We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply to your project. Otherwise, any general questions about the preapplication and permitting process can be referred to your key contact. PROJECT DESCRIPTION Residential short subdivision of one existing single-family lot into four single-family lots. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. a Planning Division a Ownership of the `Tract B' portion of the parcel must be verified. a Environmental review may be required for right-of-way stormwater improvements or excessive grading. Slielyuk' Page 2 August 9, 2012 Development Services Division Surface water runoff control and water quality treatment will be required per the 2009 King County Surface Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 2009 KCSWDM. • Traffic Division 1. A Transportation Concurrency permit is required per FWRC Chapter 19.90. 2. Construct street frontage improvements and dedicate right -of --way (ROW) along the property frontage on SW 312"' Street and 8"' Avenue SW (FWRC 19.135.040). 3. Revise current proposal to meet access management standards (FWRC 19.135.280). • Lakehaven Utility District Sewer main extension will be required. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative Iisted for that section. PLANNING DIVISION (Matthew Herrera, 253-835-2638, matt.berrera@cityoffederalway.com) Comprehensive Plan and Zoning Designation —The city's comprehensive plan designation for the subject property is Single -Family Residential — High Density. The property is currently zoned RS 7.2. The minimum lot area for residential lots in RS 7.2 zones is 7,200 square feet. 2. Procedural Information — Short subdivision review is administrative. The department will issue a complete application letter and/or request for additional information within 28 days of receiving the short subdivision application. Vesting of the proposed short subdivision shall take place at the time of complete application. A notice of application with an accompanied two -week comment period is required prior to preliminary approval. Preliminary approval is granted by the city's Director of Community and Economic Development. A two -week appeal period follows the director's decision. Prior to construction of short plat improvements, engineering approval must be granted by the Public Works Department. Please see Ms. Dower's comments for specific information regarding engineering requirements. 3. Short Plat Content Requirements — For an itemized list of required information to be included in the short plat, please refer to the enclosed bulletin. The city's Subdivision code (Title 18) and Zoning and Development code (Title 19) can be accessed from hM://www.codgpublishing,.comAVA/FederaiWay. State Environmental Policy Act (SEPA) — Short plat applications are typically exempt from the requirements of SEPA review. Although, if stormwater improvements require the need for new lines in excess of 8 inches in diameter or if grading in excess of 500 cubic yards is proposed, the short plat will lose its exempt status and require an environmental checklist with additional noticing. The State Department of Ecology is currently drafting amendments to the SEPA rules that will increase the thresholds for stormwater line diameter and grading. These amendments are anticipated to take effect beginning in 2013. If your project will currently trigger SEPA review, feel free to 12-103115 Doc. LD. 61676 Mr. Strelyuk Page 3 August 9, 2012 contact the Planning Division prior to submitting your application to verify if the amendments have been adopted. 5. Public Notice — The city will prepare and post a notice board on the subject property. Copies of the Notice of Application will also be posted at the city's designated public notice areas and published in the Federal Way Mirror. If the proposal will require SEPA review, the applicant is responsible for acquiring mailing labels and providing postage paid envelopes for property owners within 300 feet of the subject property for the environmental determination. Critical Areas — The site is located within a 5-year Wellhead Protection Zone. Pursuant to 19.185.010, if the project requires SEPA review, city regulations regarding Wellhead Protection Zones will be applied at time of short plat application. Limitation of the handling and storing of hazardous materials on the subject site are enforced and a hazardous material checklist is required with the Master Land Use application. 7. Lot Size — The zoning for the subject site is Residential Single -Family (RS-7.2). Minimum lot size for each lot is 7,200 square feet. Please be advised that any area established as an ingress/egress easement, pipestem, or access tract for each property must be deducted from the underlying parcel lot size. Please include this "net" lot area on the lot closure calculations and short plat document. Tract B Ownership — Prior to approving the short subdivision, the city will need verification of ownership of the adjacent subdivision's `Tract B' that has been included on the site survey. This tract was originally within the Mirror Lake Lane subdivision but is now shown on the subject property. Subdivision tracts are typically created for a function other than a dwelling site such as stormwater control/treatment, a roadway component, or onsite open space. Staff was unable to locate evidence the tract was obtained via sale and/or boundary line adjustment and will likely not consider the tract a `building site.' 9. Design Criteria — Short plats are subject to the subdivision design criteria set forth in FWRC Chapter 18.55. 