S., Parcel 152104-9081 Dear Mr. Singh: Thank you for participating in the preapplication conference with the City of Federal Way's Development Review Committee (DRC) held January 4, 2018. We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Water and Sewer District and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply to your project. Otherwise, any general questions about the preapplication and permitting process can be referred to your key contact. PROJECT DESCRIPTION The applicant proposes to short plat one single-family residential lot into seven on a 2.05-acre vacant parcel with a public street (cul-de-sac). The site is vacant and heavily forested with no permitting records on file with the city. MAJOR ISSUES PlanninF_ Division • Forest Practices Class IV Permit and environmental threshold determination required if proposal includes the removal of 5,000 board feet (i.e., one log truck of timber) of merchantable timber. This information shall be required at the time of formal land use application. The burden of proof shall be on the applicant to provide an inventory (clearing, grading and tree/vegetation retention plan) prepared by a qualified professional. Where the city determines that clearing and grading plans and/or tree and vegetation retention plans shall also be reviewed by the city's consultant(s), the applicant shall cover the cost of the third party review. Singh January 10, 2017 Page 2 • All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site per FWRC 18.55.060(2). All or some of the open space requirement may be satisfied by a fee -in -lieu payment at the discretion of the Parks and Recreation Director; paid at recording. Please request this in writing to the attention of the Parks Director for consideration. • Depict net plat area on short plat map (deducting public lands and right-of-way dedications, etc.). • Special studies -maybe required to establish the presence or absence of critical areas (wetlands, streams and geologically hazardous areas). If found on the property third party review maybe required for review of such study by the city's consultant at the expense of the applicant. Public Works Traffic Division • Transportation Concurrency Management (FWRC 19.90) — Transportation concurrency permit with application fee of $1,669.00 is required for the proposed project. • Traffic Impact Fees (FWRC 19.91) — Traffic impact fees are required for each residential dwelling unit assessed at building permit issuance. • Frontage Improvements (FWRC 19.135.040) — Construct street improvements and dedicate right- of-way (ROW) along Military Road South. • Access Road — Internal road shall be public and constructed to a Type `W" street. • Access Management (FWRC 19.135.260) — The development shall meet access management standards along Military Road. Public Works Development Services Division ■ Existing overhead utilities along the Military Road frontage may need to be relocated underground if a relocation is required due to the street frontage improvements that will be required (FWRC 11.05.110). • If the internal plat roadway is to be a public street (see Traffic Division comments, below), dedicated to the City, the roadway and other hard surfaces shall be per City standards — no permeable paving materials are allowed. COMMUNITY DEVELOPMENT — PLANNING DIVISION Leila Willoughby -Oakes, 253-835-2644, Leila.Willoughby-Oakes@cityoffederalway.com 1. Comprehensive Plan and Zoning Designation — The city's comprehensive plan designation for the subject property is Single -Family Residential -High Density. The property is zoned Residential Single -Family (RS) 9.6. The minimum lot area for residential lots in the RS9.6 zone is 9,600 square feet; detached dwelling units are permitted pursuant to FWRC 19.200.010. The required review process for the project is an administrative short plat review process. 2. Short Plat Review —Pursuant to FWRC 18.30.010, short plat applications are administratively processed through the Department of Community Development. The administrative review process requires that the Director issues a decision on the short subdivision request, reviewed under FWRC 18.30.110.(2). Public notice of the complete short plat proposal is required per FWRC 18.30.080, and a 15-day public comment period is provided. However, no public hearing will be required for a short plat unless an appeal is filed. A master land use application and short plat submittal checklist are enclosed; relevant code sections can be accessed online from www.codepublishing.comIWA/FederalWay. 17-105604-00-PC Doc ID: 77001 Mr. M. Singh January 10, 2017 Page 3 Prior to construction of the short plat improvements, engineering approval must be granted by the Public Works Department. Please see Kevin Peterson's (PW Engineering Plans Reviewer) comments for specific information regarding engineering requirements. Forest Practices Permit — The City has assumed jurisdiction over the review and approval of Class IV -General Forest Practices permits. A forest practices application form must be completed if more than 5,000 board feet of merchantable timber is harvested from the subject property. This is approximately equal to one log truck of timber; your site development includes the potential removal of trees on more than two acres. As such, please calculate the board feet of timber to be removed shown on your preliminary clearing and grading plan (Figure 1). The City will review the proposed Class IV -General Forest Practices in conjunction with the Land Use application. Please include details of such activity in the environmental checklist as the Class IV permit is not exempt from SEPA review. Approval Duration General forest practice approval shall be valid for two consecutive years following the date of issuance unless a longer time period has been established through an associated approval (e.g., preliminary plat approval, land use approval, building permit, etc.) in which case the time limits applicable to the associated approval shall apply. 