Request for Modification to Private Access Road
Dear Ms. Nguyen,
This letter responds to your request to modify the required private access road improvements
associated with the above -referenced project. After evaluating your request and review of
Federal Way City Code (FWCC) provisions (Sections 22-1477, 22-1496), and development
standards, the Public. Works Department hereby denies your request to modify the private
access road.
It has been determined, through the development of the private access roadway standards that
the requirements provided in City Standard Drawing 3-2DD (20-foot paved road within a 25-
foot easement), provides the minimum for the safe passage of passenger, emergency, and
various delivery vehicles, for a three or four lot development.
Even though the City is denying your modification request, we would like to offer the following
suggestions as to how the minimum access requirements may be met, while maintaining the
three -lot option:
Based on the preliminary site design provided, it appears that if the bio-swale can be eliminated
through the use of an alternative water quality design, Best Management Practices (BMP's)
and/or Low Impact Design (LID) options, the roadway and easement can be widened to the
required width, with minimal further impact on the desired building depth. Even though the
project is required to meet the surface water design requirements of the 1998 King County
Surface Water Design Manual (KCSWDM), the scale of project lends itself to be a candidate for
the City to consider LID options (if determined feasible) that are more likely identified in the
2005 KCSWDM. The City has, in the past, approved similarly sized projects where LID options
were determined feasible.
The City would also consider an access off of Military Road for Lot 3 if the applicant were to
establish a shared access driveway agreement (and associated easements) with the neighboring
property to the north.

The conditions of this right-of-way modification will be applicable for a period of one year from
the date of this letter. If a building permit is not issued within the one-year time limit, this
waiver will be void, and a new request for modification must be submitted.
