees are $753.00 for the first 12 hours of review, and $65 per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/sea] of a professional engineer registered/licensed in the State of Washington. 2. In addition to engineering approval, short plats and subdivisions are required to obtain a separate permit for grading. Details and fees may be obtained from the Federal Way Building Department. 3. The Federal Way Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.ci!yoffederalway.com to assist the applicant's engineer in preparing the plans and TIR. 4. The applicant shall provide a geotechnical report that addresses design pavement thickness for the roadways. Bonding is required for all street frontage improvements and temporary erosion control measures associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 08-100741 Doc 1 D 44569 Ms. Nguyen March 21, 2008 Page 6 6. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. All final approved drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1 "= 20', or larger. Architectural scales are not permitted on engineering plans. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 1998 KCSWDM, must be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS TRAFFIC DIVISION (Soma Chattopadhyav, 253-835-2745, soma.chattopadhvay@cityoffederalway.com) Transportation Impact Analysis Based on the Institute of Transportation Engineers Trip Generation 76i Edition, land use code 210 (Single - Family Detached Housing), the project is expected to generate approximately three or five new weekday evening peak hour trips depending on three lots or four lots after giving credit for an existing building. Therefore, a Concurrency analysis is required for this proposal and the concurrency application fee is $315. The applicant would be expected to contribute pro-rata shares towards TIP projects impacted by 1 or more peak hour trips. Mitigation improvements necessary beyond those identified in the TIP to meet the City's adopted level -of -service standard are required to be provided by the applicant to meet concurrency requirements of the Growth Management Act. Street Frontage Improvements Per Federal Way City Code (FWCC) Section 22-1474, the applicant/owner would be expected to construct street improvements consistent with the planned roadway cross -sections as shown in Map III-6 of the FWCP and Capital Improvement Program (CIP) shown as Table III-19. Based on the materials submitted, staff conducted a limited analysis to determine the required street improvements in meeting the FWCC. Based on the analysis and FWCC, the applicant would be expected to construct improvements on the following streets to the City's planned roadway cross -sections: 1. Military Road South is planned as a Type "G" street, consisting of a 66-foot street with curb and gutter, six-foot planter strips with street trees, eight -foot sidewalks, and street lights in a 100-foot right-of-way (ROW). Assuming a symmetrical cross section, 20-foot ROW dedication and half 0& 100741 Doc. 1 D 44569 Ms_ Nguyen March 21, 2008 Page 7 street improvements are required and should be measured from the street centerline. Half street improvement shall be waived if there is no driveway access from Military Road South but dedication is required. 2. South 300`h Street is planned as a Type "W" street, consisting of a 28-foot street with curb and gutter, 5-foot sidewalks with street trees and streetlights in a 52-foot right-of-way. ROW is available. 3. The width of private driveway (ingress/egress easement) for three and four lots is 25 feet with a 20-foot minimum paved driveway (Drg. No.3-21313), for two lots 20 feet with a 16-foot minimum paved driveway (Drg. No.3-2CC), and for one lot 15 feet minimum with a 12-foot minimum pavement (Drg. No.3-213B). 4. Per FWCC Section 22-I477, the applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements. Information about right-of- way modification requests are available through the assigned planner. Such requests have a set review fee. Access and Traffic Circulation Access management standards are based on roadway safety and capacity requirements. FWCC Section 22-1543 provides access standards for streets based on planned roadway cross -sections. Please note that access classifications are per Drawing 3-1A in the Public Works Development Standards. Other Comments Please note that the maximum allowable grade for city streets/access driveways is 15 percent or as approved by the Fire Department. LAKEHAVEN UTILITY DISTRICT (Brian Asbury, 253-946-5407, basbury@lakehaven.org) Water A separate water service connection application submitted to Lakehaven is required for each new service connection to the water distribution system, or any modification to an existing water service connection (e.g., larger service, abandonment of existing service(s), etc.), in accordance with standards defined in Lakehaven's current `Fees and Charges Resolution'. Sewer 1. A Developer Extension Agreement will be required to construct new and/or abandon existing sanitary sewer facilities necessary for the proposed development. Additional detail and/or design requirements can be obtained from Lakehaven by submitting a separate application to Lakehaven for either a Developer Pre -Design meeting or a Developer Extension Agreement. Lakehaven encourages the owner to apply for either of these processes early in the pre-design/planning phase to avoid delays in overall project development. 2. In lieu of the requirement for a Developer extension Agreement, sewer service connections for the proposed single-family residences may be allowed under Lakehaven's "Temporary Service Policy". Such connections would be subject to payment of earlycomer charges assessed with the sewer service connection permits. A preliminary estimate of sewer earlycomer charges, based on the property frontage along Military Road S of 83.9 feet at Lakehaven current (2008) rate of $77.46 per 08-100741 Doc I D 44569 Ms. Nguyen March 21, 2008 Page 8 benefited front foot, indicates a payment of approximately $6,500 would be required. Additionally, the cost of each sewer service connection permit (2008 fee schedule) would be approximately $3,121. General 1. Charges -payable -in -lieu -of -extension, and/or latecomer and/or earlycomer charges may be assessable against the property for facilities either previously constructed or to be constructed that provide direct benefit to the property. Please contact Lakehaven for further detail. 2. Lakehaven's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units (ERU). Residential equivalency for Single-family use is calculated as 1.0 ERU per unit. Lakehaven's 2007 Capital Facilities Charges are $3,196/ERU for water and $2,768/ERU for sewer. 3. Credit may be available for this property from connection charges previously assessed for water and/or for sewer. Please contact Lakehaven for further detail. 4. All comments herein are valid for one (1) year and are based on the proposal(s) submitted and Lakehaven's current regulations and policies. Every building lot shall have a fire hydrant within 300 ft. All measurements shall be made as vehicular travel distance_ Fire Apparatus Access Roadway Fire apparatus access roadways in excess of 150 feet in length shall be provided with a cul-de-sac. A fire department alternative turnaround may be approved when buildings are completely protected with an approved automatic fire sprinkler system.