10. Setbacks and Lot Coverage — Existing and future residences must conform to the following structural setback requirements of 19.200.010, "Detached Dwelling Units" (enclosed): front yard - 20 feet; side yard - five feet; and rear yard - five feet. Lot coverage for residential uses is limited to 60 percent and includes all impervious surfaces such as driveways, walkways, patios, and roof overhangs. Depict these typical building setback requirements and the proposed lot coverage on the proposed short plat. PIease refer to the enclosed Flag Lot Setbacks illustration to see how the building setbacks should be applied. 11. Open Space — All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site per FWRC 18.55.060(2). All or some of the open space requirement may be satisfied by a fee -in -lieu payment at the discretion of the parks director after consideration of the city's overall park plan, quality, location, and service area of the open space that would otherwise be provided with the project. If the fee -in -lieu option is chosen, a written request to Public Works and Parks Director Cary Roe is required. Clearing, Grading, and Vegetation and Tree Retention — The short plat is subject to the provisions of FWRC 19.120, "Clearing, Grading, and Vegetation and Tree Retention." It is recommended that FWRC 19.120 be reviewed carefully in reference to the proposed short plat. A clearing and grading plan that meets FWRC 19.120.020(4) and FWRC 19.120.040 must be submitted with the short plat application. Please note that there are limitations on artificial slopes (FWRC 19.120.100) and rockeries and retaining walls are limited to six feet in height (FWRC 19.120.120). The plat will be subject to tree density requirements ofFWRC 19.120.130(1); note that 25 tree -units per acre are required for single-family zoned sites. In the case of the I.56-acre site, 19 tree units are required (25 x 1.56 = 39, minus any land area deducted for public or private streets). Under FWRC 19.120.130(c), if there is insufficient tree cover to meet tree density standards, additional trees are to be planted to achieve the minimum tree density. Tree unit credits are in table 2 of FWRC 19.120.130-2. The formal application must indicate how this requirement is to be met. 13. Administrative Fees —As development fees change annually, please contact the Permit Center at 253-835-2607 for an updated fee list prior to submitting your application. 14. Approval Timeline — Infrastructure and improvements associated with short plat approval shall be constructed within five (5) years of the date of approval or the decision shall expire. 15. Recording — The City will record the short plat with the King County Division of Records and Elections subsequent to Public Works Department approval of submitted as -built plans. Prior to recording the short plat, all surveying and monumentation must be complete. In addition, all other required improvements must be substantially completed as determined by the departments of Community Development and Public Works. Unless deferred, all open space and traffic impact fees must be paid in full prior to recording. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Ann Dower 253-835-2732, an n. d ower@cityoffed eralway.com) Land Use Issues — Stormwater 1. Surface water runoff control and water quality treatment will be required per the 2009 King County Surface Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 2009 KCSWDM. This project meets the requirements for a Full Drainage Review. At the time of land use, preliminary short plat submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1" = 100`, five-foot contour planimetric maps that may be used for basin analysis. 2. The project lies within a Flood Protection flow control area, thus the applicant must design the flow control facilities and Best Management Practices (BMP's) to meet this performance criteria. Water quality treatment will be required for all pollution -generating impervious surfaces. Treatment options must be selected from the Enhanced Basic Water Quality Menu provided in the KCSWDM. 12-103115 Doc. ID. 61676 Mr. Strelyuk Page 5 August 9, 2012 3. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. 4. Detention and water quality facilities for short plats must be above ground (i.e. open pond). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division. 5. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 6. