Dear Mr. Dahabreh:
The City has completed a review of the Process I application submitted October 1, 2009, to install a 500-
gallon above ground retail propane dispensing tank at the above -referenced gas station and convenience
store. The zoning for the site is Neighborhood Business (BN). Vehicle service stations and mini marts are
permitted uses in the BN zone pursuant to Federal Way Revised Code (FWRC) 19.215.030. The sales and
distribution of propane gas is considered accessory to the vehicle service station use. Based on the City's
review, the Process I application to locate a propane tank on site is administratively approved.
The proposed propane tank is to be set back 30 feet from the building as shown in the enclosed redlined copy
of the site plan. The propane tank does not create new impervious area; does not reduce the amount of
required landscaping, buffering, open space, or public areas; and does not change parking, pedestrian
connections, utilities, or easements. As the propane tank is consistent with gasoline fueling pumps, screening
is not required. An electrical permit for the propane tank is required, as is a Uniform Fire Permit from the
Fire Department.
The effective date of this decision is October 30, 2009, or three days from the date of this letter. Pursuant to
FWRC 19.55.050, any person who received notice of the administrative diction may appeal the decision to
the Federal Way Hearing Examiner by November 13, 2009. Any appeal must be in the form of a letter
delivered to the Department of Community Development Services with the established fee. The appeal letter
must contain a clear reference to the matter being appealed and a statement of the alleged errors in the
Director's decision, including the identification of specific findings and conclusions made by the Director
disputed by the person filing the appeal. No work on the proposal can commence until the end of the appeal
period.
In that you are the only party of record, you may waive your right to appeal by submitting a letter to this
effect to the City of Federal Way, Department of Community Development Services. Work on the site may
not commence until you have been issued the appropriate electrical and Uniform Fire permits.
