The City of Federal Way's Department of Community Development has received your request for a work
hour variance to perform construction activities outside of normal working hours. The proposed project
site is located on S. 322nd St. and 23`d Ave S. in Federal Way. The proposed work hours are between 7:00
pm and 6:00 am and will occur October 13, 2015. Additional work outside of City of Federal Way
working hours is proposed between 8:00 am and 9:00 am on October 13, 2015. As such, relief from
Federal Way Revised Code (FWRC) 19.105.040, "Regulation of Work Hours" is needed.
Work Hour Exception
Pursuant to FWRC 19.105.040, work hours are permitted outright between the following hours:
7:00 a.m. and 8:00 p.m. Monday through Friday
9:00 a.m. and 8:00 p.m. Saturday
Development activities and heavy equipment operations are also not permitted on Sundays or holidays
observed by the city. However, the director of community development may grant revocable written
permission to engage in development activity other than the above permitted times, in accordance with
FWRC 19.105040(2)(a):
a) Any exception must be requested by advance written request to the director, including a
description of the specific exception(s) requested; proposed temporary construction mitigation measures
for any related impacts such as traffic, noise, and glare; and an analysis of how the request meets the
following criteria:
i. The work will not result in substantial adverse impacts to surrounding properties.
ii. The exception is necessary to avoid undue delay of project completion and/or long-term
inconvenience or disruption to the public.
Approval
The proposed night work activity involves the subcontractor, G&G, saw -cutting the existing pavement for
the installation of 11 new traffic loops, splicing the loop wire and sealing the loops. Working at night is
needed to minimize the traffic impacts that result from working in the right-of-way, as well as to avoid
upcoming adverse weather conditions.

Work on the morning of October 13"' will involve temporary paving, asphalt paving, roller compaction
clean up and temporary patching. Starting earlier in the day than typically is allowed will ensure the
contractor completes the work that day; a police officer will be on site to direct traffic.
Based on your written request and as a follow-up pursuant to the email approval issued by City of Federal
Way Planning Manager Isaac Conlen, on Monday, October 12, 2015, the Director of Community
Development hereby grants you revocable approval to engage in construction activity between 7:00 pm
and 6:00 am on October 13, 2015.
Notice
Pursuant to FWRC 19.105.040(3), written notice at least seven days prior to the proposed work activity is
required before a work hour variance may be granted. However, pursuant to FWRC 19.105.040(4),
"Waiver of Notice," the Director of Community Development may waive this requirement.
The Director hereby waives the notice requirement as the proposal will have minimal noise impact on
nearby residents and businesses.
Closing
Please be advised that the city may revoke or modify any exceptions approved under this section based on
verified complaints that the development activity or equipment operation does not meet the terms of the
approved exception, or if the activity creates some unanticipated and verifiable adverse effect.

Subject: S 324`h St Preservation Project — STPUL-1150(002)
Night Work variance Reqeust
Mr. Conlen,
The Streets Division is requesting a variance per section FWRC code 19.105.040 subsection (2)
to do night work at the location of S 288th Street and Military Road for work being constructed
by Tucci and Sons, Inc. due to the amount of work that needs to performed to complete the work
in time and prior to adverse weather as follows:
(1) Work hours: 7pm to 6am starting 10-13-2015 for 1 night.
(2) (a) Reasons for night work: Requested by Public Works Streets Division to minimize traffic
impacts for traffic detection loop installation and allow for schedule for City project paving to be
maintained.. This would allow the contractor to begin work earlier in order to ensure completion
of the paving operations that day.
(2) (b) Work impact to surrounding properties: Work will be limited to 23`d Ave S from the
intersection S 322" d Street southwoard approximately 200 feet. The electrical sub -contractor,
G&G, will be installing 11 new traffic loops. Work will include sawcutting existing pavement
for the installation of loops, installation and splicing of the lop wire and sealing of the loops. Site
specific traffic control plans will be used.
(3) Notice: Businesses affected are: the northbound left -turn access to the Commons Mall will
be closed while lops are being installed. Multiple driveway entrances will remain open for
access into the mall. Other businesses not affected.
I am also requesting a waiver of the notification requirements under FWRC code 19.105.040
Regulation of Work Hours subsection (3), based on subsection (4), Waiver of Notice. Per
subsection (4), the Director may waive or modify the requirements of subsection (3), based on
project location, scope, scale or alternative comparable notification methods, and/or other
reasonable considerations.
The City plans to place Portable Changeable message signs up prior to the work notifying those
using S 3241h Street of the upcoming work. This will include dates and hours for the work. The

Contractor is also required to contact local businesses to notify them of the work. I am keeping
the Mall management informed via email for all work scheduled and theya re providing that
information to tenant stores.