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at htt:/lwww_e wa_ ov/ ro ams/seal ac/index.html, or by calling 360-407-6437. Right -of -Way Improvements See the Traffic Division comments from Sarady Long, Sr. Transportation Planning Engineer, for traffic related items. 2. If dedication of additional right-of-way is required to install street frontage improvements, the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 3. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 4. FWRC 19.135.280 requires that driveways serving residential uses may not be located closer than 25 feet to any street intersection. Lots and intersections within new subdivisions or short plats must be designed to meet this standard. Building (or EN) Permit Issues 1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be reviewed and approved by the City. Engineering review fees are $824.50 for the first 12 hours of review, and per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the State of Washington. 2. In addition to engineering approval, short plats and subdivisions are required to obtain a separate permit for grading. Details and fees may be obtained from the Federal Way Building Department. 3. The Federal Way Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.ciiyoffedeTalwgy.com to assist the applicant's engineer in preparing the plans and TIR. 4. The applicant shall provide a geotecbnical report that addresses design pavement thickness for the roadways. 12-103115 Doc. I.D. 61676 Mr. Strelyuk Page 6 August 9, 2012 5. Bonding is required for all street improvements and temporary erosion and sediment control measures associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit will need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 6. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period. During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. 7. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are called out. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. All final approved drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of 1" = 20', or larger. Architectural scales are not permitted on engineering plans. 9. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 2009 KCSWDM, must be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WoRKs TRAFFIC DIVISION (Sarady Long, 253-835-2743, sarady.long@cityoffederalway.com) Transportation Concurrency Analysis (FWRC 19.90) Based on the submitted materials for a 4-unit, single-family short plat, the Institute of Transportation Engineers (ITE) Trip Generation - 8"' Edition, land use code 210 (Single -Family Detached Housing), the proposed project is estimated to generate approximately 6 new weekday PM peak hour trips, 13 morning peak hour trips, and 13 Saturday peak hour trips. 2. A concurrency permit is required for this development project. The PW Traffic Division will perform concurrency analysis to determine if adequate roadway capacity exists during the weekday PM peak period to accommodate the proposed development. Please note that supplemental transportation analysis and concurrency mitigation may be required if the proposed project creates an impact not anticipated in the six -year Transportation Improvement Plan (TIP). 12-103115 Doc. I D. 61676 Mr. Strelyuk Page 7 August 9, 2012 3. The estimated fee for the concurrency permit application is $344.50 (1 -10 Trips). This fee is an estimate and based on the materials submitted during the preapplication meeting. The concurrency application fee must be paid in full at the time the concurrency permit application is submitted with land use application. The fee may change based on the new weekday PM peak hour trips as identified in the concurrency trip generation. The applicant has the option of having an independent traffic engineer prepare the concurrency analysis consistent with City procedures; however, the fee remains the same. Transportation Impact Fees (TIF) (FWRC 19.91) Based on the submitted materials for 4 single-family lots, the estimated traffic impact fee is $12.812. The actual fee will be calculated and paid at the time of plat recording. The applicant may defer part or all of the impact fee payment amount to either building permit issuance; or to later than closing of the sale of the single family home. If this option is selected, a covenants prepared by the city to enforce payment of the deferred fees will be recorded at the applicant's expense on each lot at the time of plat recording for residential land divisions. Street Frontage Improvements (FWRC 19.135) 1. The applicant/owner would be expected to construct street improvements consistent with the planned roadway cross -sections as shown in Map III-6 of the FWCP and Capital Improvement Program (CIP) shown as Table III-19 (FWRC 19.135.040). Based on the materials submitted, staff conducted a limited analysis to determine the required street improvements. The applicant would be expected to construct improvements on the following streets to the City's planned roadway cross -sections: ■ SW 312t' Street is a Minor Arterial planned as a Type "K" street, consisting of a 44-foot street with curb and gutter, six-foot planter strips with street trees, 8-foot sidewalks, and street lights in a 78-foot right-of-way (ROW). Assuming a symmetrical cross section, half street improvements are required as measured from the street centerline with no additional ROW dedication. 