4. State Environmental Policy Act (SEPA) — Short subdivision applications and associated permits for less than 20 residential dwelling units are exempt from state environmental review per FWRC 14.15.030, categorical exemptions, flexible thresholds. However, if it is determined that the proposal will trigger a Forest Practices Class IV permit, a threshold determination must occur in conjunction with the enclosed Forest Practices application. Initial public notice of application is issued after determination of a complete application. An environmental checklist is also enclosed with this letter. Single family building permits can be issued after land use approval is granted and appeal periods concluded, engineering permits are approved and the short plat is recorded. Meeting Follow-up: At the meeting the question arose as to whether Forest Practices Class IV Rermit is required. Please provide a tree/timber inventory evaluating the site as to whether the proposal, likely requesting the removal of all trees on site for short plat construction, will result in 5,000 board feet of merchantable timber. It is the opinion of staff that this is likely the case and an environmental checklist and threshold determination applies. If subject to environmental review under the State Environmental Policy Act (SEPA) the City serves as the Responsible Official for the environmental review; an environmental checklist must be submitted and reviewed prior to the City issuing an environmental threshold determination. All property owners within 300 feet of the site are notified of that decision. The notification includes a 14-day comment and 21-day appeal period. SEPA review must be concluded before land use approval may be granted. 17-105604-00-PC Doc ID: 77001 Mr. M. Singh January 10, 2017 Page 4 Figure 1. Subject Property- Tree Coverage Notification — If a SEPA determination is triggered by the forest practices permit, it requires a public notice and 15-day comment period. Within 14 days of issuing the Letter of Complete Application for the underlying land use permit, a Notice of Application will be published in the Federal Way Mirror, mailed to persons within 300 feet of the subject property, posted on the subject property, and placed at the city's three designated notice boards. SEPA notification will be done in compliance with FWRC 14.10.040. Please fmd the enclosed affidavit for sign posting, return to the city, signed, with pictures of the public notice. The applicant is required to submit two (2) sets of stamped mailing envelopes to persons receiving tax statements within 300 feet of the subject property. The City's GIS Division provides this service for a nominal fee or the applicant may provide their own mailing envelopes via King County Assessor records or Title Company. Please find the enclosed bulletin for further information. 6. Environmentally Critical Areas — There are no critical areas depicted on the city's critical area mapping'; however, the site is undeveloped and thickly forested. There are no permitting/building records on file with the city, including a recent critical area study and/or site investigation conducted within the last five years. Please conduct a critical areas reconnaissance prepared by a qualified professional (wetland biologist and geotechnical engineer) to evaluate if streams, regulated wetlands and/or geologically hazardous areas exist on site or within 225 ft. of the subject property (boundaries) pursuant to FWRC 19.145.410.2.Off-site critical areas and critical area buffers that extend onto the undeveloped parcel shall be depicted on the plans and not built in. The city's biologist will peer review and conduct a site visit confirming the applicant's consultant conclusions and recommendation, at the expense of the applicant (FWRC 19.145). You may choose to do this prior to submitting your formal land use application before a final short plat design. Please see the Administrative Decision application enclosed (a city letter of concurrence is valid for five years on wetland determinations and delineations). In the event there are critical areas on site using best available science, the applicant shall submit critical area report with complete field sheets, site data, pictures and the items in FWRC 19.145.080 (minimum critical area content requirements). I FWRC 19.145.2 states, "area -wide inventories and documents identifying critical areas may not identify all critical areas designated under this chapter. The provisions of this chapter will apply to all designated critical areas located within the city, including those critical areas not identified on a map or inventory. Whenever there is evidence of a critical area located within or in proximity to a nonexempt action, the director may require a critical area report to determine the extent to which such critical area may exist. " 17-105604-00-PC Doc ID:77001 Mr. M. Singh January 10, 2017 Page 5 7. Key Development Regulations — All site improvements must comply with the applicable FWRC development regulations. The following general regulations apply to single family dwelling units in the RS9.6 zone. Setback Requirements — The required front yard setback is 20 feet; side and rear yard setbacks are five feet. Please provide 2 ft. contours on the topography drawing. Drivewa sl rkin -- 20 ft. max. Vehicles may not be parked in the required side yard. Two per dwelling unit. Maximum Lot Coverage — 60 percent. Maximum Hei t — 30 feet above average building elevation. 