8`h Avenue SW is a Minor Collector planned as a Type "S" street, consisting of a 36-foot street with curb and gutter, 4-foot planter strip with street trees, 5-foot sidewalks, and streetlights in a 60-foot right-of-way (ROW). Assuming a symmetrical cross section, no ROW dedication and half street improvements are required as measured from the street centerline. Improvements may include half -width grind and overlay of the existing pavement. Internal street(s) should be Type a "DD" driveway, consisting of a 20-foot paved roadway in a 25-foot private driveway and utilities easement. The owner may be required to dedicate additional right-of-way (ROW) to accommodate additional turn lane improvements if identified in the transportation analysis and/or property corner radius. 3. The applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements (FWRC 19.135.070). Information about right-of-way modification requests is available through the Public Works Development Services Division. Please note that these modification requests have a nominal review fee currently at $85.50. 4. Tapers and transitions beyond the project frontage may be required as deemed necessary for safety purposes, taper rate shall be WS^2/60 or as directed by the Public Works Director. 12-10311 S Doc. I.D. 61676 Mr. Strelyuk Page 8 August 9, 2012 Access Management (FWRC 19.135) 1. Access management standards are based on roadway safety and capacity requirements. FWRC 19.135.280 provides access standards for streets based on planned roadway cross -sections. Please note that access classifications are per Drawing 3-1A in the Public Works Development Standards. Although code does not address this directly, the proximity of the site access to the intersection of 8a' Avenue SW and SW 312'h Street may create sight distance issues for those leaving the site, particularly creating a conflict with the westbound right -turn movement at the intersection. The access should be located as near as possible to the north property line to minimize this potential safety issue. LAKEHAVEN UTILITY DISTRICT (Brian Asbury, 253-946-5407, basbury@lakehaven.org) Water 1. A Certificate of Water Availability (application form enclosed) issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications (check with land use agency for requirement). Certificate is valid for one (1) year from date of issuance. If Certificate is needed, allow 10 work days to issue for typical, 3 work days for accelerated, processing. 2. Lakehaven does not have local water distribution system hydraulic information (aka `fire flow') available for this area. Water system hydraulic information may be needed to determine fire protection (if any) &/or other water service requirements; in addition to potentially being needed by the applicant's fire protection system designer (if required). Applicant can request Lakehaven perform a separate hydraulic model analysis, or can request this analysis to be performed concurrent with an application for Availability. Current 2012 cost for a hydraulic model analysis is $180.00. Please contact Lakehaven for further detail. 3. The site does not have any existing or previous water service connection(s). 4. The site does not have any existing water system capacity credits (ERU). 5. A water service connection application (form enclosed) submitted separately to Lakehaven is required for each new service connection to the water distribution system, in accordance with standards defined in Lakehaven's current `Fees and Charges Resolution'. 6. Residential fire protection systems proposed to be connected to a residential domestic water service connection shall require installation of a private double check valve assembly (DCVA) directly adjacent to the service meter box. 7. Proof of new, recorded private, water easement will be required across the westerly new short plat lots, for the benefit of the new easterly short plat lots (presuming all new water services/meters along 8th Ave SW). This private easement shall cover off -site property along the route of the affected portion of the private water supply line(s) from the edge of public right-of-way or Lakehaven easement to each affected new short plat lot. Based on the proposal submitted, preliminary estimated Lakehaven water service connection fees/charges/deposits (2012 schedule) will be as follows. All Lakehaven fees, charges and deposits are typically reviewed & adjusted (if necessary) annually, but are subject to change without notice. ■ Water Service/Meter Installation: $4,020.00 each lot. 1" size meter presumed for this estimate, actual size TBD by Lakehaven based on plumbing fixture count submitted by applicant. • Capital Facilities Charge(s)-Water: $3,232.00 each lot. • Charge -Payable -in -Lieu -of -Extension (CPILOE): $1,941.33 forthe existing parcel. "West Side Improvements (A)" project (1966), 339.34 front footage along SW 312th St. • Latecomer Charge: $N/A. ■ Service Agreement Charge(s): $None anticipated. • County Document Recording Fees: $None anticipated. • ROW Permit Fee (Agency): $600.00 each lot, City of Federal Way permit. • Other (describe): $None anticipated. Sewer 1. A Developer Extension Agreement will be required to construct new and/or abandon existing sanitary sewer facilities necessary for the proposed development. Additional detail and/or design requirements can be obtained from Lakehaven by completing & submitting a separate application to Lakehaven for either a Developer Pre -Design Meeting or a Developer Extension Agreement (application forms attached). Lakehaven continues to encourage owners/developers/applicants to apply for Lakehaven processes separately to Lakehaven, early in the pre-design/planning phase to avoid delays in overall project development. 2. In lieu of the requirement for a Developer Extension AMement sewer service connection(s) for the proposed development may be conditionally allowed by Lakehaven; depending significantly on the extent of ROW improvements required along 8th Ave SW. Owners/developers/applicants will need to submit a brief written request (letter, email, or fax) separately to Lakehaven for this standards modification. Such service connection(s) would be subject to owner's acquisition of any private sewer/utility easement on adjacent property (if necessary) and payment of temporary service (earlycomer) charges assessed with the sewer service connection application. Where future, permanent Lakehaven sewer system facilities would be located across the owner's property, the owner shall be required to grant to Lakehaven all necessary easements for the construction and operation/maintenance of the future Lakehaven facilities in locations and on forms approved by Lakehaven. Lakehaven continues to encourage owners/developers/applicants to submit this separately to Lakehaven, early in the pre-design/planning phase to avoid delays in overall project development. The site does not have any existing or previous sewer service connections. The site does not have any existing sewer system capacity credits (ERU). A separate Lakehaven sewer service connection permit (application form enclosed) is required for each new connection to the sanitary sewer system or any modification (re -align, abandon, etc.) to an existing sewer service connection, in accordance with standards defined in Lakehaven's current `Fees and Charges Resolution'. Proof of new, recorded private, sewer easement will be required across the westerly new short plat lots, for the benefit of the new easterly short plat lots (presuming all new sewer service connections along 8th Ave SW). This easement area(s) may be reserved on the recorded short plat documents. 7. The associated Developer Extension Agreement must achieve a point of either Substantial Completion or Acceptance, as determined by Lakehaven prior to activating any new sewer service connection(s). 8. Based on the proposal submitted, preliminary estimated 2012 Lakehaven sewer service connection charges (2012 schedule) will be as follows. Actual connection charges will be determined upon submittal of service connection application(s) to Lakehaven. All Lakehaven fees & charges are typically reviewed & adjusted (if necessary) annually, but are subject to change without notice. ■ Sewer Service Connection Permit Fee: $310.00 each lot. ■ Capital Facilities Charge(s)-Sewer: $2,968.00 each lot. • Discharge Agreement Charge: $N/A. • Charge -Payable -in -Lieu -of -Extension (CPILOE): $N/A. ■ Latecomer Charge: $TO -BE -DETERMINED. The site is subject to developer latecomer charges for sewer mainline facilities constructed in 8th Ave SW by an adjacent developer. This project is not yet completed at this time, nor have any latecomer calculations been prepared. Please contact Lakehaven for further detail. • ROW Permit Fee (Agency): $600.00 each lot, City of Federal Way permit. General All comments herein are valid for one (1) year and are based on the proposal(s) submitted and Lakehaven's current regulations and policies. Any change to either the development proposal(s) or Lakehaven's regulations and policies may affect the above comments accordingly. SOUTH KING FIRE AND RESCUE (Chris Ingham, 253-946-7244, chris.ingham@southlangfire.org) 1. Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 ft. from fire apparatus vehicle access. 2. Fire apparatus access roads: a) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. b) Shall be designed and maintained to support the imposed load of a 75,000 pound fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. c) Shall be not less than a 20-foot inside turning radius and not less than a 40-foot outside turning radius. d) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac. All such cul-de-sacs shall be not less than 80 feet in diameter. e) Gradient shall not exceed 15 percent.