8. Short Plat Approval Duration — Per FWRC 18.35.260, short plat approval shall expire five years from the date of preliminary short plat approval unless the applicant requests an extension. As provided in FWRC 18.05.090, no less than 60 days prior to the lapse of approval, the applicant may request a two-year time extension for the plat approval potentially subject to conditions on the second extension request. 9. Landscape buffer — The frontage of the plat shall contain a 10-foot Type III landscape buffer, dedicated in a separate tract to shield new residences. Military Road South is an arterial street. Please note tracts are counted as lots in the city of Federal Way. Perimeter fencing in subdivisions shall be located on the interior side of landscape strips planted along arterial streets. The landscape buffer may be allocated towards open space requirements (15 percent of the gross plat area) to a maximum of 2%. Any subdivision proposal exceeding 9 lots requires preliminary plat review pursuant to FWRC Chapter 18.35. 10. Recording — Following substantial completion of short plat subdivision improvements and city review of the final short plat map, the applicant will record the plat with the King County Recorder's Office. The applicant is responsible for the recording fees. Prior to recording the plat, all surveying and monumentation must be complete. In addition, all other required improvements must be substantially completed as determined by the departments of Community Development and Public Works and the open space fee -in -lieu must be paid in full prior to recording. All mylars shall be signed with black ink. 11. School Access — A school access analysis is required to be submitted to the City with the seven -lot short plat application, to assure that safe walking routes to schools or bus stops are provided as required by RCW 58.17. If there are not safe and adequate walking routes available, walking route improvements may be required as part of the administrative review process and fulfilled during the engineering review. School Impact Fees — School impact fees are due and calculated at the time of residential permit application(s) for new dwelling units. This fee amount is subject to change as determined annually by the Federal Way School District due at the time of building permit. Please check with the Permit Center for up-to-date fees. 13. Application Fees — Please contact the Permit Center at 253-835-2607 for the following review fees applicable for your project: • Short Plat Application • SEPA Checklist 0 Forest Practices Permit Class IV w/ SEPA • Concurrency This list does not include building permit, engineering review, inspection, traffic impact, recording and other fees that may be applicable prior, concurrent, or following final construction of the single family residences. Please reference the enclosed submittal checklist for minimum submittal requirements. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Kevin Peterson, 253-835-2734, kevin.peterson@cityoffederalway.com) Land Use Issues — Stormwater 1. Surface water runoff control and water quality treatment will be required per the 2016 King County Surface Water Design Manual (KCSWDM). This project meets the requirements for a Full Drainage Review. At the time of preliminary short plat submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project to the nine core and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1" = 100', five-foot contour planimetric maps in GIS format that may be used for basin analysis. 2. The project lies within a Conservation flow control area, thus the applicant must design the flow control facility to meet this performance criteria. In addition to flow control facilities, Best Management Practices (BMP's) are required as outlined in the KCSWDM. The project also lies within Enhanced Basic Water Quality Area. Water Quality Treatment shall be designed to meet the treatment criteria of the Enhanced Basic Water Quality Menu. 3. If infiltration is proposed, soil logs and infiltration test shall be prepared by a licensed geotechnical engineer to verify infiltration suitability. It shall be established, prior to preliminary short plat approval, that infiltration is viable for roof drain runoff for the individual lots. This is to ensure that the storm water pond is adequately sized for all runoff from the roadway(s). 4. Detention and water quality facilities for short plats must be above ground (i.e. open pond), located within a separate tract. Underground facilities are allowed only with approval from the City of Federal Way Public Works Department. 5. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 17-105604-00-PC Doc ID: 77001 Mr. M. Singh January 10, 2017 Page 7 6. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) construction storm water permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at htt2://www ecy wa.goylprograms/wg/stormwater/constructiotilijidex.htmi or by calling 360-407- 6048. Right -of -Way Improvements 1. See the Traffic Division comments from Sarady Long, Sr. Transportation Planning Engineer, for traffic related items. 2. If dedication of additional right-of-way is required to install street frontage improvements, the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 3. If the internal plat roadway is to be a public street, dedicated to the City, the roadway and other hard surfaces shall be per City standards — no permeable paving materials are allowed. 4. All stormwater treatment and detention requirements outlined above may apply to any improvements within the public right-of-way. 5. FWRC 11.05.110 requires that overhead utility lines be relocated underground if over 500 feet, or three spans are affected by a project. This condition will be applied to Military Road. 6. FWRC 19.135.280 requires that driveways serving residential uses may not be located closer than 25 feet to any street intersection. Lots and intersections within new subdivisions or short plats must be designed to meet this standard. Engineering (EN) Permit Issues 1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the City. Engineering review fees for Short Plats are $1,669.00 for the first 12 hours of review, and $139.00 per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2.. In addition to engineering approval, projects that will be filling or grading in the area of the future building pads are required to obtain a separate grading permit from the Building Department. 3. The Federal Way Public Works Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at btW://www.ciiyoffederalw,g,v.com/index.aspx?nid=171 to assist the applicant's engineer in preparing the plans and TIR. 4. Bonding is required for all street improvements and temporary erosion and sediment control measures associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the 17-105604-00-PC Doc ID: 77001 Mr. M. Singh January 10, 2017 Page 8 improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. The developer will be responsible foi the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two- year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. 6. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. 7. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. Site plans shall be drawn at a scale of 1" = 20', or larger. Architectural scales are not permitted on engineering plans. 8. Provide cut and fill quantities on the clearing and grading plan. 9. Temporary Erosion and Sediment control (TESC) measures, per Appendix D of the 2016 KCSWDM, must be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS — TRAFFIC DIVISION (Sarady Long, 253-835-2743, sarady.lone(a-�cityoffederalway.com) Transportation Concurrency Analysis (FWRC 19.90) 1. Based on the submitted materials for two Single Family Detached Housing, the Institute of Transportation Engineers (ITE) Trip Generation - 8t" Edition, land use code 210 (Single Family Detached Housing), the proposed project is estimated to generate approximately 7 new weekday PM peak hour trips and 66 daily trips. 2. A concurrency permit is required for this development project. The PW Traffic Division will perform concurrency analysis to determine if adequate roadway capacity exists during the weekday PM peak period to accommodate the proposed development. Please note that supplemental transportation analysis and concurrency mitigation may be required if the proposed project creates an impact not anticipated in the six -year Transportation Improvement Plan (TIP). 3. The estimated fee for the concurrency permit application is $1,669.00 (less than 10 PM Trips). This fee is an estimate and based on the materials submitted for the preapplication meeting. The concurrency application fee must be paid in full at the time the concurrency permit application is submitted with land use application. The fee may change based on the new weekday PM peak hour trips as identified in the concurrency trip generation. The applicant has the option of having an 17-105604-00-PC Doe ID: 77001 Mr. M. Singh January 10, 2017 Page 9 independent traffic engineer prepare the concurrency analysis consistent with City procedures; however, the fee remains the same. Transportation Impact Fees (TIF) (FWRC 19.91) Based on the submitted materials for seven single family lots, the estimated traffic impact fee is $27,940. The total amount of the impact fees will be assessed and collected from the applicant when the building permit is issued, using the fee schedule then in effect. The applicant may request, at any time prior to building issuance to defer the payment of the impact fee to final building inspection. If this option is selected, a covenants prepared by the city to enforce payment of the deferred fees will be recorded at the applicant's expense on each lot. Please, refer to defer payment of impact fee code for process. Street Frontage Improvements (FWRC 19.135) The applicant/owner would be expected to construct street improvements consistent with the planned roadway cross -sections as shown in Map III-4 in Chapter III of the Federal Way Comprehensive Plan (FWCP) and Capital Improvement Program (CIP) shown as Table III-10 (FWRC 19.135.040). Based on the materials submitted, staff conducted a limited analysis to determine the required street improvements. The applicant would be expected to construct improvements on the following streets to the City's planned roadway cross -sections: ■ Military Road South is a minor arterial planned as a Type "K" street, consisting of a 44- foot street with curb and gutter, six-foot planter strips with street trees, eight -foot sidewalks and street lights in a 78-foot right-of-way (ROW). Assuming a symmetrical cross section, half street improvements are required and 9-foot right-of-way dedication. It Internal street shall be a Type "W" Local street, consisting of a 28-foot street with curb and gutter, four -foot planter strips with street trees, five-foot sidewalks and street lights in a 52- foot right-of-way (ROW). K Cul-de-sac terminus bulb shall be per Dwg. 3-2Z. 2. Tapers and transitions beyond the project frontage may be required as deemed necessary for safety purposes, taper rate shall be WS^2/60 or as directed by the Public Works Director. 3. The applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements (FWRC 19.135.070). Information about right-of-way modification requests is available through the Public Works Development Services Division. These modification requests have a nominal review fee currently at $278 plus recording fee. Access Management (FWRC 19.135) 1. Access management standards are based on roadway safety and capacity requirements. FWRC 19.135.280 provides access standards for streets based on planned roadway cross -sections. Please note that access classifications are per Drawing 3-1A in the Public Works Development Standards. 2. The current proposal does not meet access management standards and should be modified. Military Road South is Access Class " 4", which permits full access as close as 150 feet to any other street 17-105604-00-PC Doc ID:77001 Mr. M. Singh January 10, 2017 Page 10 intersection or driveway, whether on or off the subject property. The internal street should be aligned with 45t" Way South. 3. All lots shall be accessed by a public street right-of-way (FWRC 18.55.020). In certain cases, lots may be accessed by an ingress/egress and utilities easement or alley subject to the requirements established in the City of Federal Way Public Works development standards. Residential lots should not have direct access onto arterial streets. 4. The Director may grant a modification administratively to reduce spacing standards by up to 20 percent of the tabular values with supporting documentation (FWRC 19.135.290). Once preliminary traffic queuing analysis has been completed, the applicant's traffic engineer may submit a written request for access modification if desired. Please note that these modification requests have a nominal review fee. COMMUNITY DEVELOPMENT — BUILDING DIVISION Peter Lawrence, 253-835-2621, Peter.Lawrence@cityoffederalway.com There are no comments from the Building Division on the short plat process. Building permits will be required when the lots are determined buildable. LAKEHAVEN WATER AND SEWER DISTRICT (Brian Asbury, 253-946-5407, BAsbury@lakehaven.org) Water • A Water Certificate of Availability issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications (check with land use agency for requirement). Certificate is valid for one (1) year from date of issuance. If Certificate is needed, allow 1-2 work days to issue for typical. Proposed 2018 cost for a Water Certificate of Availability is $60.00. • Fire Flow at no less than 20 psi available within the new dead-end water distribution system will be a minimum of 1,000 GPM (approximate) for two (2) hours or more. This flow figure represents Lakehaven's adopted minimum level of service goals for residential areas regarding performance of the water distribution system under high demand conditions. Hydraulic model results (FF #163, copy attached) indicate that Lakehaven's standard maximum allowable system liquid velocity of 10 ft/s in the existing water system along Military Rd S, at no less than 20 psi, is exceeded at a fire flow rate above 3,100 GPM. This flow figure depicts the calculated performance of the water distribution system under high demand conditions. Fire flow rates greater than available in the existing distribution system may be accommodated through water distribution system improvements. Please contact Lakehaven for further detail. o A Lakehaven Developer Extension (DE) Agreement will be required to construct new water distribution system facilities for the proposed development. Additional detail and/or design requirements can be obtained from Lakehaven by completing & submitting a separate application to Lakehaven for either a Developer Pre -Design Meeting or a DE Agreement. Lakehaven encourages owners/developers/applicants to apply for Lakehaven processes separately to Lakehaven, and sufficiently early in the pre-design/planning phase to avoid delays in overall project development. o Service pressure(s) greater than 80 psi indicated, Pressure Reducing Valve(s) indicated, contact local building official for requirements &/or additional information. 17-105604-00-PC Doc ID: 77001 Mr. M. Singh January 10, 2017 Page 11 o The associated DE Agreement must achieve a point of either Substantial Completion or Acceptance, as determined by Lakehaven, prior to activating any new domestic or irrigation water service connection(s). o Based on the proposal submitted, preliminary estimated Lakehaven water service connection fees/charges/deposits (2018 schedule) will be as follows. Actual connection charges will be determined upon submittal of service connection application(s) to Lakehaven. Connection charges are separate from any DE fees/charges/deposits & are due at the time of application for service. EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system the distance can be increase 20 percent. Fire apparatus access roads: 1) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2) Shall be designed and maintained to support the imposed load of a 75,000 pound fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3) Shall be not less than a 32 foot inside turning radius and not less than a 40 foot outside turning radius. 4) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac or Fire Department approved alternative at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. 5) Gradient shall not exceed 12 percent. Designated fire lanes may be required for emergency access. This may be done during the plans check or prior to building final. Fire apparatus access roads shall be installed and made serviceable prior to and during the time of construction.
